| Article 2 This Law applies to all productive activities of fisheries such as aquaculture and fishing of aquatic animals and plants, protection of fishery resources, and other activities conducted in the inland waters, tidal flats, territorial waters, and exclusive economic zones of the People's Republic of China and other sea areas under the jurisdiction of the People's Republic of China. | | 第二条 在中华人民共和国内水、滩涂、领海、专属经济区以及中华人民共和国管辖的其他海域从事养殖和捕捞水生动物、水生植物等渔业生产活动,以及渔业资源保护等活动,适用本法。 |

| Marine fishery shall be under the supervision and administration of the departments of fisheries administration of the people's governments of provinces, autonomous regions, and municipalities directly under the Central Government contiguous to sea areas, except sea areas and fishing grounds with special fishery resources under the supervision and administration of the department of fisheries administration of the State Council as designated by the State Council. | | 海洋渔业,除国务院划定由国务院渔业渔政主管部门监督管理的海域和特定渔业资源渔场外,由毗邻海域的省、自治区、直辖市人民政府渔业渔政主管部门监督管理。 |

| Article 9 The people's governments at or above the county level shall, in accordance with the relevant provisions, effectively conduct the work such as supporting fishermen who shift to other productions or occupations in securing employment or starting their own businesses and providing social assistance, strengthen their vocational skill training, and safeguard their social security rights and interests in accordance with the law. | | 第九条 县级以上人民政府应当按照有关规定做好转产转业渔民的就业创业扶持、社会救助等工作,加强职业技能培训,依法维护其社会保障权益。 |

| Article 13 Foreign nationals and fishing vessels of foreign nationalities shall obtain the approval from the appropriate department of the State Council before entering the territorial waters of the People's Republic of China to engage in fishery production or survey of fishery resources, and comply with this Law and other relevant laws and regulations of the People's Republic of China, and if there are any applicable provisions in a treaty or agreement concluded or acceded to by the People's Republic of China, such treaty or agreement applies. | | 第十三条 外国人、外国籍渔业船舶进入中华人民共和国管辖水域,从事渔业生产或者渔业资源调查活动,应当经国务院有关主管部门批准,并遵守本法和中华人民共和国其他有关法律、法规的规定;中华人民共和国缔结或者参加的条约、协定有规定的,按照条约、协定办理。 |

| Article 15 The state encourages entities and individuals to develop aquaculture by utilizing the water areas and tidal flats suitable for aquaculture in a scientific and reasonable manner, and supports the aquaculture models that are resource-saving and environmentally friendly and ensure quality and safety. | | 第十五条 国家鼓励单位和个人科学合理利用适于养殖的水域、滩涂发展养殖业,支持资源节约、环境友好、质量安全的养殖模式。 |
| The state encourages the development of green and ecological stock enhancement and aquaculture, the development of deep-sea and offshore aquaculture, and the development of international aquaculture cooperation in oceans, rivers, lakes, reservoirs, and other water areas in accordance with the law. | | 国家鼓励在海洋、江河、湖泊、水库等水域依法开展绿色生态增殖养殖,发展深远海养殖,开展对外养殖合作。 |
| Article 16 The state conducts unified planning for the utilization of water areas and tidal flats, determines the water areas and tidal flats that may be used for aquaculture, and establishes a protection system of aquaculture water areas and tidal flats. | | 第十六条 国家对水域、滩涂利用进行统一规划,确定可以用于养殖业的水域、滩涂,建立养殖水域、滩涂保护制度。 |
| The local people's governments at or above the county level shall, as needed, organize the preparation and implementation of general plans for aquaculture water areas and tidal flats, and reasonably demarcate aquaculture areas and restricted areas for aquaculture. The planning for aquaculture water areas and tidal flats shall conform to the territorial space planning and comprehensive river basin planning, and be connected with the flood control planning, maritime traffic resource planning, and relevant planning for ecological and environmental protection, among others. | | 县级以上地方人民政府应当根据需要组织编制并实施养殖水域滩涂规划,合理划定养殖区、限养区。养殖水域滩涂规划应当符合国土空间规划、流域综合规划,与防洪规划、海上交通资源规划、生态环境保护有关规划等相衔接。 |

