| Chapter I General Provisions | | 第一章 总则 |
| Article 1 For purposes of regulating the provision of private network and targeted communication audiovisual program services, promoting the sound and orderly development of the industry, protecting the lawful rights and interests of the general public and institutions, and safeguarding national interest and public interest, these Provisions are developed in accordance with the relevant provisions of the state. | | 第一条 为规范专网及定向传播视听节目服务秩序，促进行业健康有序发展，保护公众和从业机构的合法权益，维护国家利益和公共利益，根据国家有关规定，制定本规定。 |
| Article 2 For purposes of these Measures, “private network and targeted communication audiovisual program services” mean the provision of radio and TV program and other audiovisual program services to the targeted audience with TV, and all types of handheld electronic equipment, etc., as terminal recipients, and through setting up virtual private network through local area networks and Internet or with Internet and other information networks as targeted transmission channels, including the provision of contents, integrated broadcast control, transmission and distribution, and other activities conducted by such forms as Internet protocol television (IPTV), private network mobile TV, and Internet TV. | | 第二条 本规定所称专网及定向传播视听节目服务，是指以电视机、各类手持电子设备等为接收终端，通过局域网络及利用互联网架设虚拟专网或者以互联网等信息网络为定向传输通道，向公众定向提供广播电视节目等视听节目服务活动，包括以交互式网络电视（IPTV）、专网手机电视、互联网电视等形式从事内容提供、集成播控、传输分发等活动。 |
| Article 3 The competent department of radio, film and television of the State Council shall be responsible for the supervision and administration of private network and targeted communication audiovisual program services nationwide. | | 第三条 国务院广播电影电视主管部门负责全国专网及定向传播视听节目服务的监督管理工作。 |
| The competent departments of radio, film and television of local people's governments at or above the county level shall be responsible for the supervision and administration of private network and targeted communication audiovisual program services within their respective administrative regions. | | 县级以上地方人民政府广播电影电视主管部门负责本行政区域内专网及定向传播视听节目服务的监督管理工作。 |
| Article 4 For the provision of private network and targeted communication audiovisual program services, the orientation of serving the people and the socialist undertaking shall be adhered to, priority shall be laid on social benefits, carrying forward the core socialist values and the fine traditional culture of the nation, and the positive energy. | | 第四条 从事专网及定向传播视听节目服务，应当坚持为人民服务、为社会主义服务，把社会效益放在首位，弘扬社会主义核心价值观，弘扬民族优秀传统文化，弘扬正能量。 |
| Private network and targeted communication audiovisual program service entities shall voluntarily abide by the Constitution, laws and administrative regulations, provide more and better private network and targeted communication audiovisual program services, and continuously enrich the people's spiritual and cultural life. | | 专网及定向传播视听节目服务单位应当自觉遵守宪法、法律和行政法规，提供更多更好的专网及定向传播视听节目服务，不断丰富人民群众的精神文化生活。 |
| Private network and targeted communication audiovisual program service industry organizations are encouraged to play the functions of industry self-discipline, guidance and services, and the public are encouraged to oversee private network and targeted communication audiovisual program services. | | 鼓励专网及定向传播视听节目服务行业组织发挥行业自律、引导、服务功能，鼓励公众监督专网及定向传播视听节目服务。 |
| Chapter II Formation of Private Network and Targeted Communication Audiovisual Program Service Entities | | 第二章 专网及定向传播视听节目服务单位的设立 |
| Article 5 Whoever provides private network and targeted communication audiovisual program services, such as content provision, integrated broadcast control, and transmission and distribution, shall obtain a License for the Dissemination of Audiovisual Programs through Information Network in accordance with these Provisions. | | 第五条 从事内容提供、集成播控、传输分发等专网及定向传播视听节目服务，应当依照本规定取得《信息网络传播视听节目许可证》。 |
| The License for the Dissemination of Audiovisual Programs through Information Network shall be issued by the competent department of radio, film and television of the State Council based on the categories of such matters as business categories, service content, transmission network, and coverage of private network and targeted communication audiovisual program services. | | 《信息网络传播视听节目许可证》由国务院广播电影电视主管部门根据专网及定向传播视听节目服务的业务类别、服务内容、传输网络、覆盖范围等事项分类核发。 |
