第一章 总则


Article 1 These Regulations are formulated for the purposes of standardizing the actions between the enterprise and the enterprise employees as one party to carry out the collective Negotiations and to conclude collective Contracts and maintaining the legal rights and interests of both parties in accordance with the Labor Law of the People's Republic of China and the Trade Union Law of the People's Republic of China as well as other relevant laws with the combination of the practical situations of Shaanxi Province.
   第一条 为了规范企业与企业职工一方进行集体协商、签订集体合同的行为,维护双方的合法权益,根据《中华人民共和国劳动法》、《中华人民共和国工会法》及有关法律,结合本省实际,制定本条例。
Article 2 These Regulations shall apply to the collective Negotiations and the conclusion of collective Contracts between the enterprise and the enterprise employees as one party within the administrative region of Shaanxi Province.
   第二条 本省行政区域内企业与企业职工一方进行集体协商、签订集体合同适用本条例。
Article 3 The enterprise and the enterprise employees as one party should establish a collective negotiation system and conclude collective Contracts according to law.
The term “collective Contract” as mentioned in these Regulations shall refer to the written agreement concluded between the enterprise employees as one party with the enterprise through collective negotiations on such labor relationship matters as the labor payment, working hours, rest and vacations, labor safety and health, insurance and welfare and so on.
The term “collective Negotiations” as mentioned in these Regulations shall refer to the actions for the equal negotiation between the enterprise employees as one party and the enterprise according to law for such matters as the conclusion of collective Contracts and so on.
   第三条 企业与企业职工一方应当建立集体协商制度,依法签订集体合同。
本条例所称集体合同是指企业职工一方与企业就劳动报酬、工作时间、休息休假、劳动安全卫生、保险福利等劳动关系事项,通过集体协商签订的书面协议。
本条例所称集体协商是指企业职工一方与企业依法就签订集体合同等事项进行平等协商的行为。
Article 4 collective Negotiations and the conclusion of collective Contracts should follow the principles of equal cooperation and coherent consultation, and should not violate the provisions of laws, rules and regulations.
   第四条 集体协商、签订集体合同应当遵循平等合作、协商一致的原则,不得违反法律、法规的规定。
Article 5 collective Contracts concluded in accordance with law shall have the binding force on both the enterprise and all the enterprise employees.
The relevant standard of labor conditions and labor payment agreed upon in the labor contract to be concluded between an individual employee and the enterprise shall not be lower than the provisions in collective Contracts.
   第五条 依法签订的集体合同对企业和企业全体职工具有约束力。
职工个人与企业订立的劳动合同中有关劳动条件和劳动报酬的标准不得低于集体合同的规定。
Article 6 The labor administrative superintending departments of the people's governments at or above county levels shall be responsible to coordinate the collective Negotiations, to examine and to administrate collective Contracts.
Local trade unions and industrial trade unions shall guide the enterprise employees as one party to carry out negotiations and to conclude collective Contracts collectively with the enterprise.
   第六条 县级以上人民政府劳动行政主管部门负责协调集体协商,审查和管理集体合同。
地方工会和产业工会指导企业职工一方与企业进行集体协商,签订集体合同。

第二章 集体协商


Article 7 The enterprise employees as one party shall have the rights to bring forward the request to the enterprise for collective Negotiations, and the enterprise shall not decline, but should go on with the collective Negotiations within fifteen days as from the day of the request made by the enterprise employees as one party.
   第七条 企业职工一方有权向企业提出进行集体协商的要求,企业不得拒绝,应当在职工一方提出要求之日起十五日内进行集体协商。
Article 8 The numbers of the representatives from both parties for the collective Negotiations should be equal, each party shall have three to ten numbers of representatives, and each party shall ensure a chief representative respectively.
   第八条 参加集体协商的双方代表人数应当对等,每方代表为三至十名,并各确定一名首席代表。
Article 9 The chief representative for the enterprise employees as one party where the trade union has been set up shall be the chairperson of the trade union or the representative entrusted in writing by the chairperson of the trade union, while the other representatives shall be democratically chosen to come into being by all the enterprise employees as organized by the trade union.

   第九条 已建立工会的企业职工一方首席代表由工会主席或者工会主席书面委托的代表担任,其他代表由工会组织全体职工民主推举产生。