| Article 17 To use a water area or tidal flat owned by the state for aquaculture production, an entity or individual shall apply to the department of fisheries administration of the local people's government at or above the county level, and the people's government shall issue an aquaculture permit and determine a reasonable aquaculture period to permit the entity or individual to use the water area or tidal flat for aquaculture production. The specific measures for issuing aquaculture permits shall be prescribed by the State Council. | | 第十七条 单位和个人使用国家所有的水域、滩涂从事养殖生产的,应当向县级以上地方人民政府渔业渔政主管部门提出申请,由本级人民政府核发养殖证,合理确定养殖期限,许可其使用该水域、滩涂从事养殖生产。核发养殖证的具体办法由国务院规定。 |
| When issuing aquaculture permits, the local people's government at or above the county level shall prioritize the local fishery producers falling under any of the following circumstances in engaging in aquaculture production: | | 县级以上地方人民政府在核发养殖证时,应当优先安排具有下列情形之一的当地渔业生产者从事养殖生产: |
| (1) They primarily rely on the income from aquaculture production in water areas and tidal flats in living. | | (一)以水域、滩涂养殖生产为主要生活来源; |
| (2) They shift from production in the fishing industry to aquaculture production due to industrial restructuring of fisheries. | | (二)因渔业产业结构调整,由捕捞业转产从事养殖业; |
| (3) They need to move to other water areas or tidal flats for aquaculture production due to adjustments in the planning for aquaculture water areas and tidal flats. | | (三)因养殖水域滩涂规划调整,需要另行安排养殖水域、滩涂从事养殖生产; |
| (4) Other circumstances as prescribed by laws and regulations. | | (四)法律、法规规定的其他情形。 |
| Collectively owned water areas and tidal flats or state-owned water areas and tidal flats used by rural collective economic organizations may be contracted by individuals or entities in accordance with the relevant laws and regulations for aquaculture production. | | 集体所有或者国家所有由农村集体经济组织使用的水域、滩涂,可以由个人或者单位依照有关法律、法规的规定承包,从事养殖生产。 |
| Article 18 Where a dispute arises from the use of a water area or tidal flat by an entity or individual for aquaculture production, it shall be handled in accordance with the relevant provisions of laws, and any party to the dispute shall not impair aquaculture production before the dispute is resolved. | | 第十八条 单位和个人因使用水域、滩涂从事养殖生产发生争议的,依照有关法律规定处理;争议解决前,任何一方不得破坏养殖生产。 |
| Article 19 Where a local people's government at or above the county level modifies or withdraws an aquaculture permit for public interest in accordance with the law, causing any property loss to the relevant entity or individual, it shall provide fair and reasonable compensation. | | 第十九条 县级以上地方人民政府因公共利益需要依法变更或者撤回养殖证,给单位或者个人造成财产损失的,应当给予公平、合理的补偿。 |
| The expropriation of collectively-owned water areas and tidal flats shall be conducted in accordance with the provisions of the laws and administrative regulations on land administration. | | 征收集体所有的水域、滩涂的,依照有关土地管理的法律、行政法规的规定办理。 |
| Article 20 The local people's governments at or above the county level shall adopt measures to strengthen the protection of production bases of aquatic products and important water areas and tidal flats for aquaculture. | | 第二十条 县级以上地方人民政府应当采取措施,加强对水产品生产基地和重要养殖水域、滩涂的保护。 |
| Article 21 The departments of fisheries administration of the people's governments at or above the provincial level shall, as needed for the protection of aquatic germplasm resources, determine aquatic resource conservation farms, and strengthen the protection of original and improved aquaculture species. | | 第二十一条 省级以上人民政府渔业渔政主管部门应当根据水产种质资源保护的需要,确定水产种质资源保种场,加强水产原种和优良品种的保护。 |
| Article 22 The state encourages and supports the selection, cultivation, and promotion of improved aquaculture species. | | 第二十二条 国家鼓励和支持水产优良品种的选育、培育和推广。 |
| New aquaculture species shall be subject to the evaluation and approval of the National Committee for Aquaculture Species Evaluation, and be announced and promoted by the department of fisheries administration of the State Council. The measures for the evaluation and approval of new aquaculture species shall be developed by the department of fisheries administration of the State Council. | | 水产新品种应当经全国水产品种审定委员会审定,由国务院渔业渔政主管部门公告后推广。水产新品种审定办法由国务院渔业渔政主管部门制定。 |
| Whoever is to engage in the production of aquatic fry and fingerlings shall obtain a license for producing aquatic fry and fingerlings issued by the department of fisheries administration of the local people's government at or above the county level, except that the aquatic fry and fingerlings are bred and used by the fishery producer itself. | | 从事水产苗种生产活动,应当取得县级以上地方人民政府渔业渔政主管部门核发的水产苗种生产许可证。但是,渔业生产者自育、自用水产苗种的除外。 |
| Article 23 The aquatic fry and fingerlings sold or transported shall be quarantined in accordance with the provisions of the laws and administrative regulations on animal and plant quarantine. | | 第二十三条 销售或者运输水产苗种,应当依照有关动植物检疫的法律、行政法规的规定实施检疫。 |
| Article 24 The import and export of aquatic fry and fingerlings shall be subject to quarantine in accordance with the provisions of the laws and administrative regulations on the entry-exit quarantine of animals and plants to prevent diseases from spreading into or out of China and strengthen the prevention and control of ecological security risks. | | 第二十四条 水产苗种的进口、出口,应当依照有关进出境动植物检疫的法律、行政法规的规定实施检疫,防止病害传入境内和传出境外,加强生态安全风险防控。 |
| The introduction of genetically modified aquatic fry and fingerlings shall be subject to safety evaluation in accordance with the relevant provisions issued by the State Council. | | 引进转基因水产苗种,应当按照国务院有关规定进行安全性评价。 |
| Article 25 The departments of fisheries administration of the people's governments at or above the county level shall strengthen the technical guidance and disease prevention and control for aquaculture production. | | 第二十五条 县级以上人民政府渔业渔政主管部门应当加强对养殖生产的技术指导和病害防治工作。 |
| Article 26 Whoever engages in aquaculture activities such as production, transportation, or sale shall comply with the provisions of this Law and the laws and regulations on agricultural product quality and safety and food safety, and shall not use any baits, feeds, feed additives, medicines, or other toxic or hazardous substances prohibited by the state to ensure the quality and safety of aquatic products. | | 第二十六条 从事养殖生产、运输、销售等活动,应当遵守本法和有关农产品质量安全、食品安全的法律、法规的规定,不得使用国家禁止使用的饵料、饲料、饲料添加剂、药物或者其他有毒有害物质,保障水产品质量安全。 |
| Article 27 Whoever engages in aquaculture production shall protect the ecology and environment of water areas and tidal flats, determine aquaculture density and scale, among others, in a scientific manner, and cast baits and feeds and use medicines in a reasonable manner. The tail water discharged from aquaculture shall comply with the relevant pollutant discharge standards, and shall not cause environmental pollution or ecological damage to water areas and tidal flats. | | 第二十七条 从事养殖生产应当保护水域、滩涂生态环境,科学确定养殖密度、规模等,合理投饵、投饲、使用药物,养殖排放尾水应当符合有关污染物排放标准,不得造成水域、滩涂的环境污染、生态破坏。 |
| Article 28 Producers of aquatic fry and fingerlings and entities engaging in aquaculture shall, in accordance with the provisions issued by the department of fisheries administration of the State Council, honestly record the information on the introduction and cultivation of parents of aquatic fry and fingerlings, breeding and production of aquatic fry and fingerlings, disease prevention and control, medication, use of inputs, and product sales, among others, and preserve such information for two years at a minimum. | | 第二十八条 水产苗种生产者、从事水产养殖的单位应当按照国务院渔业渔政主管部门的规定,如实记录水产苗种亲本引种和培育、苗种繁育生产、疫病防控、用药、投入品使用、产品销售等信息,并至少保存二年。 |
| Article 29 The aquaculture of alien aquatic species and hybrids shall undergo recordation with the departments of fisheries administration of the local people's governments at or above the county level, emergency response plans shall be developed, and necessary protective measures shall be adopted, to prevent the ecological security risks caused by species escape. | | 第二十九条 养殖水生外来种、杂交种,应当向县级以上地方人民政府渔业渔政主管部门备案,制定应急处置预案,采取必要的防护措施,防止物种逃逸造成生态安全风险。 |