| A catalogue for guiding private network and targeted communication audiovisual program services shall be developed by the competent department of radio, film and television of the State Council. | | 专网及定向传播视听节目服务业务指导目录由国务院广播电影电视主管部门制定。 |
| Article 6 An entity that applies for the provision of private network and targeted communication audiovisual program services shall meet the following conditions: | | 第六条 申请从事专网及定向传播视听节目服务的单位，应当具备下列条件： |
| (1) It has the status of a legal person and is a state-owned or state-controlled entity. | | （一）具备法人资格，为国有独资或者国有控股单位； |
| (2) It has complete management rules for program content compilation and safe transmission as well as safety protection measures. | | （二）有健全的节目内容编审、安全传播管理制度和安全保护措施； |
| (3) It has the technical capability, business premises and relevant resources suitable for its business. | | （三）有与其业务相适应的技术能力、经营场所和相关资源； |
| (4) It has professionals suitable for its business. | | （四）有与其业务相适应的专业人员； |
| (5) Its technical plan complies with the relevant standards and technical specifications of the state. | | （五）技术方案符合国家有关标准和技术规范； |
| (6) It complies with the overall plan, layout and catalogue for guiding private network and targeted communication audiovisual program services as determined by the competent department of radio, film and television of the State Council. | | （六）符合国务院广播电影电视主管部门确定的专网及定向传播视听节目服务总体规划、布局和业务指导目录； |
| (7) It meets other conditions prescribed by laws, administrative regulations and relevant provisions of the state. | | （七）符合法律、行政法规和国家规定的其他条件。 |
| Wholly foreign-owned institutions, Chinese-foreign equity joint ventures and Chinese-foreign contractual joint ventures shall not provide private network and targeted communication audiovisual program services. | | 外商独资、中外合资、中外合作机构，不得从事专网及定向传播视听节目服务。 |
| Article 7 Any entity that applies for the provision of content provision services shall be a radio and television broadcaster at or above the prefecture (city) level formed with the approval of the competent department of radio, film and television of the State Council, a central news entity or any other institution, and shall have program content reserves of 2,000 hours or more and 30 or more professional program production and editing personnel. | | 第七条 申请从事内容提供服务的，应当是经国务院广播电影电视主管部门批准设立的地（市）级以上广播电视播出机构或者中央新闻单位等机构，还应当具备2000小时以上的节目内容储备和30人以上的专业节目编审人员。 |
| Whoever applies for the provision of centralized broadcast control services shall be a radio and television broadcaster at or above the level of provinces, autonomous regions, and municipalities directly under the Central Government formed with the approval of the competent department of radio, film and television of the State Council. | | 申请从事集成播控服务的，应当是经国务院广播电影电视主管部门批准设立的省、自治区、直辖市级以上广播电视播出机构。 |
| Whoever applies for the provision of IPTV transmission services or private network mobile phone and TV distribution services shall be an entity which is qualified for conducting legal basic network operation as approved by the competent department of industry and information technology of the State Council, and has public information basic network facilities and resources of a certain scale and the reputation or capability for providing long-term services to users. | | 申请从事交互式网络电视（IPTV）传输服务、专网手机电视分发服务的，应当是国务院工业和信息化主管部门批准的具有合法基础网络运营资质的单位，并具有一定规模的公共信息基础网络设施资源和为用户提供长期服务的信誉或者能力。 |
| Article 8 Whoever applies for the provision of private network and targeted communication audiovisual program services shall file an application with the competent department of radio, film and television of the people's government of the province, autonomous region or municipality directly under the Central Government, and an entity directly under the Central Government may directly file an application with the competent department of radio, film and television of the State Council. | | 第八条 申请从事专网及定向传播视听节目服务，应当向省、自治区、直辖市人民政府广播电影电视主管部门提出申请，中央直属单位可直接向国务院广播电影电视主管部门提出申请。 |
