Notice of the General Affairs Department of the State Administration of Foreign Exchange on the Relevant Issues concerning Including RMB Purchase and Sale in the Foreign Exchange Settlement and Sale Statistics
(No. 99 [2010] of the State Administration of Foreign Exchange)
The branches and foreign exchange administrative departments of the State Administration of Foreign Exchange (SAFE) in all provinces, autonomous regions and municipalities directly under the Central Government; the branches of the SAFE in Shenzhen, Dalian, Qingdao, Xiamen and Ningbo; and all designated Chinese-funded foreign exchange banks,
To clarify the relevant issues concerning the foreign exchange settlement and sale statistics in the RMB settlement of cross-border trade, and facilitate the handling of relevant businesses by the enterprises and banks in the pilot program, we hereby clarify the relevant requirements as follows in accordance with the Measures for the Administration of Pilot RMB Settlement in Cross-border Trade (Announcement No. 10 [2009] of the People's Bank of China, the Ministry of Finance, the Ministry of Commerce, the General Administration of Customs, the State Administration of Taxation and China Banking Regulatory Commission) and the Notice on the Relevant Issues concerning the Expansion of Pilot RMB Settlement in Cross-border Trade (No.186 [2010] of the People's Bank of China):

国家外汇管理局各省、自治区、直辖市分局、外汇管理部，深圳、大连、青岛、厦门、宁波市分局；各中资外汇指定银行：
为明确跨境人民币结算中有关结售汇统计事宜，便于试点企业和银行办理相关业务，根据《跨境贸易人民币结算试点管理办法》（中国人民银行财政部 商务部 海关总署 国家税务总局 中国银行业监督管理委员会公告[2009]10号）和《关于扩大跨境贸易人民币结算试点有关问题的通知》（银发［2010］186号），现将相关要求明确如下：

I. The RMB purchase and sale business handled by domestic banks under the settlement of import and export trade in goods, cross-border trade in services and other items shall be deemed transactions of foreign exchange settlement and sale with clients, and be included in the (ten-day or) monthly statements on foreign exchange settlement and sale and the overall position statistics of foreign exchange settlement and sale of a bank. The purchase of RMB by domestic banks from overseas clients shall be deemed transactions of foreign exchange sale; and the sale of RMB by domestic banks to overseas clients shall be deemed transactions of foreign exchange settlement.
．．．．．． | | 一、境内银行办理进出口货物贸易、跨境服务贸易和其他项目结算项下的购售人民币业务，应视为对客户结售汇交易，纳入银行结售汇（旬）月报和结售汇综合头寸统计。境内银行从境外客户买入人民币，应视为售汇交易；境内银行向境外客户卖出人民币，应视为结汇交易。
