The Administrative Measures for Comprehensive Law Enforcement in Cultural Markets, as deliberated and adopted at the executive meeting of the Ministry of Culture on December 6, 2011, are hereby issued and shall come into force on February 1, 2012.

文化市场综合行政执法管理办法
Chapter I General Provisions
 

第一章 总则


Article 1 For purposes of regulating the acts of comprehensive law enforcement in cultural markets, strengthening the administration of cultural markets, maintaining the cultural market order, safeguarding the lawful rights and interests of citizens, legal persons, and other organizations, and promoting the sound development of cultural markets, these Measures are formulated according to the Law of the People's Republic of China on Administrative Penalty, the Administrative Compulsion Law of the People's Republic of China, and the relevant laws and regulations of the state.
   第一条 为规范文化市场综合行政执法行为,加强文化市场管理,维护文化市场秩序,保护公民、法人和其他组织的合法权益,促进文化市场健康发展,根据《中华人民共和国行政处罚法》、《中华人民共和国行政强制法》等国家有关法律、法规,制定本办法。
Article 2 The term “comprehensive law enforcement in cultural markets” as mentioned in these Measures refers to the specific administrative act of a comprehensive law enforcement organ in cultural markets (hereinafter referred to as the “comprehensive law enforcement organ”), supervision over and examination of the culture operational activities of citizens, legal persons, or other organizations in accordance with the provisions of relevant state laws, regulations, and rules, and the handling of their illegal acts.
   第二条 本办法所称文化市场综合行政执法是指文化市场综合行政执法机构(以下简称综合执法机构),依照国家有关法律、法规、规章的规定,对公民、法人或者其他组织的文化经营活动进行监督检查,并对违法行为进行处理的具体行政行为。
Article 3 The term “comprehensive law enforcement organ” as mentioned in these Measures includes:
   第三条 本办法所称综合执法机构包括:
(1) a law enforcement organ that implements comprehensive law enforcement in cultural markets under authorization of laws and regulations, and is accountable for the people's government at the same level; or
 (一)经法律、法规授权实施文化市场综合行政执法,对同级人民政府负责的执法机构;
(2) a law enforcement organ that accepts the authorization of relevant administrative departments to implement comprehensive law enforcement in cultural markets, accepts the guidance and supervision of the authorizing organ, and is accountable for the authorizing organ.
 (二)接受有关行政部门委托实施文化市场综合行政执法,接受委托机关的指导和监督,对委托机关负责的执法机构。
Article 4 The principle of fairness, impartiality, and openness shall be followed in comprehensive law enforcement in cultural markets, and a law enforcement system with clarified responsibilities and duties, effective supervision, and strong safeguards shall be established.
   第四条 文化市场综合行政执法应当遵循公平、公正、公开的原则,建立权责明确、行为规范、监督有效、保障有力的行政执法运行机制。
Article 5 The Ministry of Culture shall provide guidance with respect to the comprehensive law enforcement in the cultural markets nationwide, establish uniform and well-designed work systems of comprehensive law enforcement in cultural markets, build a technical supervision system for the cultural markets nationwide, strengthen the specialized, standardized, and information-based building of teams for comprehensive law enforcement in cultural markets, and improve the evaluation of the performance of comprehensive law enforcement in cultural markets.
All relevant administrative departments shall, within their respective scope of duties and authorities, guide comprehensive law enforcement organs in carrying out law enforcement business according to law.
The comprehensive law enforcement organs at all levels shall, according to their respective functions, be responsible for the work of comprehensive law enforcement in cultural markets within their respective administrative regions.
   第五条 文化部负责指导全国文化市场综合行政执法,建立统一完善的文化市场综合行政执法工作制度,建设全国文化市场技术监管体系,加强文化市场综合行政执法队伍的专业化、规范化、信息化建设,完善对文化市场综合行政执法工作的绩效考核。
各有关行政部门在各自职责权限范围内,指导综合执法机构依法开展执法业务。
各级综合执法机构依照职责分工负责本行政区域内的文化市场综合行政执法工作。
Chapter II Law Enforcement Organs and Law Enforcement Officers
 

