Judicial Authorities Issue Guiding Opinions against Cyberbullying

On September 25, 2023, the Supreme People's Court, the Supreme People's Procuratorate, and the Ministry of Public Security jointly issued the Guiding Opinions on Fighting Cyberbullying Violations and Crimes in Accordance with Law. Competent judicial authorities should, according to the guiding document, fight against cyberviolence crimes and violations by operation of laws. Whoever engages in cyberbullying, judged by the way of conduct, will be convicted of such crimes as crime of defamation, crime of insult, and crime of infringing on citizens' personal information, and be punished accordingly. The Guiding Opinions clarify five circumstances under which a heavier punishment should be given according to law. For example, perpetrators who conduct cyberbullying against minors or disabled individuals should be harshly punished. Judicial authorities should severely punish perpetrators who hire Internet trolls or other paid posters to conduct cyberbullying, or fabricate sex-related topics to infringe upon the dignity of others, or post illegal or harmful information by use of “deep synthesis” and other generative AI technologies. In addition, network service providers sponsoring or organizing cyberviolence activities should also face stricter punishments, the document said.
