| Chapter I General Provisions | | 第一章 总 则 |
| Article 1 This Regulation is developed in accordance with relevant laws for the purposes of regulating ecological and environmental monitoring activities, enhancing the capacity and level of ecological and environmental monitoring, ensuring the quality of ecological and environmental monitoring data, and better playing the important role of ecological and environmental monitoring in supporting the construction of ecological civilization and a beautiful China and in serving high-quality economic and social development. | | 第一条 为了规范生态环境监测活动,提升生态环境监测能力和水平,保障生态环境监测数据质量,更好发挥生态环境监测在支撑生态文明和美丽中国建设、服务经济社会高质量发展中的重要作用,根据有关法律,制定本条例。 |
| Article 2 This Regulation shall apply to ecological and environmental monitoring and related activities carried out within the territory of the People's Republic of China and in other sea areas under its jurisdiction. If it is otherwise prescribed by any law or administrative regulation, such provisions shall apply. | | 第二条 在中华人民共和国领域及管辖的其他海域开展生态环境监测及其相关活动,适用本条例。法律、行政法规另有规定的,依照其规定。 |
| For the purposes of this Regulation, “ecological and environmental monitoring” includes ecological and environmental monitoring conducted or organized by the government and its relevant departments to perform their ecological and environmental protection and other duties (collectively, “public monitoring”), as well as self-monitoring conducted by enterprises, public institutions, and other producers and traders with statutory monitoring obligations (collectively, “enterprises and public institutions”) regarding the impact of their relevant activities on the ecology and environment. | | 本条例所称生态环境监测,包括政府及其有关部门为履行生态环境保护等职责开展或者组织开展的生态环境监测(以下统称公共监测),以及负有法定监测义务的企业事业单位和其他生产经营者(以下统称企事业单位)就其相关活动对生态环境的影响开展的自行监测。 |
| Article 3 The ecological and environmental monitoring work shall be in line with the guidelines, principles, policies, decisions, and arrangements of the Communist Party of China and the state, adhere to lawful, scientific, and honest monitoring, and a mechanism featuring government leadership, coordination of departments, performance of duties by enterprises and public institutions, social participation, and public supervision shall be established. | | 第三条 生态环境监测工作应当贯彻党和国家路线方针政策、决策部署,坚持依法监测、科学监测、诚信监测,构建政府主导、部门协同、企事业单位履责、社会参与、公众监督的机制。 |
| Article 4 The state shall establish and improve ecological and environmental monitoring rules and improve the specifications and standards for ecological and environmental monitoring. Ecological and environmental monitoring shall comply with the specifications and standards for ecological and environmental monitoring. | | 第四条 国家建立健全生态环境监测制度,完善生态环境监测规范和标准。开展生态环境监测应当遵守生态环境监测规范和标准。 |
| Article 5 The state shall strengthen the building of ecological and environmental monitoring capabilities, accelerate the establishment of a modern ecological and environmental monitoring system, and build an ecological and environmental monitoring network featuring coordinated land and marine development, the connection of terrestrial and space-based facilities, coordination among different levels, and information sharing, to comprehensively enhance automatic, digital, and intelligent ecological and environmental monitoring. | | 第五条 国家加强生态环境监测能力建设,加快建立现代化生态环境监测体系,构建陆海统筹、天地一体、上下协同、信息共享的生态环境监测网络,全面提升生态环境监测的自动化、数字化、智能化水平。 |
| Article 6 People's governments at and above the county level shall strengthen the organizational leadership and support for the ecological and environmental monitoring work, coordinate the resolution of major issues in the ecological and environmental monitoring work, and include the funds required for the ecological and environmental monitoring work in their respective budgets at the same level according to the principle of division of fiscal powers and expenditure responsibilities. | | 第六条 县级以上人民政府应当加强对生态环境监测工作的组织领导和支持保障,统筹协调解决生态环境监测工作中的重大问题,按照财政事权和支出责任划分原则将开展生态环境监测工作所需经费列入本级预算。 |
| Article 7 The department of ecology and environment of the State Council shall be responsible for the ecological and environmental monitoring work nationwide within the scope of its duties. Relevant departments of the State Council, including the department of natural resources, the department of housing and urban-rural development, the transport department, the water administrative department, and the departments of agriculture and rural affairs, meteorology, forestry and grassland, and disease prevention and control shall be responsible for the work related to ecological and environmental monitoring according to their respective duties. | | 第七条 国务院生态环境主管部门在其职责范围内负责全国的生态环境监测工作。国务院自然资源、住房和城乡建设、交通运输、水行政、农业农村、气象、林业草原、疾病预防控制等有关部门按照职责分工,负责生态环境监测有关工作。 |
