Notice of the Organization Department of the Central Committee of the Communist Party of China, the Ministry of Personnel and the General Political Department of the People's Liberation Army on Issuing the Provisions on the Settlement of Personnel Disputes

The organization departments of the Committees of the Communist Party of China and the personnel departments (bureaus) of the people's governments of all provinces (autonomous regions and municipalities directly under the Central Government), the cadre (personnel) divisions (departments) of all departments and commissions under the Central Government, all ministries and commissions of the state organs and all people's groups, the organization department of the Committee of the Communist Party of China and the personnel bureau of Xinjiang Production and Construction Corps, and the political departments of all military regions, all corps, all headquarters, the Academy of Military Sciences, the University of National Defense, the National University of Defense Technology, and the Armed Police Forces:
The Provisions on the Settlement of Personnel Disputes are now available in print and hereby issued to you for your diligent compliance and implementation in combination with the local or departmental reality, and please inform us timely of the relevant situations and problems in the implementation.

各省(自治区、直辖市)党委组织部、政府人事厅(局),中央和国家机关各部委、各人民团体干部(人事)部门,新疆生产建设兵团党委组织部、人事局,各军区、各军兵种、各总部、军事科学院、国防大学、国防科学技术大学、武警部队政治部:
现将《人事争议处理规定》印发给你们,请结合本地区、本部门的实际情况,认真贯彻执行,并将执行中有关情况和问题及时告诉我们。

人事争议处理规定
Chapter I General Provisions
 

第一章 总则


Article 1 In order to impartially and timely settle personnel disputes and protect the legal rights and interests of the parties, these Provisions have been made in accordance with the Civil Servant Law of the People's Republic of China, the Regulation on Civilian Staff of the People's Liberation Army and other relevant laws and administrative regulations.
   第一条 为公正及时地处理人事争议,保护当事人的合法权益,根据《中华人民共和国公务员法》、《中国人民解放军文职人员条例》等有关法律法规,制定本规定。
Article 2 These Provisions shall apply to the following personnel disputes:
   第二条 本规定适用于下列人事争议:
1. A dispute arising from the execution of an employment contract between an organ subject to the civil servant law and its civil servant subject to the system of employment or between an organ (entity) managed by analogy to the Civil Servant Law of the People's Republic of China and its employed staff member.
 (一)实施公务员法的机关与聘任制公务员之间、参照《中华人民共和国公务员法》管理的机关(单位)与聘任工作人员之间因履行聘任合同发生的争议。
2. A dispute arising from the rescission of a personnel relationship or execution of an employment contract between a public institution and its staff member;
 (二)事业单位与工作人员之间因解除人事关系、履行聘用合同发生的争议。
3. A dispute arising from the rescission of a personnel relationship or execution of an employment contract between a social organization and its staff member;
 (三)社团组织与工作人员之间因解除人事关系、履行聘用合同发生的争议。
4. A dispute arising from the execution of an employment contract between a military employing entity and its civilian staff member; and
 (四)军队聘用单位与文职人员之间因履行聘用合同发生的争议。
5. Any other personnel dispute that may be arbitrated as provided for by a law or administrative regulation.
 (五)依照法律、法规规定可以仲裁的其他人事争议。
Article 3 After a personnel dispute arises, the parties may settle it through consultation; if the consultation is not attempted or fails, either party may apply to the competent authority for mediation, or in the case of a personnel dispute between a military employing entity and its civilian staff member, may apply to the entity at the next higher level of the employing entity for mediation; and if the mediation is not attempted or fails, either party may apply to a personnel dispute arbitration commission for arbitration. Either party may also directly apply to the personnel dispute arbitration commission for arbitration. Either party may bring an action in the people's court against the arbitral award.
   第三条 人事争议发生后,当事人可以协商解决;不愿协商或者协商不成的,可以向主管部门申请调解,其中军队聘用单位与文职人员的人事争议,可以向聘用单位的上一级单位申请调解;不愿调解或调解不成的,可以向人事争议仲裁委员会申请仲裁。当事人也可以直接向人事争议仲裁委员会申请仲裁。当事人对仲裁裁决不服的,可以向人民法院提起诉讼。
Article 4 The parties shall enjoy equal status and equal application of laws and administrative regulations in the settlement of personnel disputes.
A party shall be entitled to use his or her own ethnic language in the application for arbitration. A personnel dispute arbitration commission shall provide translation for the party who is unfamiliar with the local language that is generally used.
   第四条 当事人在人事争议处理中的地位平等,适用法律、法规平等。
当事人有使用本民族语言文字申请仲裁的权利。人事争议仲裁委员会对于不熟悉当地通用语言文字的当事人,应当为他们翻译。
Article 5 In the settlement of personnel disputes, attention shall be paid to mediation, the principle of legality, impartiality and timeliness shall be adhered to, the fact shall be the basis, and the law shall be the yardstick.
   第五条 处理人事争议,应当注重调解,遵循合法、公正、及时的原则,以事实为依据,以法律为准绳。
Chapter II Organizational Structure
 

