The Regulation of the Hainan Free Trade Port on Tourism, as adopted at the 20th Session of the Standing Committee of the Seventh Hainan Provincial People's Congress on September 30, 2025, is hereby announced, with effect on December 1, 2025. 《海南自由贸易港旅游条例》已由海南省第七届人民代表大会常务委员会第二十次会议于2025年9月30日通过,现予公布,自2025年12月1日起施行。

Chapter I General Provisions 

第一章 总 则

Article 1 This Regulation is developed in accordance with the Hainan Free Trade Port Law of the People's Republic of China, in adherence to the fundamental principles of the Tourism Law of the People's Republic of China and other applicable laws and administrative regulations, and in light of the actual conditions of the Hainan Free Trade Port for the purposes of safeguarding the lawful rights and interests of tourists and tourism businesses, regulating the order of the tourism market, protecting and rationally utilizing tourism resources, promoting the high-quality development of the tourism industry, and accelerating the development of an international tourism consumption hub.   第一条 为了保障旅游者和旅游经营者的合法权益,规范旅游市场秩序,保护和合理利用旅游资源,推动旅游业高质量发展,加快国际旅游消费中心建设,根据《中华人民共和国海南自由贸易港法》,遵循《中华人民共和国旅游法》等法律、行政法规的基本原则,结合海南自由贸易港实际,制定本条例。
Article 2 This Regulation applies to the organization and conduct of sightseeing, vacations, recreation, and other forms of tourism activities within the Hainan Free Trade Port, as well as to business activities providing related services for tourism activities.   第二条 在海南自由贸易港内组织、开展游览、度假、休闲等形式的旅游活动以及为旅游活动提供相关服务的经营活动,适用本条例。
Article 3 In the development of the tourism industry, local authorities shall uphold the leadership of the Communist Party of China, cultivate and practice core socialist values, uphold fundamental principles while breaking new ground, improve quality and efficiency, and pursue integrated development, and coordinate the relationship between the government and the market roles, supply and demand, protection and development, domestic and international dimensions, and development and security, to achieve the unity of social, economic, and ecological benefits.   第三条 发展旅游业坚持中国共产党的领导,培育践行社会主义核心价值观,坚持守正创新、提质增效、融合发展,统筹政府与市场、供给与需求、保护与开发、国内与国际、发展与安全,实现社会效益、经济效益、生态效益相统一。
In the development of the tourism industry, local authorities shall take Hainan's tourism resources and ecological and environmental advantages, deepen the integration of tourism, culture, and sports, tap into explore distinctive local cultural resources, such as historical culture, revolutionary culture, maritime culture, and folk traditions, to enrich tourism formats and advance the development of all-for-one tourism throughout the province. 发展旅游业应当发挥海南旅游资源和生态环境优势,深化旅游、文化、体育融合,挖掘历史文化、革命文化、海洋文化、民俗文化等本地特色文化资源,丰富旅游业态,推进全域旅游发展。
The development of the tourism industry shall align with international standards and enhance the quality of tourism services and internationalization levels, to build an international tourism consumption center featuring diverse business formats, clustered brands, a comfortable environment, distinctive characteristics, and a sound ecological environment. 发展旅游业应当对接国际标准,提升旅游服务质量和国际化水平,打造业态丰富、品牌集聚、环境舒适、特色鲜明、生态良好的国际旅游消费中心。
Article 4 A people's government at or above the county level shall strengthen the organization and leadership of tourism work, establish and improve comprehensive tourism coordination mechanisms, and coordinate solutions to major issues concerning tourism development, tourism image promotion, tourism public services, and comprehensive supervision of the tourism market.   第四条 县级以上人民政府应当加强对旅游工作的组织和领导,建立健全旅游综合协调机制,协调解决旅游业发展、旅游形象推广、旅游公共服务和旅游市场综合监管的重大问题。
