The Ship Safety Inspection Rules of the People's Republic of China, which were adopted at the 10th executive meeting of this Ministry on October 29, 2009, are hereby promulgated and shall come into force as of March 1, 2010.

Chapter I General Provisions
| | 第一章 总则
|
Article 1 In order to regulate ship safety inspection activities, ensure the safety of lives and properties on water, and prevent ships from causing pollutions in water areas, these Rules are formulated according to the Maritime Traffic Safety Law of the People's Republic of China, the Marine Environmental Protection Law of the People's Republic of China and the Administrative Regulations of the People's Republic of China on the Safety of Inland River Transport and other laws and regulations and relevant international conventions which China has concluded or accessed to.
| | 第一条 为规范船舶安全检查活动，保障水上人命、财产安全，防止船舶造成水域污染，根据《中华人民共和国海上交通安全法》、《中华人民共和国海洋环境保护法》、《中华人民共和国内河交通安全管理条例》等法律、行政法规和我国缔结、加入的有关国际公约，制定本规则。

Article 2 These Rules shall be applicable to safety inspection activities conducted on Chinese ships and foreign ships which sail or operate or which are moored in Chinese ports (including marine mooring points), internal waters and territorial waters.
These Rules shall not be applicable to military ships, public security ships, fishery ships and sports ships.
The “ship safety inspection” mentioned herein shall mean that a maritime safety authority supervises and inspects the technical condition of the involved ship and the staffing and eligibility of the crew in accordance with the procedures prescribed herein to urge the ship, the crew, the owner, operator and manager of the ship and the ship inspecting, certifying and accrediting authorities to effectively execute the provisions in the laws, administrative regulations, rules and statutory technical specifications for ship inspection of China as well as relevant international conventions which China has concluded or accessed to.
| | 第二条 本规则适用于对中国籍船舶以及航行、停泊、作业于我国港口（包括海上系泊点）、内水和领海的外国籍船舶实施的安全检查活动。
本规则不适用于军事船舶、公安船舶、渔业船舶和体育运动船艇。
本规则所称“船舶安全检查”，是指海事管理机构按照本规则规定的程序，对船舶技术状况、船员配备及适任状况等进行监督检查，以督促船舶、船员、船舶所有人、经营人、管理人以及船舶检验机构、发证机构、认可组织等有效执行我国法律、行政法规、规章，船舶法定检验技术规范，以及我国缔结、加入的有关国际公约的规定。

Article 3 The ship safety inspection shall be conducted on the principle of legality, fairness, good faith and convenience.
| | 第三条 船舶安全检查遵循依法、公正、诚信、便民的原则。

Article 4 The Maritime Safety Administration of the People's Republic of China shall centrally govern the national ship safety inspection.
Other maritime safety authorities at other levels shall conduct the ship safety inspection according to their respective duties.
| | 第四条 中华人民共和国海事局统一管理全国的船舶安全检查工作。
其他各级海事管理机构按照职责开展船舶安全检查工作。

Chapter II Ship Safety Inspection and Disposition
| | 第二章 船舶安全检查和处理
|
Article 5 The ship safety inspection shall be divided into flag state control inspection and port state control inspection.
The flag state control inspection shall mean the ship safety inspection conducted on Chinese ships; the port state control inspection shall mean the ship safety inspection conducted on foreign ships which sail or operate or which are moored in Chinese ports (including marine mooring points), inland waters and territorial waters.
| | 第五条 船舶安全检查分为船旗国监督检查和港口国监督检查。
船旗国监督检查是指对中国籍船舶实施的船舶安全检查；港口国监督检查是指对航行、停泊、作业于我国港口（包括海上系泊点）、内水和领海的外国籍船舶实施的船舶安全检查。

Article 6 The ship safety inspection shall be conducted by at least two safety inspectors in a period during which the involved ship is moored or operates.
It's prohibited to conduct safety inspection on any ship which is sailing, unless otherwise provided in relevant laws or regulations.
| | 第六条 船舶安全检查，应当由至少两名安全检查人员于船舶停泊或者作业期间实施。
禁止对在航船舶进行安全检查，但法律、行政法规另有规定的除外。

