A landlord refused to lease his apartment to tenants, alleging they had concealed the cohabitation of a disabled elderly person and committed fraud. [Case Review] 【案情回放】
Mr. Gao, one of the tenants, signed the Housing Lease Contractwith Mr. Wang, the landlord. The tenants included Mr. Gao, his wife, children, mother-in-law, an elderly person from his mother-in-law's family, and a caregiver. After the conclusion of this contract, Mr. Gao paid an initial rent and a deposit. The next day, Mr. Wang discovered that the elderly person was 94 years old and unable to take care of himself upon inquiry. Mr. Wang accused Mr. Gao of concealing significant information about the disabled elder, constituting fraud, and refused to deliver the apartment. He filed a lawsuit in the People's Court to rescind the contract and demanded compensation from Mr. Gao. In response, Mr. Gao lodged a counterclaim, seeking the court's acknowledgment of the contract's validity and penalties from Mr. Wang for breach of contract. 租客高某与房东王某签订《房屋租赁合同》,租住人员包括高某及其妻子、孩子、岳母、岳母家中一位老人以及护理人员。双方签订《房屋租赁合同》后,高某支付了首期租金及押金。合同签订后次日,王某询问老人情况,得知老人94岁、生活不能自理。王某以租客为“高龄失能老人”为由,认为高某隐瞒同住人的重要信息,构成欺诈,拒绝向高某交付房屋,并向人民法院起诉,请求撤销《房屋租赁合同》,由高某赔偿损失。高某提起反诉,请求确认《房屋租赁合同》已生效,并由王某支付违约金。

 上海市第一中级人民法院经审理认为,《房屋租赁合同》签订后,以租客为“高龄失能老人”为由拒绝交房,有违社会主义核心价值观,不利于建立和谐友善的社会秩序,有损老年人权益。王某也未能证明其将同住人不能有“高龄失能老人”作为签订租赁合同的关键因素予以考量。故人民法院驳回了王某的诉讼请求,支持了高某的反诉请求,判决王某承担违约责任。
