| For the purposes of enhancing the patent transformation and application capabilities of innovation entities in Beijing Municipality, enhancing the patent transformation and application service levels of patent service institutions, promoting the industrialization of patents, and accelerating the cultivation of new quality productive forces, the Beijing Municipal Intellectual Property Office has developed the Measures for Promoting the Enhancement of Patent Transformation and Application Capabilities in Beijing, which are hereby issued with effect from the date of issuance. | | 为提升我市创新主体专利转化运用能力，提高专利服务机构专利转化运用服务水平，促进专利产业化，加快培育新质生产力，市知识产权局制定了《北京市专利转化运用能力提升促进办法》，现予印发，自公布之日起施行。 |

| Measures for Promoting the Enhancement of Patent Transformation and Application Capabilities in Beijing | | 北京市专利转化运用能力提升促进办法 |
| Chapter I General Provisions | | 第一章 总则 |
| Article 1 These Measures are developed in accordance with the spirit of the Notice by the General Office of the State Council of Issuance of the Special Action Plan for the Transformation and Application of Patents (2023-2025), the Outline of Beijing Municipality for Building a Model City for an Intellectual Property Powerhouse (2021-2035), the Intellectual Property Development Plan of Beijing Municipality for the “14th Five-Year Plan” Period, and other relevant policies for the purposes of enhancing the patent transformation and application capabilities of innovation entities in Beijing Municipality, improving the patent transformation and application service levels of patent service institutions, promoting the industrialization of patents, and accelerating the cultivation of new quality productive forces. | | 第一条 为提升我市创新主体专利转化运用能力，提高专利服务机构专利转化运用服务水平，促进专利产业化，加快培育新质生产力，按照《国务院办公厅关于印发〈专利转化运用专项行动方案（2023—2025年）〉的通知》《北京市知识产权强国示范城市建设纲要（2021—2035年）》《北京市“十四五"时期知识产权发展规划》等有关政策精神，制定本办法。 |
| Article 2 For the purposes of these Measures, “patent transformation and application” means the act of putting valid domestic patents and qualified valid foreign patents into actual production or services by means such as transfer and licensing. | | 第二条 本办法所称专利转化运用，是指通过转让、许可等方式将我国国内有效专利和符合条件的国外有效专利投入实际生产或服务等的行为。 |
| Article 3 The enhancement of patent transformation and application capabilities shall be based on enhancing capabilities and oriented towards comprehensive achievements, shall support the development of micro, small, and medium-sized enterprises through the transformation and application of patents, enhance the quality and efficiency of industries, and accelerate the transformation of patent technologies into real productive forces. | | 第三条 专利转化运用能力提升促进工作以能力建设为基础、综合成效为导向，通过专利转化运用支持中小微企业发展，赋能产业提质增效，加快推动专利技术向现实生产力转化。 |
| Chapter II Supports Recipients, Contents, and Standards | | 第二章 支持对象、内容和标准 |
| Article 4 The support recipients of these Measures are the institutions of higher learning, scientific research institutions, medical and health institutions, and service institutions that engage in business relating to patent transformation and application in this Municipality that can bear legal liability independently. | | 第四条 本办法的支持对象为本市可以独立承担法律责任的高等学校、科研机构、医疗卫生机构和开展专利转化运用相关业务的服务机构。 |
| Article 5 Institutions of higher learning, scientific research institutions, and medical and health institutions are supported in enhancing their comprehensive capabilities in the transformation and application of patents, and accelerating the industrialization of patents. | | 第五条 支持高等学校、科研机构、医疗卫生机构提升专利转化运用综合能力，加快实现专利产业化。 |
| Based on the implementation of the applicant's patent transformation and application strategies or plans, the constitution of patent transformation and application work institutions and teams, the construction and implementation of patent transformation and application management rules, the cultivation of basic patent resources and high-quality patents, the number of valid domestic patents that have been transferred or licensed, the amount of contracts for the transfer and licensing of valid domestic patents, or the transaction amount of registered technology contracts involving patents, as well as the transformation and application of patents, among others, support shall be provided in stages for those with outstanding achievements. The amount of support received by each entity shall not exceed 500,000 yuan each year. | | 根据申报单位专利转化运用策略或计划制定实施情况，专利转化运用工作机构设置和团队配置情况，专利转化运用管理制度建设和执行情况，专利资源基础和高质量专利培育情况，完成转让、许可的国内有效专利数量情况，转让、许可国内有效专利的合同金额情况或已登记的涉及专利的技术合同成交额情况以及专利转化运用工作情况等，成效显著的，分等次给予支持。每个单位每年度获得的支持金额不超过50万元。 |
| No support shall be given if the applicant has not made and implemented patent transformation and application work strategies or plans, has not established a department or personnel responsible for the management of patent transformation and application, has not developed sound or effectively implemented the management rules for patent transformation and application, such as assessment before the application for patents and distribution of intellectual property rights and interests, has not achieved significant results in patent transformation and application within the specified period, or fails to effectively implement the relevant work requirements for the transformation and application of patents set by the state and this Municipality. | | 申报单位未制定实施专利转化运用工作策略或计划，未设置管理专利转化运用工作的部门和负责专利转化运用工作的人员，专利申请前评估、知识产权权益分配等专利转化运用管理制度不健全、运行不顺畅，指定期限内专利转化运用成效不显著，落实国家和本市专利转化运用有关工作要求不力，有上述情况之一的，不予支持。 |
| Article 6 Patent service institutions are supported in enhancing their capabilities for providing patent transformation and application services, and enhancing the efficiency of patent industrialization. | | 第六条 支持专利服务机构提高专利转化运用服务能力，提升专利产业化能效。 |
| ．．．．．． | | 根据申报单位专利转化运用服务策略或计划制定实施情况，专利转化运用服务工作组织管理体系和业务机构设置情况，专利转化运用服务业务团队配置和人才培养情况，为转让、许可国内有效专利或为达成已登记的涉及专利的技术合同提供咨询、分析、评估、经纪、投融资、法律等实质性转化运用服务工作情况等，成效显著的，分等次给予支持。每个单位每年度获得的支持金额不超过50万元。 |
