全国银行间同业拆借中心利率互换交易确认规则

第一章　总则

　　1.1　为规范利率互换交易确认行为，维护市场秩序，保护交易成员的合法权益，根据中国人民银行相关文件精神，制定本规则。

前款所称利率互换交易确认，是参与机构通过全国银行间同业拆借中心（以下简称交易中心）系统确认利率互换交易条款、要素定义及其他必要合同条款的行为。

　　1.2　参与机构应根据交易中心要求签署相关法律文件，遵守本规则及交易中心发布的《全国银行间同业拆借中心利率互换确认细则》。

第二章　定义

　　2.1　交易中心系统：是指由交易中心管理运作的，向交易成员提供利率互换交易确认及其他辅助服务的计算机处理系统和数据通讯网络。

　　2.2　参与机构：是指完成与交易中心联网并签署交易确认相关法律文件的利率互换市场成员。参与机构应在交易中心系统中建立系统用户并为其设定相应确认操作权限。参与机构在交易中心系统中的所有操作以交易中心系统数据库记录为准。

　　2.3　系统用户：指由交易成员建立并支配的，用以在交易中心系统中进行利率互换交易确认及相关操作的系统帐号。

　　2.4　交易确认书：交易中心系统依据交易双方达成一致的利率互换交易条款、要素定义及其他必要合同条款出具的、对交易双方具有法律约束力的利率互换交易合同。

　　2.5　工作日与确认时间：工作日为每周一至周五，遇法定节假日调整除外，确认时间为每工作日8：30-19：00；如遇变更，交易中心将提前发布市场公告。

第三章　确认行为及其效力

　　3.1　自交易中心通过中国货币网（www.chinamoney.com.cn）更新参与机构名单之日起，该等参与机构之间通过交易中心系统达成的利率互换交易，亦应通过交易中心系统进行确认。
