To carry out the spirit of the national video and telephone conference on intellectual property rights protection and law enforcement and the video and telephone conference on the special campaign of cracking down on intellectual property infringements and production and sales of counterfeit and shoddy commodities of the commercial system in the whole country, further rectify and regulate the market order in the field of commercial and trade circulation, intensify the protection of intellectual property rights, effectively control such illegal acts as infringement of trademark right, copyright and patent in the field of commercial and trade circulation, and enhance the awareness of general commercial and trade circulation enterprises of protecting intellectual property rights, the Ministry of Commerce decided to crack down on intellectual property infringements and production and sales of counterfeit and shoddy commodities in the field of commercial and trade circulation in the whole country, and hereby issue the Implementation Plan for Cracking down on Intellectual Property Infringements and Production and Sales of Counterfeit and Shoddy Commodities in the Field of Commercial and Trade Circulation to you. Please earnestly implement it by taking into consideration your actualities.
Please report the work, implementation of the plan and the relevant information to the Commercial Service Department of the Ministry of Commerce prior to December 27, 2010, and timely contact the Commercial Service Department on the opinions and suggestions in work.

Implementation Plan for Cracking down on Intellectual Property Infringements and Production and Sales of Counterfeit and Shoddy Commodities in the Field of Commercial and Trade Circulation
To comprehensively carry out the spirit of the national video and telephone conference on intellectual property rights protection and law enforcement, and further the implementation of the requirements of the Notice of the General Office of the State Council on Issuing the Plan for the Special Campaign of Cracking down on Intellectual Property Infringements and Production and Sales of Counterfeit and Shoddy Commodities (No.50 [2010] of the General Office of the State Council) and the Notice of the General Office of the State Council on the Division of Work in Carrying out the Spirit of the National Video and Telephone Conference on Intellectual Property Rights Protection and Law Enforcement (No.169 [2010] of the General Office of the State Council), we, according to the uniform arrangements of the Plan of the Ministry of Commerce for the Implementation of the Special Campaign of Cracking down on Intellectual Property Infringements and Production and Sales of Counterfeit and Shoddy Commodities, decided to crack down on intellectual property infringements and production and sales of counterfeit and shoddy commodities in the field of commercial and trade circulation in the whole country from December 2010 to March 2011, and the specific plan for implementation is as follows:

为贯彻落实全国知识产权保护与执法工作电视电话会议和全国商务系统打击侵犯知识产权和制售假冒伪劣商品专项行动电视电话会议精神，进一步整顿和规范商贸流通领域市场秩序，加大知识产权保护力度，有效遏制商贸流通领域侵犯商标权、著作权、专利权等违法行为，增强广大商贸流通企业知识产权保护意识，商务部决定在全国商贸流通领域开展打击侵犯知识产权和制售假冒伪劣商品工作，现将《商贸流通领域打击侵犯知识产权和制售假冒伪劣商品实施方案》印发你们。请结合实际，认真贯彻落实。
工作开展情况、贯彻落实方案及相关信息请于2010年12月27日前报送商务部商贸服务司，工作中的意见和建议，请及时与商贸服务司联系。

商贸流通领域打击侵犯知识产权和制售假冒伪劣商品实施方案
为全面贯彻全国知识产权保护与执法工作电视电话会议精神，深入落实《国务院办公厅关于印发打击侵犯知识产权和制售假冒伪劣商品专项行动方案的通知》（国办发[2010]50号）和《国务院办公厅关于贯彻落实全国知识产权保护与执法工作电视电话会议精神任务分工的通知》（国办函[2010]169号）要求，根据《商务部打击侵犯知识产权和制售假冒伪劣商品专项行动实施方案》统一部署，从2010年12月至2011年3月，在全国商贸流通领域开展打击侵犯知识产权和制售假冒伪劣商品工作，具体实施方案如下：

I. Overall Objective
We shall adhere to the principles of overall promotion, focusing on critical issues, combining crackdown and prevention, and seeking actual effects, seriously investigate and deal with cases on intellectual property infringements in the field of commercial and trade circulation jointly with the relevant departments, comprehensively enhance the level of protection of intellectual property rights in the field of commercial and trade circulation; establish sound communication and coordination mechanisms on the protection of intellectual property rights, strengthen the management and regulation of commercial and trade circulation enterprises, guide enterprises to conduct business operations according to law and in good faith; raise enterprises' awareness and ability of protecting intellectual property rights, improve the consumers' discerning capability, and create a sound atmosphere of consciously resisting counterfeit and shoddy products and attaching importance to the protection of intellectual property rights in the whole society.
