| 2021 Legislative Work Plan of the State Council | | 國務院2021年度立法工作計劃 |
| The year 2021 marks the 100th anniversary of the founding of the Communist Party of China (“CPC”), the first year for the implementation of the “14th Five-Year Plan” and the Long-Range Objectives through the Year 2035, the start of a new journey of building a modern socialist country in an all-round way, and a march towards the second Centenary Goal. The overall requirements for the 2021 legislative work of the State Council are, under the strong leadership of the CPC Central Committee with Comrade Xi Jinping as the core, to hold high the great banner of socialism with Chinese characteristics, be guided by Xi Jinping Thought on Socialism with Chinese Characteristics for a New Era, thoroughly study and implement Xi Jinping Thought on the Rule of Law, fully implement the spirit of the 19th CPC National Congress and the Second, Third, Fourth, and Fifth Plenary Sessions of the 19th CPC Central Committee, unswervingly follow the path of socialist rule of law with Chinese characteristics, adhere to the organic unity of Party leadership, the running of the country by the people, and law-based country governance, adhere to the general principle of pursuing progress while ensuring stability, ground our efforts in the new development stage, implement the new development concept, create a new development pattern, promote high-quality development, strengthen legislative work in key fields, emerging fields, and foreign-related fields, focus on improving the quality and efficiency of legislation, provide powerful legal safeguards for advancing the modernization of the national governance system and governance capabilities and the comprehensive construction of a modern socialist country, and celebrate the 100th anniversary of the founding of the CPC with outstanding achievements. | | 2021年是中國共產黨成立100周年，是實施“十四五”規劃和2035年遠景目標的開局之年，開啟全面建設社會主義現代化國家新征程，向第二個百年奮鬥目標進軍。國務院2021年度立法工作的總體要求是：在以習近平同志為核心的黨中央堅強領導下，高舉中國特色社會主義偉大旗幟，以習近平新時代中國特色社會主義思想為指導，深入學習貫徹習近平法治思想，全面貫徹落實黨的十九大和十九屆二中、三中、四中、五中全會精神，堅定不移走中國特色社會主義法治道路，堅持黨的領導、人民當家作主、依法治國有機統一，堅持穩中求進工作總基調，立足新發展階段、貫徹新發展理念、構建新發展格局，推動高質量發展，系統謀劃、統籌推進立法工作，加強重點領域、新興領域、涉外領域立法，不斷提高立法質量和效率，為推進國家治理體系和治理能力現代化、全面建設社會主義現代化國家提供有力法治保障，以優異成績慶祝建黨100周年。 |
| I. Thoroughly studying and implementing Xi Jinping Thought on the Rule of Law | | 一、深入學習貫徹習近平法治思想 |
| The Central Conference on the Work of Comprehensive Law-based Country Governance has specified the guiding position of Xi Jinping Thought on the Rule of Law in the work of comprehensive law-based country governance. Xi Jinping Thought on the Rule of Law is rich in connotation, profound in elaboration, rigorous in logic, and complete in systems. It provides a profound answer to a series of major issues such as why and how to achieve the comprehensive law-based country governance in the new era from the perspective of connection between history and reality, correlation between international and domestic laws, and the combination of theory and practices. Xi Jinping Thought on the Rule of Law is a major theoretical innovation that came into being in response to the requirements of the era of the great rejuvenation of the Chinese nation, the latest achievement in adapting the Marxism theory on the rule of law to the Chinese context, an integral part of Xi Jinping Thought on Socialism with Chinese Characteristics in a New Era, and the fundamental principle and action guidelines for the comprehensive law-based country governance. Efforts shall be made to conscientiously study and comprehend Xi Jinping Thought on the Rule of Law, understand the basic spirit, grasp the core principles, and clarify work requirements, and effectively implement Xi Jinping Thought on the Rule of Law into the entire process and all aspects of administrative legislative work. | | 中央全面依法治國工作會議明確了習近平法治思想在全面依法治國中的指導地位。習近平法治思想內涵豐富、論述深刻、邏輯嚴密、系統完備，從曆史和現實相貫通、國際和國內相關聯、理論和實際相結合上深刻回答了新時代為什麼實行全面依法治國、怎樣實行全面依法治國等一系列重大問題。習近平法治思想是順應實現中華民族偉大複興時代要求應運而生的重大理論創新成果，是馬克思主義法治理論中國化最新成果，是習近平新時代中國特色社會主義思想的重要組成部分，是全面依法治國的根本遵循和行動指南。要認真學習領會習近平法治思想，吃透基本精神、把握核心要義、明確工作要求，切實把習近平法治思想貫徹落實到行政立法工作全過程和各方面。 |
