With the progress made in China’s judicial reform, the guiding case system with Chinese Characteristics has been established step by step. By the end of 2015, the Supreme People’s Court (SPC) and the Supreme People’s Procuratorate (SPP) have issued 32 criminal guiding cases in total, 23 of which in 6 batches were issued by SPP and the other 9 cases in 11 batches were issued by SPC. To have a deep insight into the specific situation of the criminal guiding cases, with the data in the Judicial Cases database of the Pkulaw as its study object and based on the detailed introduction to the issuance of the guiding criminal cases from the SPC and SPP, this Report focuses on analyzing and discussing the current situation of the judicial application of the guiding criminal cases, sums up the restricting factors and gives advice on the improvement of such application in an effort to offer reference for the judicial application of the guiding cases in China.
