The Supreme People's Procuratorate recently issued the Plan for the Pilot Program on Reforming Public Interest Litigation Initiated by Procuratorate.
Pursuant to the Plan, when a procuratorate initiates a civil public interest lawsuit or an administrative public interest lawsuit, it shall identify specific defendant, establish specific claims and collect preliminary evidence to prove that public interest has been damaged, and shall prepare the statement of claim for the public interest litigation. For public interest litigations initiated by procuratorate, the court charges shall be exempted and the defendants shall have no right of counterclaim. Further, to enhance the effect of procuratorial supervision, for administrative authorities to take the initiatives in performing duties, and to effectively save judicial resources, the Plan sets up the pretrial procedure.
