Order of the Ministry of Foreign Trade and Economic Cooperation of the People's Republic of China

The “Measures on the Administration of Designated Trading on the Import of Goods”, which were discussed and adopted by the Ministry of Foreign Trade and Economic Cooperation at the 9th minister's working meeting in 2001 in accordance with the “Foreign Trade Law of the People's Republic of China” and the “Regulations of the People's Republic of China on the Administration of the Import and Export of Goods”, are hereby promulgated, and shall come into force on January 1, 2002.

根据《中华人民共和国对外贸易法》和《中华人民共和国货物进出口管理条例》，《货物进口指定经营管理办法》已经对外贸易经济合作部２００１年第９次部长办公会议讨论通过，现予公布，自２００２年１月１日起施行。

Article 1These Measures are enacted in accordance with the “Foreign Trade Law of the People's Republic of China” and the “Regulations of the People's Republic of China on the Administration of the Import and Export of Goods” in order to maintain the import trading order of the goods subject to designated trading administrations.
| | 第一条 为了维护指定经营管理货物的进口经营秩序，根据《中华人民共和国对外贸易法》和《中华人民共和国货物进出口管理条例》，制定本办法。

Article 2 The Ministry of Foreign Trade and Economic Cooperation of the People's Republic of China (hereinafter referred to as “the MOFTEC”) shall make, adjust and promulgate the catalogue of the goods subject to import designated by the trading administration.
| | 第二条 实行进口指定经营管理的货物目录由对外贸易经济合作部（以下简称“外经贸部”）制定、调整并公布。

Article 3 The import business of the goods subject to import designated by the trading administration shall be carried out by the enterprises designated by MOFTEC (hereinafter referred to as “designated trading enterprises”), and non-designated trading enterprises shall not be engaged in the import business of this kind of good.
| | 第三条 实行进口指定经营管理的货物，由外经贸部指定的企业（以下简称“指定经营企业”）从事进口经营业务，非指定经营企业不得从事该类货物的进口经营业务。

Article 4 MOFTEC shall determine the designated trading enterprises in the principles of justice, openness and fairness. The quantity of the designated trading enterprises shall increase by the year. The directory of the designated trading enterprises shall be promulgated by MOFTEC.
| | 第四条 外经贸部按照公正、公开、公平原则确定指定经营企业。指定经营企业的数量逐年增加。指定经营企业名录由外经贸部公布。

Article 5 An enterprise applying for being a designated trading enterprise shall fulfill the following conditions:
| | 第五条 申请指定经营企业，应当具备以下条件：
|
(1) having the same status as that of a legal person, and having no less than 10 million Yuan of registered capital (For enterprises in special economic zones, Shanghai Pudong New Area and the middle and west regions, the registered capital of each enterprise shall be no less than 5 million Yuan);
| | （一）具有企业法人资格，注册资本不低于１０００万元人民币（经济特区、上海浦东新区、中西部地区的企业不低于５００元万人民币）；
|
(2) having corresponding purchasing and selling avenues for information on domestic and foreign markets;
| | （二）具有相应的采购和销售渠道，了解国内外市场情况；
|
(3) having held the qualification for import/export operation for two years or more, and having no trading records in violation of laws or rules within two years;
| | （三）具有进出口经营资格已满两年，并且两年内无违法违规经营记录；
|
(4) other conditions provided for by the MOFTEC.
| | （四）外经贸部规定的其他条件。

Article 6 An enterprise applying for being a designated trading enterprise shall submit the following documents to MOFTEC:
| | 第六条 申请指定经营企业，需向外经贸部提交以下材料：
|
(1) application form for being a designated trading enterprise;
| | （一）指定经营企业申请表格；
|
(2) duplicate of the “Business License for Enterprise Legal Person” which has passed the annual inspection;
