The Administrative Measures for the Report of Occupational Hazards at Work Places, which were deliberated and adopted at the director's meeting of the State Administration of Work Safety, are hereby promulgated and shall come into force as of November 1, 2009.

《作业场所职业危害申报管理办法》已经2009年8月24日国家安全生产监督管理总局局长办公会议审议通过,现予公布,自2009年11月1日起施行。

作业场所职业危害申报管理办法
Article 1 To regulate the report of occupational hazards at work places and strengthen the supervision and administration of the occupational health work of the production and operation entities, these Measures are formulated in accordance with the Law of the People's Republic of China on the Prevention and Control of Occupational Diseases, Regulation on Labor Protection at Work Places Where Toxic Substances Are Used, other laws and regulations, and provisions of the State Council on adjusting the relevant functions in respect of the supervision and inspection of occupational health.
   第一条 为了规范作业场所职业危害的申报工作,加强对生产经营单位职业健康工作的监督管理,根据《中华人民共和国职业病防治法》、《使用有毒物品作业场所劳动保护条例》等法律、行政法规和国务院有关职业健康监督检查职责调整的规定,制定本办法。
Article 2 A production and operation entity which has or generates occupational hazards within the territory of the People's Republic of China (excluding coal mining enterprises) shall, under relevant laws and administrative regulations of the state as well as these Measures, timely and faithfully report the occupational hazards and accept the supervision and administration of the work safety administrative departments.
The administration of report of occupational hazards at work places of coal mining enterprises shall be provided separately.
   第二条 在中华人民共和国境内存在或者产生职业危害的生产经营单位(煤矿企业除外),应当按照国家有关法律、行政法规及本办法的规定,及时、如实申报职业危害,并接受安全生产监督管理部门的监督管理。
煤矿企业作业场所职业危害申报的管理,另行规定。
Article 3 The term “occupational hazards at work places” as mentioned in these Measures refers to all kinds of hazards to the physical health of the practitioners who are exposed to the dust, toxics and other hazardous factors during their occupational activities.
The occupational hazards at work places shall be determined according to the Catalog for the Classification of Hazardous Factors of Occupational Diseases.
   第三条 本办法所称作业场所职业危害,是指从业人员在从事职业活动中,由于接触粉尘、毒物等有害因素而对身体健康所造成的各种损害。
作业场所职业危害按照《职业病危害因素分类目录》确定。
Article 4 The report of occupational hazards shall be subject to the classified territorial administration. A production and operation entity shall test and assess the occupational hazardous factors at its own work place under relevant provisions and report to the local work safety administrative department at or above the county level according to division of functions.

   第四条 职业危害申报工作实行属地分级管理。生产经营单位应当按照规定对本单位作业场所职业危害因素进行检测、评价,并按照职责分工向其所在地县级以上安全生产监督管理部门申报。