The tourism administration of a people's government at or above the county level is responsible for coordinating general planning, development, supervision, and administration of the tourism industry within its respective administrative region, and shall supervise and administer the tourism market in accordance with its respective duties. 县级以上人民政府旅游主管部门负责对本行政区域内旅游业规划、发展和监督管理进行统筹协调,依职责对旅游市场实施监督管理。
The other relevant departments of the people's government at or above the county level are responsible for the work related to the development, supervision and administration of the tourism industry according to their respective duties. 县级以上人民政府其他有关部门应当按照各自职责,负责旅游业发展和监督管理相关工作。
Township people's governments and subdistrict offices shall cooperate with relevant departments in effectively conducting tourism-related work within their respective jurisdictions. 乡镇人民政府、街道办事处应当配合有关部门做好本辖区内旅游业的相关工作。
Article 5 Tourism industry organizations shall conduct activities in accordance with the law, accept guidance and supervision from tourism administrations, develop industry operating rules and service standards in accordance with laws, regulations, and their charters, and strengthen industry self-regulation and public welfare services.   第五条 旅游行业组织应当依法开展活动,接受旅游主管部门的指导和监督,依照法律、法规和章程的规定制定行业经营规范和服务标准,加强行业自律和公益服务。
Tourism industry organizations shall protect the lawful rights and interests of their members in accordance with the law, reflect reasonable industry demands, and provide members with services such as market expansion, product promotion, exchange and cooperation, information sharing, and industry training to promote integrity in the tourism industry. 旅游行业组织应当依法维护会员的合法权益,反映行业合理诉求,为会员提供市场拓展、产品推介、交流合作、信息共享、行业培训等服务,推动旅游业诚信建设。
Article 6 People's governments at all levels and relevant departments shall strengthen publicity and education on civilized tourism, guide tourists in taking safe, healthy, civilized, and environmentally friendly travel, and encourage tourism businesses to develop and operate low-carbon, green, and environmentally friendly tourism products.   第六条 各级人民政府及有关部门应当加强文明旅游宣传教育,引导旅游者安全、健康、文明、环保旅游,鼓励旅游经营者开发和经营低碳、绿色、环保旅游产品。
Tourists, tourism businesses, tourism practitioners, and residents shall abide by the code of conduct for civilized tourism, protect tourism resources and the ecological environment, and develop a harmonious and friendly order of tourism. 旅游者、旅游经营者、旅游从业人员和当地居民应当遵守文明旅游公约,保护旅游资源和生态环境,构建和谐、友善的旅游秩序。
Social organizations and citizens' participation in tourism development are encouraged and supported to create a tourism environment built, governed, and shared collectively. Relevant social organizations and volunteers shall be supported in carrying out tourism public welfare activities. 鼓励和支持社会组织和公民参与旅游业发展,营造共建、共治、共享的旅游环境。支持有关社会组织和志愿者开展旅游公益活动。
Chapter II Tourism planning and resource protection 

第二章 旅游规划与资源保护

Article 7 The tourism administration of the provincial people's government shall organize the development of provincial tourism development plans and specialized tourism development plans for the province, which shall be implemented upon approval by the provincial people's government. Tourism development plans spanning cities, counties, or autonomous counties shall be developed by the tourism administration of the provincial people's government or jointly developed by the people's governments of relevant cities, counties, or autonomous counties through consultation, which shall be implemented upon approval by the provincial people's government.   第七条 省人民政府旅游主管部门组织编制全省旅游发展规划、全省专项旅游发展规划,报省人民政府批准后实施;跨市县的旅游发展规划由省人民政府旅游主管部门组织编制或者由相关市、县、自治县人民政府协商编制,报省人民政府批准后实施。
