| Measures for the Administration of Business Operations of Artworks | | 艺术品经营管理办法 |
| Chapter I General Provisions | | 第一章 总 则 |
| Article 1 These Measures are developed to strengthen the administration of the artwork business activities , regulate business operations, flourish the artwork market, and protect the legitimate rights and interests of creators, business operators and consumers. | | 第一条 为了加强对艺术品经营活动的管理，规范经营行为，繁荣艺术品市场，保护创作者、经营者、消费者的合法权益，制定本办法。 |
| Article 2 For the purpose of the these Measures, “artworks” means works of painting, calligraphy and seal cutting, sculpture and carving, artistic photography, installation art, industrial art and the limited replicas of the aforesaid works. The "artworks" as mentioned in these Measures exclude cultural relics. | | 第二条 本办法所称艺术品，是指绘画作品、书法篆刻作品、雕塑雕刻作品、艺术摄影作品、装置艺术作品、工艺美术作品等及上述作品的有限复制品。本办法所称艺术品不包括文物。 |
| The "artwork business activities" regulated in these Measures include: | | 本办法规范的艺术品经营活动包括： |
| (1) purchase, sale and lease; | | （一）收购、销售、租赁； |
| (2) brokerage; | | （二）经纪； |
| (3) import and export business operations; | | （三）进出口经营； |
| (4) identification, evaluation, commercial exhibition and other services; and | | （四）鉴定、评估、商业性展览等服务； |
| (5) investment and business operations and services with artworks as subject matters. | | （五）以艺术品为标的物的投资经营活动及服务。 |
| These Measures shall apply to those engaging in artwork business activities through information networks. | | 利用信息网络从事艺术品经营活动的适用本办法。 |
| Article 3 The Ministry of Culture shall take charge of developing the policies on the administration of artwork business operations , supervising and administering the artwork business activities nationwide, and establishing the artwork market credit regulatory system. | | 第三条 文化部负责制定艺术品经营管理政策，监督管理全国艺术品经营活动，建立艺术品市场信用监管体系。 |
| The culture administrative departments of the people's governments of all provinces, autonomous regions, and municipalities directly under the Central Government shall take charge of the approval of the business activities of import and export of artworks, form expert committees, and provide professional opinions for the relevant work on content review and market regulation conducted by the culture administrative departments. | | 省、自治区、直辖市人民政府文化行政部门负责艺术品进出口经营活动审批，建立专家委员会，为文化行政部门开展的内容审查、市场监管相关工作提供专业意见。 |
| The culture administrative departments of the people's governments at or above the county level shall take charge of the routine supervision and administration of artwork business activities within their respective administrative regions, and the culture administrative departments of the people's governments at or above or the comprehensive law enforcement organs of the cultural market authorized in accordance with the law shall impose punishments on the violations of the relevant provisions of the state when engaging in artwork business activities. | | 县级以上人民政府文化行政部门负责本行政区域内艺术品经营活动的日常监督管理工作，县级以上人民政府文化行政部门或者依法授权的文化市场综合执法机构对从事艺术品经营活动违反国家有关规定的行为实施处罚。 |
| Article 4 The construction of social organizations in the artwork market shall be strengthened. Industry associations and other social organizations shall be encouraged and directed to develop industry standards; members shall be guided and supervised to conduct business activities; and, in accordance with the articles of association, industry self-regulation shall be strengthened, and the building of integrity shall be boosted, so as to promote fair industry competition. | | 第四条 加强艺术品市场社会组织建设。鼓励和引导行业协会等社会组织制定行业标准，指导、监督会员依法开展经营活动，依照章程，加强行业自律，推动诚信建设，促进行业公平竞争。 |
| Chapter II Operating Rules | | 第二章 经营规范 |
| Article 5 To form the business entities engaging in artwork business activities, the applicants shall apply for business licenses to the administrative departments for industry and commerce of the people's governments at or above the county level at the places of their domiciles, and, within 15 days from the dates when business licenses are obtained, undergo the recordation formalities with the culture administrative departments of the people's governments at or above the county level at the places of their domiciles. | | 第五条 设立从事艺术品经营活动的经营单位，应当到其住所地县级以上人民政府工商行政管理部门申领营业执照，并在领取营业执照之日起15日内，到其住所地县级以上人民政府文化行政部门备案。 |
| Where any other business entity adds the artwork operation business, it shall undergo the recordation formalities in accordance with the preceding paragraph. | | 其他经营单位增设艺术品经营业务的，应当按前款办理备案手续。 |
| Article 6 It is forbidden to operate the artworks containing the following contents: | | 第六条 禁止经营含有以下内容的艺术品： |
| (1) Opposing the basic principles as prescribed in the Constitution. | | （一）反对宪法确定的基本原则的； |
| (2) Endangering the unity, sovereignty or territorial integrity of the state. | | （二）危害国家统一、主权和领土完整的； |
| (3) Divulging the state secrets , endangering national security or damaging the honor or benefits of the state. | | （三）泄露国家秘密、危害国家安全或者损害国家荣誉和利益的； |
| (4) Inciting ethnic hatred or discrimination, undermining the ethnic solidarity, or infringing upon national customs or habits. | | （四）煽动民族仇恨、民族歧视，破坏民族团结，或者侵害民族风俗、习惯的； |
| (5) Violating the religious policies of the state, or propagating evil cults or superstition. | | （五）破坏国家宗教政策，宣扬邪教、迷信的； |
| (6) Propagating terrorist activities, spreading rumors, disturbing the public order or destroying the social stability. | | （六）宣扬恐怖活动，散布谣言，扰乱社会秩序，破坏社会稳定的； |
| (7) Propagating obscenity, eroticism, gambling or violence or instigating crimes. | | （七）宣扬淫秽、色情、赌博、暴力或者教唆犯罪的； |
| (8) Insulting or defaming others, or infringing upon the lawful rights and interests of others. | | （八）侮辱或者诽谤他人，侵害他人合法权益的； |
| (9) Breaching social morality or excellent ethnic cultural heritage. | | （九）违背社会公德或者民族优秀文化传统的； |
| (10) Maliciously falsifying the history or seriously distorting the history. | | （十）蓄意篡改历史、严重歪曲历史的； |
| (11) Other contents prohibited by laws, administrative regulations and the provisions of the state. | | （十一）有法律、法规和国家规定禁止的其他内容的。 |
| Article 7 It is forbidden to operate the following artworks: | | 第七条 禁止经营以下艺术品： |
| (1) Artworks smuggled or stolen or obtained from any other illegal source. | | （一）走私、盗窃等来源不合法的艺术品； |
| (2) Artworks forged, altered or falsely used in other people's names. | | （二）伪造、变造或者冒充他人名义的艺术品； |
| (3) Artworks made from animals, plants, minerals, metals, fossils or other materials whose trading is prohibited by any law or regulation, except otherwise allowed to be operated under legal procedures. | | （三）除有合法手续、准许经营的以外，法律、法规禁止交易的动物、植物、矿物、金属、化石等为材质的艺术品； |
| (4) Other artworks whose trading is forbidden by the state. | | （四）国家规定禁止交易的其他艺术品。 |
| Article 8 Artwork business entities may not engage in any of the following business operations: | | 第八条 艺术品经营单位不得有以下经营行为： |