| Article 30 The state determines the total allowable catch of fishery resources under the principle that the catch is lower than the growth of fishery resources, and implements a fishing quota system. The department of fisheries administration of the State Council shall, in accordance with the law, organize the investigation and assessment of fishery resources, to provide a scientific basis for the implementation of the fishing quota system. | | 第三十条 国家根据捕捞量低于渔业资源增长量的原则,确定渔业资源的总可捕捞量,实行捕捞限额制度。国务院渔业渔政主管部门依法组织渔业资源的调查和评估,为实行捕捞限额制度提供科学依据。 |
| The total fishing quotas for inland seas, territorial seas, and exclusive economic zones of the People's Republic of China and other sea areas under the jurisdiction of the People's Republic of China shall be determined by the department of fisheries administration of the State Council, and upon approval by the State Council, be broken down and distributed hierarchically. The total fishing quotas for important rivers and lakes determined by the state shall be determined by the people's governments of relevant provinces, autonomous regions, or municipalities directly under the Central Government or be determined through consultation, be broken down and distributed hierarchically, and be reported to the department of fisheries administration of the State Council. | The departments of fisheries administration of the people's governments at or above the county level shall, within the scopes of control indicators of fishing vessels, nets, and other gear, approve the indicators of fishing vessels, nets, and other gear by grading and classification according to their prescribed powers. | | 县级以上人民政府渔业渔政主管部门在渔业船网工具控制指标范围内,按照规定的权限分级分类批准渔业船网工具指标。 |
| For fishing vessels subject to the indicators of fishing vessels, nets, and other gear, entities and individuals may manufacture or convert and apply for inspection and registration of them only after obtaining the indicators of fishing vessels, nets, and other gear. | | 对应当取得渔业船网工具指标的渔业船舶,单位和个人取得渔业船网工具指标后方可制造、改造并申请检验、登记。 |