| The department of ecology and environment of the local people's government shall be responsible for the ecological and environmental monitoring work within its administrative region within the scope of its duties. Relevant departments of local people's governments shall, according to their respective duties, be responsible for the work related to ecological and environmental monitoring within their respective administrative regions. | | 地方人民政府生态环境主管部门在其职责范围内负责本行政区域内生态环境监测工作。地方人民政府有关部门按照职责分工,负责本行政区域内生态环境监测有关工作。 |
| Article 8 Local people's governments at all levels shall establish and improve the responsibility system and working mechanism to prevent and punish the falsification of ecological and environmental monitoring data, and ensure that the ecological and environmental monitoring data are true, accurate, and comprehensive. | | 第八条 地方各级人民政府应当建立健全防范和惩治生态环境监测数据弄虚作假的责任体系和工作机制,确保生态环境监测数据真实、准确、全面。 |
| Article 9 The state encourages and supports the research, development, and application of advanced technologies and equipment for ecological and environmental monitoring, and shall increase efforts in the training of professionals in ecological and environmental monitoring, and promote international exchanges and cooperation in ecological and environmental monitoring. | | 第九条 国家鼓励、支持生态环境监测先进技术和装备的研究、开发和应用,加大生态环境监测专业人才培养力度,促进生态环境监测国际交流合作。 |
| The state shall establish and improve the rules for the collection and submission of ecological and environmental monitoring data and the mechanism for integrated sharing, and encourage and support the in-depth development and application of ecological and environmental monitoring data. | | 国家建立健全生态环境监测数据汇交制度和集成共享机制,鼓励、支持生态环境监测数据深度开发和应用。 |
| Chapter II Public Monitoring | | 第二章 公共监测 |
| Article 10 Local people's governments at all levels and relevant departments of people's governments at and above the county level shall diligently perform their duties of ecological and environmental monitoring, and in accordance with the provisions of laws and regulations and the needs of the ecological and environmental protection work, conduct or organize public monitoring such as ecological and environmental quality monitoring, ecological and environmental supervision monitoring, and emergency monitoring of ecological and environmental emergencies. | | 第十条 地方各级人民政府、县级以上人民政府有关部门应当认真履行生态环境监测职责,依照法律、法规规定以及生态环境保护工作需要,开展或者组织开展生态环境质量监测、生态环境监督监测、突发生态环境事件应急监测等公共监测。 |
| Article 11 The department of ecology and environment of the State Council shall, in conjunction with the relevant departments of the State Council, organize the national ecological and environmental monitoring network. The department of ecology and environment of the local people's government at or above the level of a districted city shall, in conjunction with relevant departments at the same level, organize the local ecological and environmental monitoring network within its administrative region. | | 第十一条 国务院生态环境主管部门会同国务院有关部门组织国家生态环境监测网络。设区的市级以上地方人民政府生态环境主管部门会同同级有关部门组织本行政区域内地方生态环境监测网络。 |
| The organization of the ecological and environmental monitoring network shall adhere to the principles of reasonable layout, complete functions, grading and categorization, and joint construction and sharing, and the interconnection between the national ecological and environmental monitoring network and local ecological and environmental monitoring networks shall be promoted. | | 组织生态环境监测网络,应当坚持布局合理、功能完善、分级分类、共建共享的原则,推进国家生态环境监测网络和地方生态环境监测网络互联互通。 |
| Article 12 The department of ecology and environment of the State Council shall, in conjunction with relevant departments of the State Council, uniformly plan the setup of national ecological and environmental quality monitoring stations. The departments of ecology and environment of people's governments of provinces, autonomous regions, and municipalities directly under the Central Government shall, in conjunction with relevant departments at the same level, uniformly plan the setup of local ecological and environmental quality monitoring stations within their administrative regions. The setup, adjustment, and revocation of local ecological and environmental quality monitoring stations shall be filed with the department of ecology and environment of the State Council or the relevant department of the State Council. | | 第十二条 国务院生态环境主管部门会同国务院有关部门统一规划国家生态环境质量监测站点设置。省、自治区、直辖市人民政府生态环境主管部门会同同级有关部门统一规划本行政区域内地方生态环境质量监测站点设置。设置、调整和撤销地方生态环境质量监测站点,应当报国务院生态环境主管部门或者国务院有关部门备案。 |
