Announcement of the Supreme People's Court
The Interpretation I of the Supreme People's Court on Several Issues concerning the Application of the Insurance Law of the People's Republic of China, which was adopted at the 1473rd meeting of the Judicial Committee of the Supreme People's Court on September 14, 2009, is hereby promulgated, and shall come into force on October 1, 2009.

Interpretation I of the Supreme People's Court on Several Issues concerning the Application of the Insurance Law of the People's Republic of China
(No.12 [2009] of the Supreme People's Court)
To correctly try cases about disputes over insurance contracts and protect the legitimate rights and interests of the parties concerned, we hereby clarify the relevant issues concerning the application of the Insurance Law of the People's Republic of China, as amended at the 7th meeting of the Standing Committee of the 11th National People's Congress on February 28, 2009, by the people's courts as follows:

最高人民法院关于适用《中华人民共和国保险法》若干问题的解释（一）

为正确审理保险合同纠纷案件，切实维护当事人的合法权益，现就人民法院适用2009年2月28日第十一届全国人大常委会第七次会议修订的《中华人民共和国保险法》（以下简称保险法）的有关问题规定如下：

Article 1 For disputes over the insurance contracts established after the Insurance Law comes into force, the Insurance Law shall apply. For disputes over the insurance contracts established before the Insurance Law comes into force, unless it is otherwise provided in this Interpretation, the then effective legal provisions shall apply; in the absence of such legal provisions, the relevant provisions of the Insurance Law shall analogically apply.
To determine whether an insurance contract is established, the law at the time when the contract is concluded shall apply.
| | 第一条 保险法施行后成立的保险合同发生的纠纷，适用保险法的规定。保险法施行前成立的保险合同发生的纠纷，除本解释另有规定外，适用当时的法律规定；当时的法律没有规定的，参照适用保险法的有关规定。
认定保险合同是否成立，适用合同订立时的法律。

Article 2 Where an insurance contract established before the Insurance Law comes into force is determined as invalid if the then effective law is applicable but valid if the Insurance Law is applicable, the Insurance Law shall apply.
| | 第二条 对于保险法施行前成立的保险合同，适用当时的法律认定无效而适用保险法认定有效的，适用保险法的规定。

Article 3 For an insurance contract established beforethe Insurance Law comes into force, if the assignment of insurance object, insurance accident, settlement of claim, subrogation or any other act or incident occurs after the Insurance Law comes into force, the Insurance Law shall apply.