The tourism administration of the people's government of a city, county, or autonomous county shall organize the development of tourism development plans for their respective administrative regions, which shall be implemented upon approval by the people's governments at the same level. Tourism development plans of each city, county, and autonomous county shall be consistent with the provincial tourism development plan. 市、县、自治县人民政府旅游主管部门组织编制本行政区域旅游发展规划,报同级人民政府批准后实施。市、县、自治县旅游发展规划应当符合全省旅游发展规划。
Tourism development plans shall be consistent with national economic and social development plans and shall be connected with territorial spatial plans, ecological and environmental protection plans, and other plans for the protection and utilization of natural resources, cultural heritage, and other human resources. Planning results shall be integrated into territorial spatial plans and submitted to the territorial spatial basic information platform. 旅游发展规划应当符合国民经济和社会发展规划,并与国土空间规划、生态环境保护规划以及其他自然资源、文化遗产等人文资源的保护和利用规划相衔接。规划成果应当统筹纳入国土空间规划并汇交至国土空间基础信息平台。
No entity or individual may arbitrarily modify tourism development plans or specialized plans; where modification is truly necessary, it shall follow the original development procedures. 任何单位和个人不得擅自改变旅游发展规划和专项规划;确需修改的,应当按照原编制程序进行。
Article 8 People's governments at the county level shall give priority to securing land use for key tourism projects based on territorial spatial plans and in conjunction with tourism development plans.   第八条 县级人民政府应当根据国土空间规划,结合旅游发展规划,优先保障旅游重点项目用地。
When developing and adjusting plans related to tourism development, or conducting approval or confirmation of tourism projects, relevant departments shall solicit opinions from tourism administrations at the same level, coordinate the relationships among tourism projects, tourism facilities, service elements, land use, infrastructure, and public service facilities, and reasonably reserve space for tourism development. 有关部门在编制和调整与旅游业发展相关的规划以及审批或者核准旅游项目时,应当征求同级旅游主管部门意见,统筹协调旅游项目、旅游设施、服务要素与土地利用、基础设施、公共服务设施等之间的关系,合理预留旅游发展空间。
Article 9 Tourism administrations at or above the county level shall, in conjunction with relevant departments, conduct surveys and evaluations of tourism resources within their respective administrative regions, establish tourism resource databases, and implement classified management and dynamic updates of tourism resources.   第九条 县级以上人民政府旅游主管部门应当会同有关部门普查、评价本行政区域内的旅游资源,建设旅游资源数据库,对旅游资源实施分类管理和动态更新。
Article 10 In the development of tourism resources and the construction of tourism facilities, efforts shall be made to comply with ecological and environmental zoning control requirements, undergo environmental impact assessments in accordance with the law, and develop plans for the development, protection, governance, and restoration of tourism resources, to achieve sustainable development.   第十条 开发旅游资源和建设旅游设施,应当符合生态环境分区管控要求,依法进行环境影响评价,制定旅游资源开发保护和治理修复方案,实现可持续发展。
Tourism projects utilizing nature protected areas, forests, wetlands, and other natural resources, as well as construction projects within scenic spots and their designated outer protection zones, shall comply with territorial spatial plans, strengthen the protection of natural resources and biodiversity, and such projects shall not damage ecosystems, pollute the environment, impair landscapes, or obstruct sightseeing. 利用自然保护地以及森林、湿地等自然资源开发旅游项目,在风景名胜区及其规划确定的外围保护地带内建设项目,应当符合国土空间规划,加强对自然资源和生物多样性的保护,不得破坏生态、污染环境、毁损景观、妨碍游览。
Tourism projects utilizing ethnic cultural resources, historical and cultural districts, outstanding historical buildings, and other historical and cultural resources shall preserve their distinctive ethnic characteristics, traditional layouts, and historic appearances. 利用民族文化资源、历史文化风貌区、优秀历史建筑以及其他历史人文资源开发旅游项目,应当保持其特有的民族特色、传统格局和历史风貌。
