| However, have you ever considered that the live streaming you are watching could be a well-designed scam? | In July 2021, Ms. Wang, a septuagenarian, while watching live streams as usual, encountered Mr. Zhao's channel. Upon entering his live-streaming channel, she discovered that he addressed every viewer as “dad” or “mom”. Mr. Zhao recounted his purported “tragic personal experience” to the audience. According to his narration, he managed to provide financial aid for two impoverished girls despite suffering from poverty. He stated that the live streaming aimed to help these girls sell their jewelry. Touched by his displayed optimism and the live streaming's positive aura, Ms. Wang purchased several pieces of jewelry in a show of support. | | 2021年7月，古稀之年的王某像往常一样打开了直播平台，恰好看到一男主播赵某在直播，点进去之后发现该主播对每个进直播间的人都以“爸爸”或“妈妈”相称。赵某先是在直播间讲述自己的“悲惨身世”，后又说自己虽然家庭困难，但仍然通过个人努力帮助了两名生活贫困的女孩，直播就是为了帮女孩售卖首饰。王某看后，觉得赵某积极乐观，直播间充满正能量，就购买了一些首饰表达支持。 |
| In this way, Ms. Wang became a fan of Mr. Zhao. Mr. Zhao subsequently sent Ms. Wang a direct message, instructing her on how to send virtual gifts during his live streaming. After the instruction, Mr. Wang often sent him virtual gifts. Later, they had each other's WeChat, and Mr. Zhao expressed his gratitude by sending Ms. Wang fruits. Over time, they gradually became acquainted with each other. That same month, Mr. Zhao, under the pretense of insufficient funds for his return trip to his hometown, asked Ms. Wang for a loan. Moved by sympathy, Ms. Wang transferred 2,500 yuan to him via WeChat. After receiving the first transfer, Mr. Zhao became even more cordial towards Ms. Wang. Upon learning that Ms. Wang was unmarried and childless, he showed more concern for her well-being. Moreover, he even promised to support her in her old age and referred to her as his adoptive mother. | | 就这样，王某成为了主播赵某的粉丝。主播赵某通过后台私信王某，教其如何在直播间刷礼物，王某学会后经常在直播间刷礼物。后两人添加微信，赵某给王某寄水果表示感谢。一来二去，两人逐渐熟络。同月，赵某以自己没钱回老家为由向王某借钱，王某心生同情，就用微信转了2500元。收到第一笔转账后，赵某对王某更加热情，当得知王某至今未婚、无子女，对王某更是嘘寒问暖，认做干妈，表示愿意给她养老。 |
| ．．．．．． | | 在充分取得王某信任后，赵某便以自己患胃癌、吐血、脑子里有血块、被黑社会追杀等各种理由向王某借钱。2023年5月，赵某跨省自驾看望王某，给王某过生日。2023年6月、7月，赵某又以人民法院让其缴纳钱款不然就要坐牢、患脂肪瘤等理由向王某借钱。王某是一位退休老人，平时靠退休金生活，在多次将钱款“借”给“干儿子”赵某后，生活拮据，甚至为此负债。赵某为了能继续从王某处取得钱款，还用自己微信假扮成自己女朋友以怀孕打胎为由向王某借钱。 |
| | 后王某联系赵某女朋友，得知其并未怀孕，遂发现自己可能被骗欲报警。2023年11月，赵某为了显示其与王某之间的钱款来往系借款，归还王某部分钱款，并答应之后会陆续还钱，但实际未还。至案发，王某已因此事负债累累，每月的退休金大部分用来还债。 |
| | 2024年1月2日，赵某被公安机关抓获。 |
| | 本案侦查阶段，赵某称上述钱款是王某赠送和借用的，自己并未诈骗。审查起诉阶段，赵某作部分供述，但辩解自己是借钱而非骗钱。 |
| | 【以案说法】 |
| | 松江区人民法院经审理后认为，被告人赵某以非法占有为目的，采用虚构事实、隐瞒真相的方法，骗取他人财物，数额特别巨大，其行为已构成诈骗罪，公诉机关的指控成立。被告人赵某虽然在审查起诉阶段供述了部分犯罪事实，但其辩解否定主观上具有非法占有目的，故不应认定其具有坦白情节。本案被害人王某案发时已70周岁，根据最高人民法院、最高人民检察院《关于办理诈骗刑事案件具体应用法律若干问题的解释》第二条的规定，诈骗老年人的财物的，可以依照刑法第二百六十六条的规定酌情从严惩处，故对被告人赵某酌情从重处罚。被告人赵某在审查起诉阶段供述部分犯罪事实且当庭自愿认罪，可酌情从轻处罚。根据犯罪的事实、性质、情节及对社会的危害程度等，对被告人赵某犯诈骗罪判处有期徒刑十年六个月，剥夺政治权利二年，并处罚金人民币十万元；责令被告人向被害人退赔；扣押在案的涉案手机，予以没收。 |
