| | 上海市静安区人民法院（以下简称“静安区人民法院”）审理后认为，旅行社作为专业的旅游服务机构，在包价游时应尽到必要的注意义务，应当对游客的护照信息进行严格核查，并在发现问题时及时通知游客；且王某年近古稀，旅行社理应承担更详尽的告知义务。旅行社违约导致游客遭受损失，游客有权要求旅行社承担相应的赔偿责任。但王某要求退一赔一，并没有合同约定也没有法律规定，对该项诉请人民法院无法支持。 |
| | 综上，人民法院判决，旅行社退还王某团费，并承担她往返机场的交通费。 |