Article 7 Ship safety inspectors shall have acquired the knowledge and skills which are necessary for ship safety inspection and shall have obtained ship safety inspection qualification certificates of required grades.
Maritime safety authorities shall have sufficient qualified ship safety inspectors and necessary equipment and data as needed for ship safety inspection.
| | 第七条 从事船舶安全检查的人员应当具备必要的船舶安全检查知识和技能，并取得相应等级的船舶安全检查资格证书。
海事管理机构应当配备足够、合格的船舶安全检查人员和必要的装备、资料等，以满足船舶安全检查工作的需要。

Article 8 The contents subject to ship safety inspection shall include:
| | 第八条 船舶安全检查的内容包括：

(1) Ship staffing;
| | （一）船舶配员；
|
(2) Relevant certificates, papers, documents and data for the ship and the crew;
| | （二）船舶和船员有关证书、文书、文件、资料；
|
(3) The structure, facilities and equipment of the ship;
| | （三）船舶结构、设施和设备；
|
(4) Load line requirements;
| | （四）载重线要求；
|
(5) Cargo stowage and handling equipment;
| | （五）货物积载及其装卸设备；
|
(6) Ship security-related aspects;
| | （六）船舶保安相关内容；
|
(7) The crew's abilities of operating the facilities and equipment involved in their job responsibilities and the competencies of the Chinese crew corresponding to their competency certificates;
| | （七）船员对与其岗位职责相关的设施、设备的实际操作能力以及中国籍船员所持适任证书所对应的适任能力；
|
(8) The crew's personal safety and health conditions;
| | （八）船员人身安全、卫生健康条件；
|
(9) The effectiveness of the operation of the ship safety and pollution prevention management system; and
| | （九）船舶安全与防污染管理体系的运行有效性；
|
(10) Other aspects subject to the ship safety inspection as required in relevant laws, administrative regulations, rules and international conventions.
| | （十）法律、行政法规、规章以及国际公约要求的其它检查内容。

Article 9 Maritime safety authorities shall select ships subject to the inspection in a reasonable manner, on the principle of fairness, reciprocity, convenience, openness and highlighted focus, according to the ship selection standard formulated by the Maritime Safety Administration of the People's Republic of China and the provisions of international conventions and regional cooperation organizations, and by taking into account the practical situation of the areas under their administration.
Chinese ships which have been inspected by a maritime safety authority of China or foreign ships which have been inspected by a maritime safety authority of a member of the Asia-Pacific Regional Memorandum of Understanding on Port State Control shall be subject to no inspection within 6 months after the date of the previous inspection, but the following ships shall be exceptional:
| | 第九条 海事管理机构应当根据中华人民共和国海事局制定的选船标准以及国际公约、区域性合作组织的规定，结合辖区实际情况，按照公平对等、便利公开、重点突出的原则，合理选择船舶实施安全检查。
经海事管理机构检查的中国籍船舶或者经《亚太地区港口国监督谅解备忘录》成员当局检查的外国籍船舶，自检查完毕之日起六个月内不再进行检查，但下列船舶除外：

(1) Passenger ships, oil tankers, liquefied gas carriers, and chemical tankers;
| | （一）客船、油船、液化气船、散装化学品船；
|
(2) Ships involved in any water traffic accident or pollution accident;
| | （二）发生水上交通事故或者污染事故的船舶；
|
(3) Ships which are reported as being below the required safety, pollution prevention, security and labor conditions;
| | （三）被举报低于安全、防污染、保安、劳工条件等要求的船舶；
|
(4) Ships which have new-found defects;
| | （四）新发现存在若干缺陷的船舶；
|
(5) Ships which have higher safety risk index as calculated by using the ship selection standard; and
| | （五）依选船标准核算具有较高安全风险指数的船舶；
|
(6) Other ships which are designated by the Maritime Safety Administration of the People's Republic of China for inspection.
| | （六）中华人民共和国海事局指定检查的船舶。

Article 10 To conduct the ship safety inspection, the inspectors shall, after boarding the ship to be inspected, present their valid certificates and express their purpose of coming to the ship. They shall conduct preliminary inspection first by perambulating the ship and checking the certificates and papers of the ship and of the crew.