Chapter III Tourism Development and Promotion 

第三章 旅游发展与促进

Article 11 A people's government at or above the county level shall develop and implement industrial policies conducive to the sustainable and sound development of tourism. They shall establish and improve institutional mechanisms for integrated tourism development, propel the integration of tourism with related industries, and promote the sound development of new, distinctive tourism formats.   第十一条 县级以上人民政府应当制定并组织实施有利于旅游业持续健康发展的产业政策,建立和完善旅游融合发展的体制机制,推动旅游业与相关产业融合发展,促进特色旅游新业态健康发展。
A people's government at or above the county level shall implement a premium tourism strategy, drive the transformation of tourism development from scale expansion to quality improvement, support the creation of a diversified tourism product system that meets market demand, support all industries in developing tourism products based on local distinctive resources, encourage innovation in business formats and services, and enrich and elevate tourism products with deeper cultural content. 县级以上人民政府应当实施旅游精品战略,推动旅游发展方式由规模扩张向质量提升转型升级,支持建设符合市场需求的、多样化的旅游产品体系,支持各行业依托当地特色资源开发旅游产品,鼓励业态创新、服务创新,丰富和提升旅游产品的文化内涵。
The development of new tourism attractions and consumption hubs is encouraged in light of cultural venues, urban complexes, leisure districts, distinctive small towns, industrial parks, and agricultural parks. 鼓励结合文化场所、城市综合体、休闲街区、特色小城镇、产业园区、农业园区建设新型旅游景区、消费集聚区。
Article 12 The development of marine tourism is encouraged. The quality of tourism products such as coastal resort vacations, offshore sightseeing, marine sports, and recreational fishing shall be enhanced, the supply of cruise, yacht, and tour boat tourism products shall be enriched, and support shall be provided for the construction of integrated marine tourism complexes integrating sightseeing, leisure, vacation, berthing facilities for cruises, yachts, and tour boats, and other functions. The pilot program of deep-sea sightseeing tourism shall be explored, and cruises and tour boats shall be supported in conducting tourism activities in designated deep-sea zones or anchorages.   第十二条 鼓励发展海洋旅游,提升滨海度假、出海观光、海上运动以及休闲渔业等旅游产品质量,丰富邮轮、游艇、游船旅游产品供给,支持建设集观光休闲度假和邮轮、游艇、游船停靠等功能于一体的海洋旅游综合体。探索深海观光旅游试点,支持邮轮、游船在深海指定海域或锚地开展旅游活动。
The development of sailing, surfing, sea fishing, and other maritime tourism projects is encouraged by increasing policy support for the use of sea areas and other matters, legally defining zones for maritime tourism activities, improving supporting infrastructure and service guarantee systems, and promoting standardized and sustainable growth of maritime tourism projects. 鼓励发展帆船、冲浪、海钓等涉海旅游项目,加大海域使用等政策支持,依法划定涉海旅游活动区域,完善涉海旅游配套基础设施和服务保障体系,促进涉海旅游项目规范发展。
Article 13 The development of forest tourism is encouraged by supporting the development of forest-based ecological tourism products, including forest sightseeing, outdoor adventure, nature education, wildlife viewing, and health and wellness retreats through the lawful use of ecological resources such as the Hainan Tropical Rainforest National Park, natural parks, wetlands, and mangrove forests.   第十三条 鼓励发展森林旅游,支持依法利用海南热带雨林国家公园、自然公园、湿地、红树林等生态资源,开发森林观光、户外探险、自然科普、野生动植物观赏、养生度假等森林生态旅游产品。
Article 14 The development of wellness tourism is encouraged. Hainan's climatic and ecological advantages shall be utilized, along with resources such as hot springs, cold springs, forests, and traditional Li and Miao medicine, to develop wellness tourism products including medical wellness, climate-based wellness, and spa-based wellness. High-end medical institutions and wellness organizations are encouraged to establish operations in Hainan, with a focus on specialized products such as health management, rehabilitation retreats, and medical aesthetics.   第十四条 鼓励发展康养旅游,利用海南气候优势、生态优势和温泉、冷泉、森林以及黎苗医药等资源,开发医疗康养、气候康养、温泉康养等康养旅游产品。鼓励高端医疗机构、康养机构落户海南,开发健康管理、康复疗养、医学美容等特色产品。