第二章 执法机构与执法人员


Article 6 Comprehensive law enforcement organs shall establish coordination and cooperation mechanisms with the relevant administrative departments, keep posted of the basis and standards for law enforcement, and the relevant administrative licensing in a timely manner, issue public notices on dynamic market information and law enforcement circumstances on a regular basis, and put forward policies or work suggestions.
   第六条 综合执法机构与各有关行政部门应当建立协作机制,及时掌握行政执法的依据、标准以及相关行政许可情况,定期通报市场动态和行政执法情况,提出政策或者工作建议。
Article 7 A comprehensive law enforcement officer in cultural markets (hereinafter referred to as the “law enforcement officer”) shall satisfy the following conditions:
   第七条 文化市场综合行政执法人员(以下简称执法人员)应当具备以下条件:
(1) is a citizen of the People's Republic of China;
 (一)具有中华人民共和国国籍;
(2) is 18 years old or more;
 (二)年满十八周岁;
(3) abides by disciplines and laws, and has good conduct and physical health;
 (三)遵纪守法、品行良好、身体健康;
(4) has good knowledge of the laws and regulations on the administration of cultural markets and has the business knowledge and skills as required for the administration of cultural markets;
 (四)熟悉文化市场管理法律法规,掌握文化市场管理所需的业务知识和技能;
(5) has no criminal record or record of being expelled from public employment; or
 (五)无犯罪或者开除公职记录;
(6) other conditions that are prescribed in laws and regulations.
To recruit a law enforcement officer, an open examination shall be conducted according to the relevant provisions of the Civil Servant Law of the People's Republic of China, and the enrollment shall be performed on the basis of competitive selection.
 (六)法律法规规定的其他条件。
录用执法人员应当参照《中华人民共和国公务员法》的有关规定公开招考,择优录取。
Article 8 A law enforcement officer may undertake the work of law enforcement after the law enforcement officer has passed on-the-job training and the examination thereof, and has obtained a Certificate of Comprehensive Law Enforcement in Cultural Markets of the People's Republic of China or a law enforcement certificate that is issued by the people's governments at various levels.
A comprehensive law enforcement organ shall assess the performance of law enforcement officers each year. The law enforcement certificates of law enforcement officers that are not qualified upon assessment shall be temporarily withheld.
   第八条 执法人员经岗位培训和考试合格,取得《中华人民共和国文化市场综合行政执法证》或者各级人民政府核发的行政执法证后,方可从事行政执法工作。
综合执法机构应当每年对执法人员进行业务考核。对考核不合格的执法人员,应当暂扣执法证件。
Article 9 A comprehensive law enforcement organ shall conduct business training on law enforcement officers according to schedule, encourage and support law enforcement officers to participate in the in-service continuing education.
   第九条 综合执法机构应当有计划地对执法人员进行业务培训,鼓励和支持执法人员参加在职继续教育。
Article 10 A comprehensive law enforcement organ shall be allocated with special rooms for investigation questioning and evidence preservation, and facilities and devices as required for law enforcement, such as transportation, communications, evidence collection, and detection; and purchase personal injury insurance for law enforcement officers.
   第十条 综合执法机构应当配备调查询问、证据保存等专用房间及交通、通讯、取证、检测等行政执法所必需的设施设备;为执法人员购买人身意外伤害保险。
Article 11 A comprehensive law enforcement organ shall implement the system of regular post-shift on law enforcement officers, and a law enforcement officer shall not stay on a position for more than five years in general.
   第十一条 综合执法机构应当实行执法人员定期岗位轮换制度。执法人员在同一执法岗位上连续工作时间原则上不超过5年。
Article 12 All relevant administrative departments or comprehensive law enforcement organs may, as required, give commendations and awards to the law enforcement organs and law enforcement officers that have outstanding performance in their work.
   第十二条 各有关行政部门或者综合执法机构可按有关规定对工作成绩显著的综合执法机构和执法人员给予表彰、奖励。
Chapter III Law Enforcement Procedures
 

第三章 执法程序


Article 13 A comprehensive law enforcement organ shall establish a sound “12318” reporting system for cultural markets, and publicize reporting methods, accept and handle the reports in a timely and effective manner according to law, and may award persons with merits in reporting.
The illegal acts that are discovered during routine patrols or regular inspections, or reported by citizens, legal persons and other organizations, and the cases that are consigned by higher authorities, reported by lower organs for disposal, or transferred to the relevant departments shall be handled in a timely manner.
   第十三条 综合执法机构应当建立健全12318文化市场举报体系,向社会公布举报方式,依法及时有效受理、办理举报,对举报有功人员可给予一定奖励。
对日常巡查或者定期检查中发现的违法行为,公民、法人及其他组织举报的违法行为,上级交办的、下级报请处理的或者有关部门移送的案件,应当及时处理。
Article 14 After a major case occurs, the local comprehensive law enforcement organ shall report it to the law enforcement organ at the next higher level within 12 hours. The comprehensive law enforcement organ at the next higher level or the authorizing organ shall supervise the handling of such major cases.

   第十四条 重大案件发生后12小时内,当地综合执法机构应当将案件情况向上级报告。上级综合执法机构或者委托机关应当对重大案件的查处进行督办。
