| | 深圳市腾讯计算机系统有限公司、腾讯科技（深圳）有限公司（以下简称两原告），共同开发运营的个人微信产品，为消费者提供即时社交通讯服务。浙江搜道网络技术有限公司、杭州聚客通科技有限公司（以下简称两被告）开发运营的“聚客通群控软件”，利用Xposed外挂技术将该软件中的“个人号”功能模块嵌套于个人微信产品中运行，为购买该软件服务的微信用户在个人微信平台中开展商业营销、商业管理活动提供帮助。两原告主张两被告擅自获取、使用涉案数据，构成不正当竞争，诉至法院。杭州铁路运输法院认为网络平台中的数据，以数据资源整体与单一数据个体划分，网络平台方所享有的是不同的数据权益。两被告的相关被诉行为已危及微信产品数据安全，违反了相关法律规定及商业道德，构成不正当竞争行为。杭州铁路运输法院判令两被告立即停止涉案不正当竞争行为，共同赔偿两原告经济损失及合理开支共计260万元。 |