第二章 组织机构


Article 6 A personnel dispute arbitration commission for central organs and their subordinate public institutions shall be set up within the Ministry of Personnel.
Personnel dispute arbitration commissions shall be set up in a province (autonomous region or municipality directly under the Central Government), a deputy provincial municipality, a prefecture (city, autonomous prefecture or league) and a county (city, district or banner).
The personnel dispute arbitration commissions shall handle cases independently, and there shall be no subordinate relationship between them.
   第六条 中央机关及所属事业单位人事争议仲裁委员会设在人事部。
省(自治区、直辖市)、副省级市、地(市、州、盟)、县(市、区、旗)设立人事争议仲裁委员会。
人事争议仲裁委员会独立办案,相互之间无隶属关系。
Article 7 A personnel dispute arbitration commission shall consist of the representative of the competent authority for civil servants, representative of the employing entity, representative of the trade union, the representative of the employees and experts in personnel and law. The composition of a personnel dispute arbitration commission shall be singular in number, including one chairman, two to four vice-chairmen and several other members.
The person in charge of the personnel work of the same-level people's government or the principal of the administrative department of personnel of the government shall serve as the chairman of a personnel dispute arbitration commission.
   第七条 人事争议仲裁委员会由公务员主管部门代表、聘任(用)单位代表、工会组织代表、受聘人员代表以及人事、法律专家组成。人事争议仲裁委员会组成人员应当是单数,设主任一名、副主任二至四名、委员若干名。
同级人民政府分管人事工作的负责人或者政府人事行政部门的主要负责人任人事争议仲裁委员会主任。
Article 8 The principle of majority rule shall apply to a personnel dispute arbitration commission, and the dissenting opinions shall be recorded as they are.
   第八条 人事争议仲裁委员会实行少数服从多数原则,不同意见应如实记录。
Article 9 The functions of a personnel dispute arbitration commission shall be:
   第九条 人事争议仲裁委员会的职责是:
1. Settling personnel disputes within its jurisdiction;
 (一)负责处理管辖范围内的人事争议。
2. Deciding the retainment and dismissal of arbitrators; and
 (二)决定仲裁员的聘任和解聘。
3. Other functions assumed by the personnel dispute arbitration commission as provided for by laws and administrative regulations.
 (三)法律、法规规定由人事争议仲裁委员会承担的其他职责。
Article 10 An office shall be set up under a personnel dispute arbitration commission, responsible for the daily work, such as acceptance of personnel dispute cases, service of arbitral documents, archival management and assessment and training of arbitrators, and other matters as authorized by the personnel dispute arbitration commission. The office shall be set up within the personnel authority of the same-level people's government.
   第十条 人事争议仲裁委员会下设办事机构,其职责是:负责人事争议案件的受理、仲裁文书送达、档案管理以及仲裁员的考核、培训等日常工作,办理人事争议仲裁委员会授权的其他事宜。办事机构设在同级人民政府人事部门。
Article 11 The arbitral tribunal system shall apply to the dispute settlement by a personnel dispute arbitration commission, and an arbitral tribunal shall be the basic form for a personnel dispute arbitration commission to settle personnel dispute cases. An arbitral tribunal shall be normally made up of three arbitrators. The personnel dispute arbitration commission shall appoint an arbitrator as the chief arbitrator who presides over the work of the arbitral tribunal; and of the other two arbitrators, either party may appoint one or the personnel dispute arbitration commission may appoint both. With the consent of both parties, the personnel dispute arbitration commission may appoint a sole arbitrator to settle a simple personnel dispute case.
   第十一条 人事争议仲裁委员会处理人事争议案件实行仲裁庭制度,仲裁庭是人事争议仲裁委员会处理人事争议案件的基本形式。仲裁庭一般由三名仲裁员组成。人事争议仲裁委员会指定一名仲裁员担任首席仲裁员,主持仲裁庭工作;另两名仲裁员可由双方当事人各选定一名,也可由人事争议仲裁委员会指定。简单的人事争议案件,经双方当事人同意,人事争议仲裁委员会可以指定一名仲裁员独任处理。
Article 12 A personnel dispute arbitration commission may retain the working staff members of the relevant authorities, experts, scholars and lawyers as full-time or part-time arbitrators. The arbitrators shall be responsible for the specific settlement of personnel dispute cases as appointed by the personnel dispute arbitration commission or chosen by the parties.

   第十二条 人事争议仲裁委员会可以聘任有关部门的工作人员、专家学者和律师为专职或兼职仲裁员。仲裁员的职责是:受人事争议仲裁委员会的委托或当事人的选择,负责人事争议案件的具体处理工作。
