Implementing Rules for the Regulations of Nanning Municipality on Urban Afforestation
(Promulgated by Decree No. 13 of Nanning Municipal People's Government on January 25, 2003, revised in accordance with the Decision of Nanning Municipal People's Government on Amending the Implementing Rules for the Regulations of Nanning Municipality on Urban Afforestation on May 23, 2005.)

Article 1 With a view to strengthening the planning, construction, protection and administration of the afforestation of the city gardens and parks, these Rules are enacted in accordance with Regulations of Nanning Municipality on Urban Afforestation (hereinafter referred to as the Regulations).
| | 第一条 为加强城市园林绿化的规划、建设、保护和管理，根据《南宁市城市园林绿化条例》（以下简称《条例》）的规定，制定本实施细则。
|
Article 2 As for the urban unit and the citizen with the capacity to work (man aged 18-60, woman aged 18-55), every person shall have the obligation to voluntarily plant 5 trees or complete the green planting and protection task of the corresponding labour work. As for the juvenile adult who reaches the age of 11 years old but under 18 years old, the afforestation labour work may be arranged within his capacity.
| | 第二条 城市中的单位和有劳动能力的公民（男十八至六十周岁，女十八至五十五周岁），每人每年义务植树五株，或完成相应劳动量的植绿护绿任务。对已满十一周岁未满十八周岁的青少年，尽可能安排力所能及的绿化劳动。

Article 3 The city green land used in the Regulations refers the following 7 kinds of green lands within the planning area:
| | 第三条 《条例》所称的城市绿地，是指在本市规划区内的下列七类绿地：
|
(1) The public green land: refers to the various parks which are open to the public at the city level, at the county level and in the residential area (including the general park, the children's park, the cultural relics park, the commemorative park, the landscape park, the zoo, the botanical garden and the belt park, etc.), the street garden, and the water area within the territory of Nanning city.
| | （一）公共绿地：指向公众开放的市级、区级、居住区级各类公园（综合性公园、儿童公园、文物古迹公园、纪念性公园、风景名胜公园、动物园、植物园、带状公园等）、街旁游园，包括其范围内的水域。
|
(2) The green land in residential area; refers to other green lands in the residential area, except the park at the district level; includes the mini small resting area within the residential area level, the green land of the social organization, the children's playground, the green land beside the building, the affiliated public green land and the road green land (namely the green land within the red line of the road), etc.
| | （二）居住区绿地：指居住区内除居住区级公园以外的其它绿地。包括小区级小游园、组团绿地、儿童游戏场、宅旁绿地、配套公建所属绿地和道路绿地（即道路红线内的绿地）等。

(3) The green land attached to the unit; refers to the environmental green land within the administrative limits of the government agency, the organization, the armed forces, the enterprise, the government-sponsored institutions and other units.
| | （三）单位附属绿地：指机关、团体、部队、企业、事业等单位管界内的环境绿地。
|
(4) The protection green land: refers to the green belt and green land used for the purpose of city separation, sanitation, safety, and disaster prevention, etc.
| | （四）防护绿地：指用于城市隔离、卫生、安全、防灾等目的的绿带、绿地。
|
(5) The production green land: refers to the garden field that provides the afforestation of the city gardens and parks with the seedling, flower, sward, and seeds.
| | （五）生产绿地：指为城市园林绿化提供苗木、花卉、草皮、种子的圃地。
|
(6) The road green land: refers to the land used for the afforestation of the road and the square. The road green land is comprised of the road green belt (including the vehicle-division green belt, the driving way tree green belt, the road side green belt), the traffic island green land (including the central island green land, the guiding island green land, the fly-over crossing green island), the traffic square green land, the parking lot green land, etc., and
| | （六）道路绿地：指道路及广场范围内用于绿化的用地。道路绿地分为道路绿带（包括分车绿带、行道树绿带、路侧绿带）、交通岛绿地（包括中心岛绿地、导向岛绿地、立体交叉绿岛）、交通广场绿地和停车场绿地等。
|
(7) The landscape woodland; refers to the woodland that has certain landscape value, plays a role in the overall city landscape and environment, but still has not the equipped with complete facilities for sight-seeing, relaxation, entertainment, etc.
| | （七）风景林地：指具有一定景观价值，在城市整体风貌和环境中起作用，但尚没有完善游览、休息、娱乐等设施的林地。

Article 4 The competent municipal administrative department of the afforestation of city gardens and parks shall be responsible for the construction, protection and administration of the afforestation of the city gardens and parks.
The administrative department of the afforestation of gardens and parks in the people's government of the urban district shall be responsible for the construction, protection and administration of the afforestation of road, of which the red line breadth is less than 20 meters; shall be responsible for inspection, supervision and guidance of the afforestation of the unit court yard and of the gardens and parks in the residential area within its administrative jurisdiction.
Each administrative committee of the development zone shall make the construction, protection and administration of the afforestation of the gardens and parks within the administrative district, in accordance with the function granted or entrusted by the competent municipal administrative department of the afforestation of the gardens and parks.
| | 第四条 市园林绿化行政主管部门负责本市城市园林绿化的建设、保护和管理。
城区人民政府园林绿化管理部门负责路幅红线宽度20米以下道路绿化的建设、保护和管理，对本辖区内单位庭院、居住区的园林绿化进行检查、督促和指导。
各开发区管委会根据市园林绿化行政主管部门授予或委托的职能，对本辖区内的园林绿化进行建设、保护和管理。