| The Party's leadership over the legislative work shall be upheld, and efforts shall be made to advance the institutionalization and legislation of Party leadership, so as to ensure that the Party's line, principles, and policies are fully implemented and effectively executed through the rule of law. Efforts shall be made to adhere to a people-centered approach, actively respond to the new requirements and expectations of the people, and systematically study, plan and resolve outstanding issues of great concern to the public in the legislation field. Efforts shall be made to adhere to advancing scientific legislation, accelerate the formation of a complete legal norms system, actively advancing legislation in important fields such as national security, scientific and technological innovation, public health, biosecurity, ecological civilization, risk prevention, and foreign-related rule of law, and improve the legal system urgently needed for country governance and requisite for the satisfaction of the people's growing needs for a better life, so as to ensure the sound development of new business forms and new models with good laws and good governance. | The Fifth Plenary Session of the 19th CPC Central Committee has specified the guiding ideology, basic principles, objectives and requirements, main tasks and major measures for economic and social development in the next five years, and has outlined the long-range objective of becoming a great modern socialist country in every dimension by 2035. In the administrative legislative work, the initiative must be taken to benchmark against the economic and social development goals and tasks during the “14th Five-Year Plan” period, and legislation in important fields shall be strengthened, so as to provide powerful legal safeguards for promoting the stable and healthy development of the economy and society. | | 黨的十九屆五中全會明確了未來五年經濟社會發展的指導思想、基本原則、目標要求、主要任務和重大舉措，描繪了到2035年基本實現社會主義現代化的遠景目標。在行政立法工作中，必須主動對標“十四五”時期經濟社會發展目標任務，加強重要領域立法，為促進經濟社會平穩健康發展提供有力法治保障。 |
| For the purpose of promoting economic development and making breakthroughs, the NPC Standing Committee shall be requested to deliberate on the Grain Security Bill, formulate the Provisions of the State Council on Strengthening the Supervision and Administration of Agricultural Product Wholesale Markets, the Regulation on Supply and Marketing Cooperatives, and the Regulation on Rare Earth Administration, as well as revise the Regulation on the Administration of Commercial Cryptography. The Bill to Revise the Metrology Law, the Bill to Revise the Highway Law, and the Bill to Revise the Railway Law are to be submitted to the NPC Standing Committee for deliberation. | For the purpose of promoting reform and opening up and making new headway, the NPC Standing Committee shall be requested to deliberate on the Value-Added Tax Bill, the Excise Tax Bill, the Tariff Bill, and the Bill to Amend the Anti-monopoly Law, formulate the Regulation on the Administration of the Registration of Market Participants, the Regulation on the Supervision and Administration of Non-depository Lenders, the Regulation on the Supervision and Administration of Privately Offered Investment Funds, and the Measures for the Implementation of the Commitment System for Parties in Administrative Enforcement Actions Regarding Securities and Futures, as well as revise the Interim Regulation on Enterprise Information Disclosure. The Development Planning Bill, the Telecommunications Bill, the Bill to Amend the Statistics Law, the Bill to Amend the Law on the People's Bank of China, the Bill to Revise the Commercial Bank Law, the Bill to Revise the Anti-Money Laundering Law, the Bill to Revise the Insurance Law, and the Bill to Revise the Bidding Law are to be submitted to the NPC Standing Committee for deliberation. The Regulation on Non-banking Payment Institutions is to be formulated.