| The competent department of radio, film and television of the people's government of the province, autonomous region or municipality directly under the Central Government shall, within 20 days as of receipt of the application, offer its preliminary examination opinions, and submit the preliminary examination opinions and all the application materials to the competent department of radio, film and television of the State Council for approval. The competent department of radio, film and television of the State Council shall, within 40 days as of receipt of the application or preliminary examination opinion, make a decision of approval or disapproval, and the period for expert review shall be 20 days. If approval is granted, it shall issue a License for the Dissemination of Audiovisual Programs through Information Network to the applicant, and announce it to the public; and if it decides not to grant approval, it shall notify the applicant in writing and explain the reason for disapproval. | | 省、自治区、直辖市人民政府广播电影电视主管部门应当自收到申请之日起20日内提出初核意见，并将初核意见及全部申请材料报国务院广播电影电视主管部门审批；国务院广播电影电视主管部门应当自收到申请或者初核意见之日起40日内作出许可或者不予许可的决定，其中专家评审时间为20日。予以许可的，向申请人颁发《信息网络传播视听节目许可证》，并向社会公告；不予许可的，应当书面通知申请人并说明理由。 |
| Article 9 The License for the Dissemination of Audiovisual Programs through Information Network shall be valid for three years. If the entity needs to continue the provision of private network and targeted communication audiovisual program services upon the expiration of the validity term, it shall, within 30 days before the expiration of the validity term, undergo extension formalities under the approval procedures as prescribed in these Provisions based upon the strength of relevant materials proving that it meets the conditions as set forth in Articles 6 and 7 of these Provisions. | | 第九条 《信息网络传播视听节目许可证》有效期为3年。有效期届满，需继续从事专网及定向传播视听节目服务的，应当于有效期届满前30日内，持符合本规定第六条、第七条条件的相关材料，按照本规定的审批程序办理续办手续。 |
| Article 10 Where a private network and targeted communication audiovisual program service entity modifies its business categories, service content, communication network, coverage or any other business item indicated on the License for the Dissemination of Audiovisual Programs through Information Network, or changes its shareholders, equity structure or any major matter, it shall undergo approval formalities in accordance with these Provisions in advance. | | 第十条 专网及定向传播视听节目服务单位变更《信息网络传播视听节目许可证》载明的业务类别、服务内容、传输网络、覆盖范围等业务项目以及变更股东、股权结构等重大事项的，应当事先按本规定办理审批手续。 |
| Where a private network and targeted communication audiovisual program service entity changes its name, office premise, or legal representative in accordance with the law, it shall undergo recordation formalities with the original license-issuing authority within 15 days after the date of change. | | 专网及定向传播视听节目服务单位的单位名称、办公场所、法定代表人依法变更的，应当在变更后15日内向原发证机关备案。 |
| Where a private network and targeted communication audiovisual program service entity conducts operational business such as program production and sale, advertisement placement, market promotion, business cooperation, receipt, payment and settlement, and technical services, in the mode of equity or contractual cooperation, it shall undergo recordation formalities with the original license-issuing authority within 15 days as of entering into the equity or contractual cooperation agreement. | | 专网及定向传播视听节目服务单位采用合资、合作模式开展节目生产购销、广告投放、市场推广、商业合作、收付结算、技术服务等经营性业务的，应当在签订合资、合作协议后15日内向原发证机关备案。 |
| Article 11 A private network and targeted communication audiovisual program service entity shall provide services within 90 days after obtaining a License for the Dissemination of Audiovisual Programs through Information Network. If it fails to provide services on schedule, the original licensing-issuing authority shall cancel its License for the Dissemination of Audiovisual Programs through Information Network. | | 第十一条 专网及定向传播视听节目服务单位应当在取得《信息网络传播视听节目许可证》90日内提供服务。未按期提供服务的，由原发证机关注销其《信息网络传播视听节目许可证》。 |
| ．．．．．． | | 如因特殊原因，延期或者中止提供服务的，应经原发证机关同意。申请终止服务的，应提前60日向原发证机关申报，由原发证机关注销其《信息网络传播视听节目许可证》。 |
| | 未经申报，连续停止业务超过60日的，由原发证机关按终止业务处理，并注销其《信息网络传播视听节目许可证》。 |