| The setup of ecological and environmental quality monitoring stations shall comply with the requirements of ecological and environmental monitoring standards and avoid repeated construction. | | 生态环境质量监测站点设置应当符合生态环境监测规范的要求,避免重复建设。 |
| Article 13 The department of ecology and environment and other relevant departments shall, according to their respective duties, strengthen the management of ecological and environmental quality monitoring stations to ensure their normal operation. | | 第十三条 生态环境主管部门、其他有关部门应当按照职责分工,加强对生态环境质量监测站点的管理,保证生态环境质量监测站点正常运行。 |
| Local people's governments at all levels shall, in accordance with the law, provide safeguards for the construction and operation of ecological and environmental quality monitoring stations, and take measures to strengthen the protection of such stations. | | 地方各级人民政府应当依法为生态环境质量监测站点的建设、运行提供保障,并采取措施加强对生态环境质量监测站点的保护。 |
| No entity or individual may encroach upon or damage ecological and environmental quality monitoring stations and their facilities and equipment, or interfere with the normal operation of ecological and environmental quality monitoring stations. | | 任何单位和个人不得侵占、损毁生态环境质量监测站点及其设施、设备,不得干扰生态环境质量监测站点正常运行。 |
| Article 14 The department of ecology and environment of the State Council shall, in conjunction with relevant departments of the State Council, organize the monitoring of ecological and environmental quality in key regions, river basins, and sea areas, and provide support for promoting coordinated regional development, scientifically implementing ecological protection compensation, and optimizing the industrial layout, among others. | | 第十四条 国务院生态环境主管部门会同国务院有关部门组织开展重点区域、流域、海域生态环境质量监测,为推动区域协调发展、科学实施生态保护补偿、优化产业布局等提供支撑。 |
| Local people's governments at and above the county level and their relevant departments may, based on actual needs, jointly organize ecological and environmental quality monitoring across administrative regions, and promote the sharing of monitoring information and mutual recognition of monitoring data. | | 县级以上地方人民政府及其有关部门可以根据实际需要,联合组织开展跨行政区域的生态环境质量监测,推动监测信息共享、监测数据互认。 |
| Article 15 The department of ecology and environment of the State Council and the departments of ecology and environment of people's governments of provinces, autonomous regions, and municipalities directly under the Central Government shall, in accordance with relevant provisions, uniformly release information on the monitoring of ecological and environmental quality and release bulletins on ecological and environmental conditions on a periodical basis. | | 第十五条 国务院生态环境主管部门和省、自治区、直辖市人民政府生态环境主管部门按照有关规定统一发布生态环境质量监测信息,定期发布生态环境状况公报。 |
| No entity or individual may illegally release the information on ecological and environmental quality monitoring. | | 任何单位和个人不得违法发布生态环境质量监测信息。 |
| Article 16 The department of ecology and environment and other relevant departments shall, according to their respective duties, strengthen the supervision and monitoring of various pollution sources (including mobile pollution sources), among others, in accordance with the law, and based on monitoring results, offer relevant recommendations to or raise requirements for relevant entities or individuals or make handling decisions. | | 第十六条 生态环境主管部门、其他有关部门应当按照职责分工,依法加强对各类污染源(包括移动污染源)等的监督监测,并根据监测结果向有关单位或者个人提出相关建议、要求或者作出处理决定。 |
| The use of remote sensing monitoring and other non-contact technical means in ecological and environmental supervision and monitoring is encouraged to enhance the monitoring efficiency and reduce the impact on normal production and operations, among others. | | 鼓励在生态环境监督监测中使用遥感监测等非接触式技术手段,提升监测效率,减少对正常生产经营活动等的影响。 |
| Article 17 The department of ecology and environment and other relevant departments shall strengthen the monitoring and early warning of ecological and environmental risks to enhance the capacity for the early warning of ecological and environmental risks. If any circumstance that may endanger ecological and environmental security or public health is discovered, the people's government at or above the county level shall issue early warning information in a timely manner in accordance with the law. | | 第十七条 生态环境主管部门、其他有关部门应当加强对生态环境风险的监测预警,提升生态环境风险预警能力;发现可能危害生态环境安全或者公众健康情形的,县级以上人民政府应当依法及时发布预警信息。 |