Article 15 The development of rural tourism is encouraged by supporting the reasonable utilization of tourism resources such as agricultural production, rural lifestyles, and the countryside's natural and cultural landscape, and developing rural tourism projects, including shared farms, distinctive homestays, leisure fruit and vegetable picking, and hands-on agricultural experiences to establish a distinctive Hainan rural vacation brand.   第十五条 鼓励发展乡村旅游,支持合理利用农业生产、农民生活、农村风貌等旅游资源,开发共享农庄、特色民宿、休闲采摘、农事体验等乡村旅游项目,形成具有海南特色的乡村度假旅游品牌。
Article 16 Deep integration between culture and tourism shall be encouraged and propelled. Local authorities shall thoroughly explore local cultural resources to develop cultural tourism projects and cultural creative products, innovate in performance products such as site-specific live performances, original stage works, and technology-performance fusion projects, give support for hosting large-scale concerts, music festivals, film festivals, and other similar performing arts events, and drive filming locations of popular movies and TV dramas as tourism hot spots.   第十六条 鼓励和推动文旅深度融合,深入挖掘本地特色文化资源开发文旅项目、文创产品,创新推出实景演出、原创剧目、科技与演艺融合项目等演艺产品,支持举办大型演唱会和音乐节、影视节等演艺活动,带动相关影视剧取景地成为热门旅游目的地。
Article 17 The development of festival and exhibition tourism is encouraged by introducing internationally renowned exhibition enterprises and branded events, hosting high-level large-scale exhibitions such as the China International Consumer Products Expo and the China (Hainan) International Tropical Agricultural Products Winter Fair, and supporting the creation of festival brands including the Hainan International Tourism Island Carnival, the Dongpo Culture Festival, and the Li and Miao “March 3 (San Yue San)” Festival, to create new tourism scenarios that integrate exhibitions, trade, experiences, and sightseeing.   第十七条 鼓励发展节庆会展旅游,引进国际知名会展企业和品牌展会,高水平举办中国国际消费品博览会、中国(海南)国际热带农产品冬季交易会等大型展会活动,支持打造海南国际旅游岛欢乐节、东坡文化节、黎族苗族“三月三”节等节庆品牌,打造集展览、贸易、体验与观光于一体的旅游新场景。
Article 18 The development of sports tourism is encouraged by actively introducing, cultivating, and holding sports events and tourism activities such as marathons, cycling races, golf tournaments, sailing competitions, and surfing events. Eligible sports training bases are encouraged to develop sports tourism products, including competitions, exhibitions, teaching, training, observation, experiential activities, and vacations.   第十八条 鼓励发展体育旅游,积极引进、培育和举办马拉松、自行车、高尔夫、帆船、冲浪等体育赛事和旅游活动。鼓励有条件的体育训练基地开展赛事展览、教学、训练、观摩、体验、度假等体育旅游产品。
Article 19 The development of low-altitude tourism is encouraged by supporting activities including low-altitude sightseeing, low-altitude flight performances and training, low-altitude competitions, and low-altitude sports as and developing low-altitude tourism projects such as helicopter rides, glider flights, hot air ballooning, skydiving, paragliding, powered paragliding, and parasailing, to enrich the forms and content of low-altitude tourism. The construction of low-altitude aircraft takeoff and landing sites shall be propelled in eligible tourist attractions and areas such as service stations along the Island-Ring Tourism Highway.   第十九条 鼓励发展低空旅游,支持开展低空观光、低空飞行表演与培训、低空赛事、低空运动等活动,开发直升机、滑翔机、热气球、跳伞、滑翔伞、动力伞、牵引伞等低空旅游项目,丰富低空旅游的形式和内容。推动在具备条件的旅游景区、环岛旅游公路驿站等区域建设低空飞行器起降场地。
