Notice of the Ministry of Human Resources and Social Security on the Relevant Issues Concerning the Participation in Social Insurance by Foreigners Employed in China
(No. 113 [2011] of the Ministry of Human Resources and Social Security)
The human resources and social security departments (bureaus) of all provinces, autonomous regions and municipalities directly under the Central Government; and the Labor Security Bureau of Xinjiang Production and Construction Corps:
In accordance with the provisions of the Social Insurance Law of the People's Republic of China and the Interim Measures for the Participation in Social Insurance by Foreigners Employed in China (Order No. 16 of the Ministry of Human Resources and Social Security, hereinafter referred to as the “Interim Measures”), we hereby notify you of the relevant issues concerning the participation in social insurance by foreigners employed in China as follows:

各省、自治区、直辖市人力资源和社会保障厅(局),新疆生产建设兵团劳动保障局:
根据《中华人民共和国社会保险法》和《在中国境内就业的外国人参加社会保险暂行办法》(人社部令第16号,以下简称《暂行办法》)规定,现就做好在中国境内就业的外国人参加社会保险工作有关事宜通知如下:
I. Legally Including Qualified Foreigners under Insurance Coverage
All localities shall strictly carry out the Social Insurance Law and the Interim Measures, include qualified foreigners under the social insurance coverage before December 31, 2011, and urge the employers and foreigners to participate in insurance and pay the full amount of social insurance premium in a timely manner in accordance with the existing laws and regulations. Foreigners that were employed in China before October 15, 2011 and meet the conditions for insurance participation shall uniformly be included in the insurance scheme and pay insurance premium from October 15, 2011. Those who have completed the formalities for insurance participation and premium payment from October 15, 2011 to December 31, 2011 may be exempt from paying overdue fees. Those who have completed the formalities for insurance participation and premium payment after January 1, 2012 shall be charged overdue fees from October 15, 2011. Foreigners employed in China after October 15, 2011 shall participate in insurance and pay insurance premium from the month when they began to work in China. The employers shall uniformly declare the base amount of premium payment of foreigners in the form of RMB. All localities shall effectively collect social insurance premium and keep records of personal rights and interests in accordance with the relevant policies.
   一、依法将符合规定的外国人纳入参保范围
各地要严格执行社会保险法和《暂行办法》,于2011年12月31日前将符合条件的外国人纳入社会保险覆盖范围,督促用人单位和外国人按照现行法律法规参保并按时足额缴纳社会保险费。2011年10月15日之前已经在中国境内就业,且符合参保条件的外国人,统一从2011年10月15日起参保缴费。2011年10月15日至12月31日办理参保缴费手续的,免收其滞纳金。2012年1月1日之后办理参保缴费手续的,从2011年10月15日起收取滞纳金。2011年10月15日以后在中国境内就业的,从在中国境内就业开始之月起参保缴费。用人单位申报外国人的缴费基数,统一按人民币形式申报。各地要按照有关政策规定,做好社会保险费收缴以及个人权益记录等工作。
II. Improving Formalities for Foreigners' Social Insurance Registration
All localities shall improve social insurance registration formalities and facilitate the handling of insurance participation registration formalities by employers for their foreign employees. When handling social insurance registration formalities, such entities as foreign representative offices in China, permanent offices of foreign news agencies and resident representative offices of foreign enterprises shall be required to provide the establishment approval documents issued by the competent Chinese authorities and certification documents such as the organization code certificate issued by China's quality and technical supervision departments.

   二、完善外国人社会保险登记办理程序
各地要完善社会保险登记办理程序,方便用人单位为聘雇的外国人办理参保登记手续。驻华代表机构、外国常驻新闻机构、外国企业常驻代表机构等单位办理社会保险登记手续时,应要求其提供由中国主管部门颁发的批准设立文件及由中国质量技术监督部门颁发的组织机构代码证书等证明文件。
对于首次参保的外国人,应要求用人单位提供其本人有效护照、《外国人就业证》或《外国专家证》、《外国常驻记者证》等就业证件(取得在中国永久居留资格的人员,应提供本人《外国人永久居留证》),以及劳动合同或派遣合同等证明材料,到用人单位参保所在地社保机构办理社会保险登记手续。经审核通过的,社保机构根据《外国人社会保障号码编制规则》,为其建立社会保障号码,发放社会保障卡。
具有与我国签订社会保险缴费双边或多边协议(或协定,以下简称协议)国家国籍的就业人员,在其依法获得在我国境内就业证件3个月内提供协议国出具参保证明的,应按协议规定免除其规定险种在规定期限内的缴费义务。对于依法获得在我国境内就业证件3个月后不能提供协议国出具的参保证明的,应按规定征收社会保险费并收取相应的滞纳金。对于协议之外的险种以及协议规定险种超过规定期限的,应要求其按规定缴纳社会保险费。
