The Provisions of Guangzhou City on Publicizing Governmental Information, which have been discussed and adopted at the 108th session of the 11th executive meeting of the city government, are hereby promulgated, and shall come into force on January 1, 2003.

Chapter I General Provisions
| | 第一章 总则
|
Article 1 The present provisions are formulated in accordance with the relevant laws and regulations and in combination with the actual situation of this city with a view to guaranteeing the individuals' and organizations' right to learn the truth, regulating the publicity of governmental information, increasing the transparency of administrative activities, and supervising governmental organs to exercise their powers in accordance with the law.
| | 第一条 为保障个人和组织的知情权，规范政府信息公开，增加行政活动的透明度，监督政府机关依法行使职权，依据有关法律、法规的规定，结合本市实际，制定本规定。

Article 2 Governmental information mentioned in the present provisions shall refer to the information produced, obtained or owned by the people's governments at all levels and by their functional departments and by the organizations exercising administrative powers in accordance with the law in the process of managing and providing public services.
| | 第二条 本规定所称的政府信息，是指各级人民政府及其职能部门以及依法行使行政职权的组织在其管理或提供公共服务过程中制作、获得或拥有的信息。

Article 3 The publicity of governmental information within the administrative division of Guangzhou City shall be subject to the present provisions.
| | 第三条 广州市行政区域内的政府信息公开，适用本规定。
|
Article 4 The people's government at all levels and their functional departments and the organizations exercising administrative powers in accordance with the law shall be the obligors for publicity, and shall perform the obligation of publicizing governmental information in accordance with the law.
Individuals and organizations shall be the obligees for publicity, and shall have the right to obtain governmental information in accordance with the law.
| | 第四条 各级人民政府及其职能部门以及依法行使行政职权的组织是公开义务人，应当依法履行公开政府信息的义务。
个人和组织是公开权利人，依法享有获取政府信息的权利。

Article 5 The competent department for publicity of government affairs under the people's government at each level shall be responsible for organizing the implementation of the present provisions.
The legal affairs department and supervising department under the people's government at each level shall, according to their respective functions, supervise the implementation of the present provisions.
| | 第五条 各级人民政府政务公开主管机构负责组织实施本规定。
各级人民政府法制机构、监察部门依照各自职能监督实施本规定。

Article 6 Governmental information shall be publicized in principle, and not be publicized exceptionally.
The publicity of governmental information shall comply with the principles of legitimacy, timeliness, genuineness and impartiality.

政府信息公开应当遵循合法、及时、真实和公正的原则。

Article 7 An obligee for publicity shall not, when exercising the right to obtain governmental information, infringe upon other's privacy, commercial secrets, state secrets or other public benefits.
No individual or organization shall illegally impede or restrict the obligor for publicity from publicizing governmental information; no individual or organization shall illegally impede or restrict the obligee for publicity from exercising the right to obtain governmental information in accordance with the law.
| | 第七条 公开权利人行使获得政府信息的权利，不得侵犯他人隐私、商业秘密、国家秘密或其他社会公共利益。
任何个人或组织不得非法阻挠或限制公开义务人公开政府信息的活动以及公开权利人行使依法获取政府信息的权利。

Article 8 An obligor for publicity shall not, when providing governmental information in accordance with the present provisions, collect any fees, unless otherwise provided for by laws, regulations or the present provisions.
The people's government at each level shall include the expenses for publicizing governmental information in the annual budget, so as to guarantee the normal activities of publicizing governmental information.
| | 第八条 公开义务人根据本规定提供政府信息，不得收费，法律、法规或本规定另有规定的除外。
各级人民政府应当将政府信息公开的经费纳入年度预算，保障政府信息公开活动的正常进行。

Chapter II Contents to be Publicized
| | 第二章 公开内容
|
Article 9 An obligor for publicity shall voluntarily publicize the governmental information in respect of the following affairs powers to the public:
| | 第九条 公开义务人应当主动向社会公开下列事权方面的政府信息：
|
(a) the social and economic development strategy, development plans, work target, and the information on the accomplishment within its administrative division;
| | （一）本行政区域的社会经济发展战略、发展计划、工作目标及完成情况；
|
(b) major decisions related to the whole situation;
| | （二）事关全局的重大决策；
|
(c) rules, regulatory documents and other policies and measures;
| | （三）规章、规范性文件及其他政策措施；
|
(d) the government's institutional structure, functions and basis of establishment;
| | （四）政府的机构设置、职能和设定依据；
|
(e) projects subject to the government's administrative approval;
| | （五）政府行政审批项目；
|
(f) treatment of the local major unexpected events;
| | （六）当地重大突发事件的处理情况；
|
(g) the promised matters and the information on the accomplishment.
An obligor for publicity shall voluntarily publicize the governmental information in respect of the following financial powers to the public:
| | （七）承诺办理的事项及其完成情况。
公开义务人应当主动向社会公开下列财权方面的政府信息：
|
(a) the government's annual financial budget report adopted by the people's congress at its level and the information on the implementation thereof;
| | （一）经本级人民代表大会通过的政府年度财政预算报告及其执行情况；
|
(b) information on the distribution and use of important special expenses, information on the bidding and purchase of important goods and materials and information on the bidding of major basic construction projects;
| | （二）重要专项经费的分配使用情况，重要物资招标采购情况和重大基本建设项目招投标情况；
|
(c) information on social commonweal constructed with governmental investments.
An obligor for publicity shall voluntarily publicize the governmental information in respect of the following personnel powers to the public:
| | （三）政府投资建设的社会公益事业情况。
公开义务人应当主动向社会公开下列人事权方面的政府信息：
|
(a) resumes of government leaders, division of their work and the information on their adjustment and change;
| | （一）政府领导成员的履历、分工和调整变化情况；
|
(b) conditions, procedure for and result of employment, selection, appointment and appraisal of civil servants;
| | （二）公务员录用、选拔任用、评选先进的条件、程序及结果；
|
(c) information on the assignment and displacement of the redundant civil servants due to the reform of government institutions.
| | （三）政府机构改革人员分流情况。
|
Article 10 An obligor for publicity shall voluntarily publicize the following governmental information to the public:
| | 第十条 公开义务人应当主动向社会公开下列政府信息：
|
(a) basis of administrative acts;
| | （一）行政行为的依据；
|
(b) procedure of administrative acts;
| | （二）行政行为的程序；
|
(c) time limit of administrative acts;
| | （三）行政行为的时限；
|
(d) avenue and time limit for remedy.
| | （四）救济途径和时限。
|
Article 11 An obligor for publicity shall, when making a decision on administrative treatment concerning the counterpart, voluntarily inform him of the following governmental information:
| | 第十一条 公开义务人对相对人作出行政处理决定时，应当主动向其告知下列政府信息：
|
(a) the deciding department;
| | （一）决定部门；
|
(b) the procedure for decision;
