Announcement of the Supreme People's Court and Supreme People's Procuratorate of the People's Republic of China
(Interpretation No. 3 [2005] of the Supreme People's Court)
The Interpretation by the Supreme People's Court and the Supreme People's Procuratorate on Several Issues Concerning the Specific Application of Law in the Handling of Criminal Gambling Cases, as adopted at the 1349th meeting of the Judicial Committee of the Supreme People's Court on April 26, 2005 and at the 34th meeting of the 10th Procuratorate Committee of the Supreme People's Procuratorate on May 8, 2005, is hereby issued, with effect from May 13, 2005.

Interpretation by the Supreme People's Court and the Supreme People's Procuratorate on Several Issues Concerning the Specific Application of Law in the Handling of Criminal Gambling Cases
For the purpose of punishing criminal activities of gambling, in accordance with the relevant provisions of the Criminal Law, several issues concerning the specific application of law in the handling of criminal gambling cases are hereby interpreted as follows:

《最高人民法院、最高人民检察院关于办理赌博刑事案件具体应用法律若干问题的解释》已于2005年4月26日由最高人民法院审判委员会第1349次会议通过，2005年5月8日由最高人民检察院第十届检察委员会第34次会议通过，现予公布，自2005年5月13日起施行。

最高人民法院、最高人民检察院关于办理赌博刑事案件具体应用法律若干问题的解释
为依法惩治赌博犯罪活动，根据刑法的有关规定，现就办理赌博刑事案件具体应用法律的若干问题解释如下：

Article 1 Whoever, for the purpose of making profits, is under any of the following circumstances shall fall within the scope of “gathering people to engage in gambling” as described in Article 303 of the Criminal Law:
| | 第一条 以营利为目的，有下列情形之一的，属于刑法第三百零三条规定的“聚众赌博”：
|
(1)Organizing 3 persons or more to engage in gambling and having accumulatively reaped illicit gains in a sum of 5,000 yuan or more by taking a percentage from the gambling money;
| | （一）组织3人以上赌博，抽头渔利数额累计达到5000元以上的；
|
(2)Organizing 3 or more persons to engage in gambling and the accumulative gambling stakes accounting for 50, 000 yuan or more;
| | （二）组织3人以上赌博，赌资数额累计达到5万元以上的；
|
(3)Organizing 3 or more persons to engage in gambling and the accumulative number of gamblers accounting for 20 or more; or
| | （三）组织3人以上赌博，参赌人数累计达到20人以上的；
|
(4)Organizing 10 or more persons to engage in gambling abroad and from which he charges kickbacks and referral fees.
