(No. 31)
The Provisions on the Administration of Chinese-foreign Cooperative Production of Films, which have been adopted at the administrative meeting of the State Administration of Radio, Film and Television on June 15, 2004, are hereby promulgated and shall become effective as of August 10, 2004.

Article 1 These Provisions are formulated in accordance with the Regulations on the Administration of Films in order to promote the creation and production of films, to safeguard the lawful rights and interests of the producers of and the persons relevant to Chinese-foreign cooperative production of films and to promote the exchange of Chinese and foreign films.
| | 第一条 为繁荣电影创作生产，维护中外合作摄制电影片的制片者及相关人员的合法权益，促进中外电影交流，根据《电影管理条例》，制定本规定。
|
Article 2 For the purposes of these Provisions, the term “Chinese-foreign cooperative production of films” means that any Chinese films producer (hereinafter referred to as “Chinese party”) who obtains the License for Producing Films or the License for Producing Film (Single Film) and any foreign films producer (hereinafter referred to as “foreign party”) produce films jointly, harmoniously or by entrustment in China.
| | 第二条 本规定所称中外合作摄制电影片，是指依法取得《摄制电影许可证》或《摄制电影片许可证（单片）》的境内电影制片者（以下简称中方）与境外电影制片者（以下简称外方）在中国境内外联合摄制、协作摄制、委托摄制电影片。
|
Article 3 These Provisions shall apply to such films (including film films, digital films and telecines etc.) as features films, cartoons, popular science films, documentary films and special topics films.
| | 第三条 本规定适用于中外电影制片者在中国境内外合作摄制的故事片、美术片、科教片、纪录片、专题片等电影片（含胶片电影、数字电影、电视电影等）。
|
Article 4 The State Administration of Radio, Film and Television (hereinafter referred to as “SARFT”) shall be responsible for the administration of Chinese-foreign cooperative production of films.
| | 第四条 国家广播电影电视总局（以下简称广电总局）负责中外合作摄制电影的管理工作。
|
Article 5 Chinese-foreign cooperative production of films shall take the following means:
| | 第五条 中外合作摄制电影片包括下列形式：
|
(1) joint production, i.e. the way of production by which the Chinese and foreign parties jointly contribute capitals (including funds, labor or kinds), produce films and share interests and risks;
| | （一）联合摄制，即由中外双方共同投资（含资金、劳务或实物）、共同摄制、共同分享利益及共同承担风险的摄制形式；
|
(2) harmonious production, i.e. the way of production by which the foreign party contributes capitals, the Chinese party provides with considerations such assistances as equipment, apparatuses, sites and labor, and the film is done in China; and
| | （二）协作摄制，即外方出资，在中国境内拍摄，中方有偿提供设备、器材、场地、劳务等予以协助的摄制形式；
|
(3) production by entrustment, i.e. the way of production by which the foreign party entrusts the Chinese party to do films on behalf of it.
| | （三）委托摄制，即外方委托中方在中国境内代为摄制的摄制形式。
|
Article 6 Chinese-foreign cooperative production of films shall comply with the following principles:
| | 第六条 中外合作摄制电影片应当遵循以下原则：
|
(1) it shall abide by Chinese constitution, laws and regulations and relevant provisions;
| | （一）符合中国宪法、法律、法规及有关规定；
|
(2) it shall respect the custom, religions, beliefs and life habits of all Chinese nationalities;
| | （二）尊重中国各民族的风俗、宗教、信仰和生活习惯；
|
(3) it shall be beneficial to the promotion of the excellent traditional cultures of the Chinese Nation;
| | （三）有利于弘扬中华民族的优秀文化传统；
|
(4) it shall be beneficial to China's economic, cultural or ideological and ethical construction and social security;
| | （四）有利于中国的经济建设、文化建设、思想道德建设和社会安定；
|
(5) it shall be beneficial to the exchange of Chinese and foreign films; and
