Notice of the Supreme People's Court on Issuing the Provisions on “Five Prohibits” and the Punishment Measures for Violations against the Provisions on “Five Prohibits”

The local people's courts at all levels, military courts at all levels, railway transportation intermediate courts and grassroots courts, and maritime courts; and the courts of Xinjiang Production and Construction Corps at all levels:
The Provisions on “Five Prohibits” and the Punishment Measures for Violations against the Provisions on “Five Prohibits” of the Supreme People's Court, which have been deliberated and adopted by the Party Leadership Group of the Supreme People's Court, are hereby issued to you for your earnest implementation.

全国地方各级人民法院、各级军事法院、各铁路运输中级法院和基层法院、各海事法院，新疆生产建设兵团各级法院：
最高人民法院《关于“五个严禁”的规定》和《关于违反“五个严禁”规定的处理办法》已经最高人民法院党组讨论通过，现印发给你们，请认真执行。

关于“五个严禁”的规定
（2009年1月8日起施行）

I. It is prohibited to accept the treats and gifts given by parties concerned to cases and other related parties.
| | 一、严禁接受案件当事人及相关人员的请客送礼；
|
II. It is prohibited to have unlawful contact with lawyers in violation of provisions.
| | 二、严禁违反规定与律师进行不正当交往；
|
III. It is prohibited to intervene in or inquire about the cases handled by other persons.
| | 三、严禁插手过问他人办理的案件；
|
IV. It is prohibited to engage in malpractice for personal gains in the process of entrusting the assessment or auction work.
| | 四、严禁在委托评估、拍卖等活动中徇私舞弊；
|
V. It is prohibited to disclose any secret involved in the judicial work.
Where any staff member of the people's courts violates the above-mentioned provisions, he shall be subject to corresponding disciplinary liability or even criminal liability. If he holds a post in adjudication or enforcement, he shall be removed from the office.
Punishment Measures for Violations against the Provisions on “Five Prohibits”
| | 五、严禁泄露审判工作秘密。
人民法院工作人员凡违反上述规定，依纪依法追究纪律责任直至刑事责任。从事审判、执行工作的，一律调离审判、执行岗位。
关于违反“五个严禁”规定的处理办法

Article 1 These Measures are formulated for the purpose of making the working disciplines of the people's courts more solemn and implementing the Provisions on “Five Prohibits”.
| | 第一条 为了严肃人民法院工作纪律、确保“五个严禁”规定落到实处，特制定本办法。
|
Article 2 The expression of “accepting the treats and gifts given by parties concerned to cases and other related parties” as mentioned in the Provisions on “Five Prohibits” means to accept the money, articles, meals, recreational arrangements, tours or other interests offered by the parties concerned to cases, their defenders, their attorneys as well as the staff of entities entrusted for auditing, assessment, auction, selling-off, authentication or bankruptcy management.
．．．．．． | | 第二条 “五个严禁”规定所称“接受案件当事人及相关人员的请客送礼”，是指接受案件当事人、辩护人、代理人以及受委托从事审计、评估、拍卖、变卖、鉴定或者破产管理等单位人员的钱物、请吃、娱乐、旅游以及其他利益的行为。