Article 5 The green land rate of the city new building, alteration and expansion project referred to in Article 8 and Article 9 of the Regulations shall be calculated within the red line land use range of the construction unit.
The green land rate = the green land area of the gardens and parks in the district ÷the area of the district× 100%
The green land area shall not include the roof afforestation, the vertical afforestation, the balcony afforestation and the indoor afforestation.
| | 第五条 《条例》第八条、第九条所称的城市新建、改建、扩建工程的绿地率，应纳入建设单位红线用地范围进行计算：
绿地率＝区域内园林绿地面积÷区域面积×100%。
绿地面积不包括屋顶绿化、垂直绿化、阳台绿化和室内绿化。

Article 6 Enterprises that engage in construction, maintenance, management and project supervision of the afforestation of city gardens and parks, and production and business operation of the seedling, flower, potted plant, and sward, and provide technical consultation, training, service and other service relating to afforestation of city gardens and parks shall all be brought under the administrative range of the afforestation trade of the city gardens and parks, and shall obtain the corresponding qualification license of enterprises for afforestation of city gardens and parks.
The enterprise for the afforestation of the city gardens and parks at the third level and under the third level, shall be examined and approved by the municipal administrative department of the afforestation of the city parks and gardens, be issued with the license for qualifications of the enterprise for the afforestation of city gardens and parks.
| | 第六条 本市从事城市园林绿化施工、养护管理、工程监理以及城市园林绿化苗木、花卉、盆景、草坪生产和经营，提供有关城市园林绿化技术咨询、培训、服务等业务的企业，均应纳入城市园林绿化行业管理范围，取得相应的城市园林绿化企业资质证书。
本市三级及三级以下城市园林绿化企业由市园林绿化行政主管部门审批、发放《城市园林绿化企业资质证书》。

Article 7 The affiliated afforestation project of the city new building, alteration and expansion project shall be planned and designed together with the principal part of the project. After the overall architecture plan of the project is approved, the construction unit shall submit the design plan of the corollary afforestation project to the competent municipal administrative department of gardens and parks for record.
| | 第七条 城市新建、改建、扩建工程的配套绿化工程应与主体工程同时规划设计，工程项目总平面图获得批准后，建设单位须将配套绿化工程的设计方案报市园林绿化行政主管部门备案。

Article 8 As for any afforestation project of city gardens and parks with the construction area over 5,000 square meters or the construction cost over 300,000 yuan, it shall invite the public bidding in accordance with the relevant Regulations of the state on the bidding invitation of the construction project.
| | 第八条 凡建设面积达5000平方米以上或工程造价在30万元以上的城市园林绿化工程项目，应按国家有关建设工程施工招标投标的规定实行施工招标投标。

Article 9 The construction of the afforestation project of the city gardens and parks shall be conducted strictly in accordance with the construction specifications of the afforestation project of the city gardens and parks, shall accept the quality supervision and administration by the competent municipal administrative department of the city gardens and parks. As for the construction of the project with the construction area over 3,000 square meters or with the construction cost over 150,000 yuan, the supervision of the construction of the project shall be entrusted to the unit with the supervision qualifications in the afforestation project of the gardens and parks.
After finishing the afforestation project of the gardens and parks, the construction unit shall submit the complete drawing of the afforestation project to the administrative department of the gardens and parks for registration and record within 30 days.
| | 第九条 城市园林绿化工程施工，必须严格按照城市园林绿化工程施工规范进行，并接受市园林绿化行政主管部门的质量监督管理。建设面积达3000平方米以上或工程造价在15万元以上的城市园林绿化工程的施工，必须委托有园林绿化工程监理资质的单位进行监理。
园林绿化工程竣工后，建设单位应在三十日内，将绿化工程竣工图报园林绿化管理部门备案。

Article 10 The maintenance management of the city green land shall be conducted strictly in accordance with the specification for maintenance of the city green land and the competent municipal administrative department of the afforestation of the gardens and parks shall make the quality supervision administration.
| | 第十条 城市绿地的养护管理，必须严格按照城市绿地养护规范进行，并由市园林绿化行政主管部门实施质量监督管理。

Article 11 The afforestation compensation in the Regulations shall include the compensation for the construction of the green land, which is the lacking part of the approved construction project in which the green land rate does not reach the stipulated standard, the compensation for the occupation and use of the green land, the compensation for the temporary occupation and use of the green land, and the compensation for felling, transplanting, and pruning the plants of city afforestation.
．．．．．． | | 第十一条 《条例》所称的绿化补偿费，包括：经批准绿地率未达到规定标准的建设项目所缺少部分的绿地建设补偿费、占用绿地补偿费、临时使用绿地补偿费，砍伐、移植、修剪城市绿化植物补偿费。
