The Regulations on Administration of the Establishment and Staffing of the Administrative Agencies of the State Council are hereby promulgated and effective as of the date of promulgation.

Chapter I General Provisions
| | 第一章 总则

Article 1 These Regulations are formulated in accordance with the Constitution and the Organic Law of the State Council for the purposes of standardizing establishment of the administrative agencies of the State Council, enhancing administration of the establishment and staffing thereof and improving administrative efficiency.
| | 第一条 为了规范国务院行政机构的设置，加强编制管理，提高行政效率，根据宪法和国务院组织法，制定本条例。

Article 2 Administration of establishment and staffing of the administrative agencies of the State Council shall adapt to the needs of political, economic, and social development of the State, and the principles of simplification, unification and high efficiency shall be observed.
| | 第二条 国务院行政机构设置和编制管理应当适应国家政治、经济、社会发展的需要，遵循精简、统一、高效的原则。

Article 3 The State Council exercises the functions arid powers of administration over establishment and staffing of the administrative agencies of the State Council in accordance with the provisions of the Constitution and the Organic Law of the State Council.
The agency and staffing administration organ of the State Council, under the leadership of the State Council, is responsible for the specific administration of establishment and staffing of the administrative agencies of the State Council.

国务院机构编制管理机关在国务院领导下，负责国务院行政机构设置和编制管理的具体工作。

Chapter II Administration of Agency Establishment

Article 4 The establishment of the administrative agencies of the State Council is based on the scientific allocation of functions, to achieve a clarification of functions, rational division of duties and simplified structure and be beneficial to improving administrative efficiency.
The State Council, according to the requirements of the national economy and social development and in the light of the requirements of the socialist market economy, adjusts the administrative agencies of the State Council at the proper time; but a relative stability within the constituent ministries and commissions of the State Council shall be maintained during the term of office of the Government.
| | 第四条 国务院行政机构的设置以职能的科学配置为基础，做到职能明确、分工合理、机构精简，有利于提高行政效能。
国务院根据国民经济和社会发展的需要，适应社会主义市场经济体制的要求，适时调整国务院行政机构；但是，在一届政府任期内，国务院组成部门应当保持相对稳定。

Article 5 The establishment, dissolution or merger of administrative agencies of the State Council is appraised and validated by the agency and staffing administration organ of the State Council by organizing the relevant departments and experts in advance.
| | 第五条 国务院行政机构的设立、撤销或者合并，由国务院机构编制管理机关事先组织有关部门和专家进行评估和论证。

Article 6 The administrative agencies of the State Council are, according to their functions, divided into the General Office of the State Council, the constituent ministries and commissions of the State Council, the directly subordinate agencies of the State Council, administrative offices of the State Council, the State agencies administrated by the constituent ministries or commissions of the State Council and the deliberation and coordination agencies of the State Council.
The General Office of the State Council assists the leaders of the State Council in handling the day-to-day work of the State Council.
The constituent ministries and commissions of the State Council exercise the basic administrative functions of the State Council according to law, which include the various ministries or commissions, the People's Bank of China and the Auditing Agency.
The directly subordinate agencies of the State Council take charge of certain specialized work of the State Council and have independent administrative functions.
The administrative offices of the State Council assist the Premier of the State Council in handling specialized affairs and do not have independent administrative functions.
The State agencies administrated by the constituent ministries or commissions of the State Council are subject to the administration of the constituent ministries or commissions of the State Council, take charge of specialized work and exercise administrative and managerial functions.
The deliberation and coordination agencies of the State Council undertake the organization and coordination of the important work across administrative agencies of the State Council. The affairs deliberated and decided upon by the deliberation and coordination agencies of the State Council shall, upon the consent of the State Council, be handled by the relevant agencies according to their respective duties. Under special or urgent circumstances, the deliberation and coordination agencies of the State Council shall, upon the consent of the State Council, stipulate interim administrative measures.
| | 第六条 国务院行政机构根据职能分为国务院办公厅、国务院组成部门、国务院直属机构、国务院办事机构、国务院组成部门管理的国家行政机构和国务院议事协调机构。
国务院办公厅协助国务院领导处理国务院日常工作。
国务院组成部门依法分别履行国务院基本的行政管理职能。国务院组成部门包括各部、各委员会、中国人民银行和审计署。
国务院直属机构主管国务院的某项专门业务，具有独立的行政管理职能。
国务院办事机构协助国务院总理办理专门事项，不具有独立的行政管理职能。
国务院组成部门管理的国家行政机构由国务院组成部门管理，主管特定业务，行使行政管理职能。
国务院议事协调机构承担跨国务院行政机构的重要业务工作的组织协调任务。国务院议事协调机构议定的事项，经国务院同意，由有关的行政机构按照各自的职责负责办理。在特殊或者紧急的情况下，经国务院同意，国务院议事协调机构可以规定临时性的行政管理措施。

Article 7 The State Council shall establish a general office in accordance with the provisions of the Organic Law of the State Council.
