| [Brief Facts] The defendant Wang Doe (with his given name withheld) was the legal representative of Jiuquan A Yu Agricultural Technology Co., Ltd. (with its partial name withheld). In 2017, after the company processed and packaged the seed it propagated and the chili pepper seed purchased from others, it applied to the Seed Management Station of Suzhou District of Jiuquan City, Gansu Province for filing its production and distribution of the variety "Yujiaowang" with said Seed Management Station. Later, it failed in the application because of a quality issue. In December 2018, the company sold 3,500 cans of "Yujiaowang" chili pepper seed to Gansu A Ci Ecological Agriculture Development Co., Ltd. (with its partial name withheld) for total sales of 2.45 million yuan. Gansu A Ci Ecological Agriculture Development Co., Ltd. (with its partial name withheld) commissioned rural households in Suzhou District of Jiuquan City to sow 1,626 cans of "Yujiaowang" chili pepper seed. In July 2019, a large number of rogues appeared after farmers sowed the chili pepper seed, seriously affecting the yield and quality of chili pepper. According to the test, the purity of the chili pepper seed was 63.4%, far lower than the national standard of 95% and the purity of 96% marked on the cans, and the chili pepper seed was determined to be inferior. According to the estimation of crop yield, the average yield of the chili pepper was 1,783.2 kg per mu, of which 1,382.2 kg of chili pepper was of commercial value, far lower than the yield of 3,000 kg to 4,000 kg per mu marked on the cans. | [Judgment] The Primary People's Court of Suzhou District of Jiuquan City, Gansu Province held upon trial that the defendant Jiuquan A Yu Agricultural Technology Co., Ltd. and the defendant Wang Doe passed inferior products off as qualified products with sales value of 2.45 million yuan, which constituted the crime of producing and selling fake and inferior products. Wang Doe fell under the circumstance of surrender and might be subjected to a mitigated penalty in accordance with the law. Given that Wang Doe had a good attitude towards confession and showed repentance of his crime after his surrender, he might be subjected to lighter punishment in accordance with the law. Accordingly, the court imposed a fine of 2.45 million yuan on the defendant Jiuquan A Yu Agricultural Technology Co., Ltd. and sentenced the defendant Wang Doe to imprisonment of eleven years in addition to a fine of 1.23 million yuan, each for the crime of producing and selling fake and inferior products. | | 【裁判结果】 甘肃省酒泉市肃州区人民法院经审理认为，被告单位酒泉某豫农业科技有限公司、被告人王某某以不合格产品冒充合格产品，销售金额245万元，其行为已构成生产、销售伪劣产品罪。王某某具有自首情节，依法可减轻处罚。王某某归案后认罪态度好，有悔罪表现，依法可酌情从轻处罚。据此，以生产、销售伪劣产品罪判处被告单位酒泉某豫农业科技有限公司罚金二百四十五万元；判处被告人王某某有期徒刑十一年，并处罚金一百二十三万元。 |