Article 20 The development of educational tourism is encouraged by supporting the establishment of educational tourism bases by the use of resources such as aerospace technology, tropical agriculture, marine environments, forests, historical and cultural sites, and beautiful villages. Cooperation with scientific research institutes, universities, museums, and other entities is encouraged to develop educational courses and itineraries, and promote the deep integration of educational tourism with science and technology, culture, ecology, and other fields.   第二十条 鼓励发展研学旅游,支持利用航天科技、热带农业、海洋、森林、历史文化、美丽乡村等资源,建设研学旅游基地。鼓励与科研机构、高校、博物馆等合作开发研学课程和路线,推动研学旅游与科技、文化、生态等领域深度融合。
Article 21 The development of self-driving and recreational vehicle (RV) camping tourism is encouraged by utilizing scenic transportation resources such as the island ring tourist highway and tropical rainforest national park circuits, scientifically planning Campsites for RV tourism, and improving supporting facilities including traffic signage, scenic viewpoints, tourist service stations, parking lots (stations), water and electricity supply, sewage disposal systems, and garbage collection points, to optimize a comprehensive service and safety assurance system for self-driving and RV camping tourism.   第二十一条 鼓励发展自驾车房车露营旅游,利用环岛旅游公路、环热带雨林国家公园旅游公路等旅游交通资源开发精品线路,科学布局房车露营基地,完善交通标识、观景台、旅游驿站、停车场(站)、供水供电、排污、垃圾收集等配套设施,优化自驾车房车露营服务保障体系。
Article 22 The development of the night economy is encouraged by establishing cultural and tourism consumption clusters that come alive after dark, and cultivating and introducing diverse nighttime consumption formats, to enrich the supply of nighttime tourism, cultural, and sports products. Shopping malls, restaurants, and cultural venues shall be driven to extend their operating hours, and 24-hour bars and performance venues may be permitted within key tourist areas.   第二十二条 鼓励发展夜间经济,打造夜间文化和旅游消费集聚区,培育和引进各类夜间消费业态,丰富夜间旅文体产品供给。推动商场、餐饮、文化场所延长营业时间,允许在重点旅游区内设置通宵营业酒吧和娱乐演艺场所。
Article 23 The development of Hainan-specific tourism products, such as Li brocade, Miao embroidery, coconut shell crafts and shell art, huanghuali wood products, agarwood, coffee, tea, mountain camellia oil, and tropical fruits, shall be encouraged to establish the “Hainan Gifts” brand. The market supply of high-end consumer goods, including premium sports equipment, high-end cultural and artistic supplies, yachts, RVs, and aircraft, shall be enriched.   第二十三条 鼓励开发黎锦苗绣、椰壳贝艺、黄花梨、沉香、咖啡、茶叶、山柚油、热带瓜果等海南特色旅游商品,打造“海南礼物”品牌。丰富高端体育装备、高端文化艺术用品、游艇、房车、航空器等高端消费品市场供应。
Article 24 Local authorities are encouraged to develop Hainan's culinary culture brand by drawing from local dining traditions, and support both the inheritance and innovation of Hainan cuisine. The construction of tourism dining venues, such as food-themed streets and districts, shall be supported, gastronomic tourism routes shall be developed, and the hosting of festivals celebrating Hainan's local food culture shall be supported to enhance tourism catering service standards.   第二十四条 鼓励依托海南本地特色餐饮,打造海南美食文化品牌,支持海南美食传承和创新发展。支持建设美食街区等旅游餐饮场所,开发特色餐饮旅游线路,支持举办具有海南本地特色的美食文化节,提升旅游餐饮服务水平。
Article 25 A people's government at or above the county level shall allocate funds to support tourism development in light of actual circumstances, strengthen tourism infrastructure, public tourism services, and tourism image promotion.   第二十五条 县级以上人民政府根据实际情况安排资金支持旅游发展,加强旅游基础设施建设、旅游公共服务和旅游形象推广。
A tourism administration at or above the county level shall, in conjunction with relevant departments, establish tourism project databases, provide information consultation and related services, and guide social capital in increasing investment in the development of tourism resources. 县级以上人民政府旅游主管部门应当会同有关部门建立旅游项目库,提供信息咨询和相关服务,引导社会资本加大对旅游资源的开发力度。
