According to the relevant provisions in the Notice of the State Council on Implementing the Price and Tax Reform of Refined Oil (No. 37 [2008] of the State Council), we have formulated the Administrative Measures for Oil Prices (For Trial Implementation), which are hereby issued to you, please implement them accordingly.

各省、自治区、直辖市、新疆生产建设兵团发展改革委、物价局，中国石油天然气集团公司、中国石油化工集团公司、中国海洋石油总公司：
根据《国务院关于实施成品油价格和税费改革的通知》（国发[2008]37号）等有关规定，现将我们制定的《石油价格管理办法（试行）》印发给你们，请按照执行。

Article 1 These Measures are formulated according to the relevant provisions in the Notice of the State Council on Implementing the Price and Tax Reform of Refined Oil (No. 37 [2008] of the State Council) for the purpose of perfecting China's oil pricing mechanism and standardizing the pricing activities.
| | 第一条 为完善我国石油价格形成机制，规范价格行为，根据《国务院关于实施成品油价格和税费改革的通知》（国发[2008]37号）的有关规定，制定本办法。

Article 2 The “oil” as mentioned in these Measures shall include crude oil, and gasoline, diesel, aviation kerosene, aviation gasoline and other refined oil products from crude oil.
| | 第二条 本办法所称石油包括原油以及由原油炼制的汽油、柴油、航空煤油和航空汽油等成品油。

Article 3 Those enterprises engaging in oil production, wholesale and retail in China shall abide by these Measures.
| | 第三条 在我国从事石油生产、批发和零售的企业，应遵守本办法。

Article 4 Crude oil prices shall be determined by enterprises on their own by reference to the international market prices. The prices of the crude oil mutually supplied between China National Petroleum Corporation (CNPC) and China Petrochemical Corporation (Sinopec) shall be determined by both sides according to the costs for transport of domestic onshore crude oil to the refinery and the costs for importing crude oil from the international market to the refinery. The price of crude oil supplied by CNPC or Sinopec to local refineries shall be determined by reference to the price given to each other by these two corporate groups. The price of crude oil produced by China National Offshore Oil Corporation and other enterprises shall be determined on their own by reference to the international market price.
| | 第四条 原油价格由企业参照国际市场价格自主制定。中国石油化工集团公司（以下简称中石化）和中国石油天然气集团公司（以下简称中石油）之间互供原油价格由购销双方按国产陆上原油运达炼厂的成本与国际市场进口原油到厂成本相当的原则协商确定。中石化、中石油供地方炼厂的原油价格参照两个集团公司之间互供价格制定。中国海洋石油总公司及其他企业生产的原油价格参照国际市场价格由企业自主制定。

Article 5 Refined oil prices shall be government-guided or government-fixed based on different situations.
| | 第五条 成品油价格区别情况，实行政府指导价或政府定价。
|
(1) Gasoline, diesel retail and wholesale prices, as well as gasoline, diesel prices for private wholesale businesses, railway, transport and other special users shall be guided by the government; and
| | （一）汽、柴油零售价格和批发价格，以及供应社会批发企业、铁路、交通等专项用户汽、柴油供应价格实行政府指导价；

(2) Gasoline, diesel prices for national reserves and Xinjiang Production and Construction Corps, as well as ex-factory prices of aviation gasoline and aviation kerosene shall be set by the government.
| | （二）国家储备和新疆生产建设兵团用汽、柴油供应价格，以及航空汽油、航空煤油出厂价格实行政府定价。

Article 6 When the average crude oil price on international market fluctuates 4% or more for consecutively 22 working days, domestic refined oil prices may be adjusted accordingly.
| | 第六条 当国际市场原油连续22个工作日移动平均价格变化超过4%时，可相应调整国内成品油价格。

Article 7 When the crude oil price on international market is lower than USD 80 per barrel, domestic refined oil prices shall be calculated according to the normal profit rate for refiners. When the crude oil price on international market is higher than USD 80 per barrel, the profit rate for refiners shall start to decline until reaching a zero rate of profit. When the crude oil price on international market is higher than USD 130 per barrel, the NDRC will adopt proper fiscal and tax policies to ensure production and supply of refined oil products; and gasoline and diesel prices may not to be raised in principle or will only be increased a little based on consideration of the interests of both manufactures and consumers, and the stability of the national economy.
．．．．．． | | 第七条 当国际市场原油价格低于每桶80美元时，按正常加工利润率计算成品油价格。高于每桶80美元时，开始扣减加工利润率，直至按加工零利润计算成品油价格。高于每桶130美元时，按照兼顾生产者、消费者利益，保持国民经济平稳运行的原则，采取适当财税政策保证成品油生产和供应，汽、柴油价格原则上不提或少提。
