| | 湖南快乐阳光互动娱乐传媒有限公司（以下简称快乐阳光公司）是芒果TV网站的经营者。广州唯思软件股份有限公司（以下简称唯思公司）于2013年开始运营720浏览器。网络用户通过720浏览器的内置功能可以实现默认拦截屏蔽芒果TV网站片头广告及暂停广告、会员免广告的功能。快乐阳光公司认为唯思公司的行为构成不正当竞争，故诉至法院。一审法院判决驳回快乐阳光公司的诉讼请求。广州知识产权法院二审认为，唯思公司技术中立的抗辩不能成立，唯思公司的上述行为违反诚实信用原则和公认的商业道德、扰乱社会经济秩序，构成不正当竞争，判令唯思公司赔偿快乐阳光公司经济损失及合理开支80万元。 |
