The Provisions on the Administration of Contents of TV Plays, which were adopted at the executive meeting of the State Administration of Radio, Film and Television on March 26, 2010, are hereby promulgated, and shall come into force as of July 1, 2010.

Chapter I General Provisions
| | 第一章 总 则
|
Article 1 These Provisions are formulated in accordance with the Regulations on the Administration of Broadcasting and Television to regulate the administration of the contents of TV plays, prosper the creation of TV plays and promote the healthy development of the industry of TV plays.
| | 第一条 为了规范电视剧内容管理工作，繁荣电视剧创作，促进电视剧产业的健康发展，根据《广播电视管理条例》，制定本规定。
|
Article 2 These Provisions shall apply to the production, distribution and broadcasting of the contents of TV plays.
| | 第二条 从事电视剧内容的制作、发行、播出活动，适用本规定。
|
Article 3 The term “TV plays” as mentioned in these Provisions refers to:
| | 第三条 本规定所称电视剧是指：
|
1. TV plays (including TV cartoons) to be broadcast by domestic TV stations or distributed within and without the territory of China, including TV plays produced by domestic entities (hereinafter referred to as the “domestically produced TV plays”) and TV plays jointly produced with overseas institutions (hereinafter referred to as the “Sino-foreign cooperatively produced TV plays”); and
| | （一）用于境内电视台播出或者境内外发行的电视剧（含电视动画片），包括国产电视剧（以下简称国产剧）和与境外机构联合制作的电视剧（以下简称合拍剧）；
|
2. TV plays (including TV cartoons and feature films, hereinafter referred to as the “imported TV plays”) imported from foreign countries for being broadcast by domestic TV stations.
| | （二）用于境内电视台播出的境外引进电视剧（含电视动画片、电影故事片，以下简称引进剧）。
|
Article 4 The production and broadcasting of the contents of TV plays shall adhere to the orientation of serving the people and socialism, the guidelines of letting a hundred flowers blossom and a hundred schools of thought contend, and the principles of getting close to reality, to life and to the masses, giving priority to social benefits and combining social benefits and economic benefits, so as to ensure the correct artistic orientation.
| | 第四条 电视剧内容的制作、播出应当坚持为人民服务、为社会主义服务的方向和百花齐放、百家争鸣的方针，坚持贴近实际、贴近生活、贴近群众，坚持社会效益第一、社会效益与经济效益相结合的原则，确保正确的文艺导向。
|
Article 5 No TV play shall contain any of the following contents:
| | 第五条 电视剧不得载有下列内容：
|
1. opposing the basic principles determined by the Constitution, instigating the resistance and disruption of the implementation of the Constitution, laws, administrative regulations and rules;
| | （一）违反宪法确定的基本原则，煽动抗拒或者破坏宪法、法律、行政法规和规章实施的；
|
2. endangering the unity, sovereignty and territorial integrity of the state;
| | （二）危害国家统一、主权和领土完整的；
|
3. divulging the state secrets, endangering state security or damaging the honor and interests of the state;
| | （三）泄露国家秘密，危害国家安全，损害国家荣誉和利益的；
|
4. inciting hatred or discrimination among ethnic groups, disrespecting ethnic customs or practices, hurting ethnic feelings or undermining the solidarity among ethnic groups;
| | （四）煽动民族仇恨、民族歧视，侵害民族风俗习惯，伤害民族感情，破坏民族团结的；
|
5. opposing the state's religious policies, advocating religious extremism, cult, superstition, discriminating against or insulting religious beliefs;
| | （五）违背国家宗教政策，宣扬宗教极端主义和邪教、迷信，歧视、侮辱宗教信仰的；
|
6. disrupting social order and harming social stability;
| | （六）扰乱社会秩序，破坏社会稳定的；
|
7. advocating obscenity, gambling, violence, terrorism, drug taking, abetting the commission of a crime or imparting methods for committing crimes;
| | （七）宣扬淫秽、赌博、暴力、恐怖、吸毒，教唆犯罪或者传授犯罪方法的；
|
8. insulting or defaming others;
| | （八）侮辱、诽谤他人的；
|
9. harming the social morality or the excellent national culture and tradition;
| | （九）危害社会公德或者民族优秀文化传统的；
|
10. infringing upon the legitimate rights and interests of minors or endangering the physical and mental health of minors; or
| | （十）侵害未成年人合法权益或者有害未成年人身心健康的；
|
11. containing any other content prohibited by any law, administrative regulation or rule.
The administrative department of radio, film and television under the State Council shall, in accordance with the provisions of the preceding paragraph, formulate the specific standards for the administration of the contents of TV plays.
| | （十一）法律、行政法规和规章禁止的其他内容。
国务院广播影视行政部门依据前款规定，制定电视剧内容管理的具体标准。

