The Measures of the Ministry of Land and Resources for Ex-post Evaluation of Rules and Normative Documents, which have been adopted at the 2nd executive meeting of the Ministry of Land and Resources on June 1, 2010, are hereby promulgated and shall come into force on September 1, 2010.

《国土资源部规章和规范性文件后评估办法》,已经2010年6月1日国土资源部第2次部务会议审议通过,现予发布,自2010年9月1日起施行。

国土资源部规章和规范性文件后评估办法
Article 1 These Measures are formulated in accordance with the Program of the State Council for Comprehensively Promoting “Administration by Law”, the Decision of the Party Group of the Ministry of Land and Resources on Emancipating the Mind, Making Reform and Innovation, Improving the Work Style and Enhancing the Implementation Capability, and the Provisions on the Legislation Procedure of the Ministry of Land and Resources, and in light of the actualities of the administration of land and resources for purposes of deeply implementing the scientific concept of development, fully promoting the administration by law, strengthening the creditability and implementation capability of building the systems of land and resources administration, and regulating the ex-post evaluation of rules and normative documents.
   第一条 为深入贯彻落实科学发展观,全面推进依法行政,增强国土资源管理制度建设的公信力和执行力,规范规章和规范性文件后评估活动,根据国务院《全面推进依法行政实施纲要》、《中共国土资源部党组关于解放思想改革创新改进作风增强执行力的决定》和《国土资源部立法工作程序规定》,结合国土资源管理工作实际,制定本办法。
Article 2 These Measures shall apply to the ex-post evaluation of the rules and normative documents of the Ministry of Land and Resources (MLR).
   第二条 国土资源部规章和规范性文件后评估活动,适用本办法。
Article 3 The term “ex-post evaluation of rules and normative documents” (hereinafter referred to as “ex-post evaluation”) as mentioned in these Measures shall refer to the activities of conducting objective investigation and comprehensive evaluation of the policies and measures, implementation, implementation effects, existing problems and the factors that may affect the rules and normative documents as formulated by the MLR and putting forward opinions of improving the systems and management according to the procedures, standards and methods as prescribed in these Measures after the aforesaid rules and normative documents have become effective.
The term “normative documents” as mentioned in these Measures shall refer to the documents formulated and promulgated by the MLR according to the statutory authority and procedures for the purpose of implementing the provisions of the laws, regulations, rules and normative documents of its superior authorities, which involve the rights and obligations of the parties subject to administration of land and resources and are of universal binding force within the system of administration of land and resources and can be applied repeatedly.
   第三条 本办法所称规章和规范性文件后评估(以下简称后评估)是指国土资源部制定的规章和规范性文件实施后,依照本办法规定的程序、标准和方法,对其政策措施、执行情况、实施效果、存在问题及其影响因素进行客观调查和综合评价,提出完善制度、改进管理的意见的活动。
本办法所称规范性文件,是指国土资源部为执行法律、法规、规章和上级规范性文件的规定,依照法定权限和程序制定并公布,涉及国土资源管理相对人权利和义务,在国土资源管理系统具有普遍约束力并能够反复适用的文件。
Article 4 The principle of objectivity, impartiality, openness, transparency, public participation and stressing actual effects shall be adhered to in ex-post evaluation, which shall be pushed forward in an orderly manner with the focuses highlighted.
   第四条 后评估应当坚持客观公正、公开透明、公众参与、注重实效的原则,把握重点,有序推进。
Article 5 The MLR shall, according to these Measures, conduct ex-post evaluation of the rules and normative documents it has formulated.
The Department of Policies and Regulations of the MLR shall be responsible for organizing and implementing the ex-post evaluation. According to the annual ex-post evaluation plan of the MLR, the Department of Policies and Regulations of the MLR shall coordinate and organize the relevant departments and bureaus, public institutions, institutes, associations, etc. to conduct ex-post evaluation.
   第五条 国土资源部依据本办法的规定对本部门制定的规章和规范性文件进行后评估。
部政策法规司负责组织实施后评估工作。根据国土资源部后评估年度计划,部政策法规司协调组织有关司局、事业单位、学会协会等开展后评估工作。
Article 6 Ex-post evaluations shall, under the standards of legitimacy, rationality, feasibility, effectiveness, etc., be conducted with respect to the evaluation of the policies and measures, implementation, implementation effects, etc. of rules and normative documents.
   第六条 后评估应当根据合法性、合理性、可操作性、实效性等标准,对规章和规范性文件的政策措施、执行情况、实施效果等内容进行评估。
Article 7 Ex-post evaluations shall be carried out in diversified ways, the relevant information on ex-post evaluation shall be timely disclosed, and the opinions of the local people's governments and relevant departments, parties subject to administration, experts, scholars, etc. shall be widely solicited.

   第七条 开展后评估工作时,应当采取多种方式,及时公开后评估有关信息,广泛征求地方人民政府及有关部门、行政管理相对人、专家学者等方面的意见。
