| | 永福县供水公司是自来水供水公用企业。吴某某向该公司申请用水，永福县供水公司要求其填写《用水报装申请表》，该申请表对用水和水表安装一并进行约定，并同时要求签订供水协议、缴纳安装工程预缴款。吴某某缴纳了水表费、安装费共计2500元。后吴某某不同意签订《个人用户供水安装工程施工协议》，要求自行购买水表，退还施工服务费。永福县供水公司未退款亦未给吴某某提供供水服务。吴某某认为永福县供水公司的行为构成捆绑交易等四项滥用市场支配地位行为，遂诉至法院。广西壮族自治区南宁市中级人民法院经审理认为，永福县供水公司在永福县所辖地域范围内的城市公共供水服务具有市场支配地位。永福县供水公司在该过程中并没有给予吴某某从别处购买供水设施材料和安装服务的选择权，据此认定永福县供水公司系以在用户申请供水时需同时购买供水设施安装的方式实施了捆绑交易行为，该合同应认定为无效。广西壮族自治区南宁市中级人民法院判决永福县供水公司返还吴某某安装费并支付利息，赔偿经济损失及合理开支。 |