Article 6 The administrative department of radio, film and television under the State Council shall be responsible for the administration and supervision of the contents of TV plays in the whole country.
The administrative department of radio, film and television of the people's government of a province, autonomous region or municipality directly under the Central Government shall be responsible for the administration and supervision of the contents of TV plays within its administrative region.
| | 第六条 国务院广播影视行政部门负责全国的电视剧内容管理和监督工作。
省、自治区、直辖市人民政府广播影视行政部门负责本行政区域内的电视剧内容管理和监督工作。

Article 7 The administrative department of radio, film and television under the State Council and the administrative departments of radio, film and television of the people's governments of provinces, autonomous regions and municipalities directly under the Central Government shall actively establish and improve the electronic office system for the administration of the examination and approval of TV plays to promote the e-government administration.
| | 第七条 国务院广播影视行政部门和省、自治区、直辖市人民政府广播影视行政部门应当积极建立和完善电视剧审批管理的电子办公系统，推行电子政务。
|
Chapter II Record-filing and Announcement
| | 第二章 备案和公示
|
Article 8 The record-filing and announcing system shall be implemented for the shooting and production of domestically produced TV plays and Sino-foreign cooperatively produced TV plays.
| | 第八条 国产剧、合拍剧的拍摄制作实行备案公示制度。
|
Article 9 The administrative department of radio, film and television under the State Council shall be responsible for announcing the TV plays shot and produced in the whole country. The administrative department of radio, film and television of the people's government of a province, autonomous region or municipality directly under the Central Government shall be responsible for accepting the record-filing of the TV plays shot and produced by the production entities within its administrative region, and upon its examination, report them to the administrative department of radio, film and television under the State Council for announcement.
A production entity which directly goes through record-filing formalities with the administrative department of radio, film and television under the State Council in accordance with the relevant provisions (hereinafter referred to as the “direct record-filing production entity”) shall obtain the consent of the competent department at a higher level before going through the formalities for record-filing of a TV play shot and produced by itself.
| | 第九条 国务院广播影视行政部门负责全国拍摄制作电视剧的公示。
省、自治区、直辖市人民政府广播影视行政部门负责受理本行政区域内制作机构拍摄制作电视剧的备案，经审核报请国务院广播影视行政部门公示。
按照有关规定向国务院广播影视行政部门直接备案的制作机构（以下简称直接备案制作机构），在将其拍摄制作的电视剧备案前，应当经其上级业务主管部门同意。

Article 10 A production entity which meets any of the following conditions may apply for the record-filing and announcement of the shooting and production of TV plays:
| | 第十条 符合下列条件之一的制作机构，可以申请电视剧拍摄制作备案公示：
|
1. holding a TV Play Production License (Class A);
| | （一）持有《电视剧制作许可证（甲种）》；
|
2. holding a Radio and TV Program Production and Business Operation License;
| | （二）持有《广播电视节目制作经营许可证》；
|
3. It is a TV station at or above the level of a city divided into districts (including a radio or TV station or a radio, film and television group);
| | （三）设区的市级以上电视台（含广播电视台、广播影视集团）；
|
4. holding a Film Production License; or
| | （四）持有《摄制电影许可证》；
|
5. It is any other production entity with the qualification for applying for the TV Play Production License (Class B).
| | （五）其他具备申领《电视剧制作许可证（乙种）》资质的制作机构。
|
Article 11 The administrative department of radio, film and television of the people's government of a province, autonomous region or municipality directly under the Central Government or a direct record-filing production entity shall, when filing an application with the administrative department of radio, film and television under the State Council for the record-filing and announcement of the shooting and production of a TV play, submit the following materials:
| | 第十一条 省、自治区、直辖市人民政府广播影视行政部门、直接备案制作机构向国务院广播影视行政部门申请电视剧拍摄制作备案公示，应当提交下列材料：
|
1. A Record-filing and Announcement Form on the Shooting and Production of a TV Play or an Application for the Initiation of a TV Play involving any Significant Revolutionary or Historic Event, to which the corresponding official seal shall be affixed;
| | （一）《电视剧拍摄制作备案公示表》或者《重大革命和重大历史题材电视剧立项申报表》，并加盖对应的公章；
|
2. A brief introduction (not less than 1,500 Chinese characters), which truthfully and accurately describes the theme, main characters, background, stories and other contents of the TV play; and
| | （二）如实准确表述剧目主题思想、主要人物、时代背景、故事情节等内容的不少于1500字的简介；
|
3. If the TV play involves any significant theme or any sensitive content involving politics, military affairs, diplomacy, national security, united front, ethnic issues, religion, judicial issues, public security, etc. (hereinafter referred to as the “special themes”), the written opinions issued by the relevant competent department of the people's government at or above the level of a province, autonomous region or municipality directly under the Central Government or the relevant parties shall be provided.
