Notice of the Ministry of Finance and the Ministry of Land and Resources on Issuing the Interim Measures for the Administration of Equity Granted to the Central Geological Exploration Fund as Payment of the Purchase Price of Prospecting Right and Mining Right

The relevant ministries and commissions of and the relevant institutions directly under the State Council; the public finance departments (bureaus) and the land and resources departments (bureaus) of all provinces, autonomous regions, municipalities directly under the Central Government and cities under separate state planning; and the relevant centrally governed enterprises:
To regulate the administration of equity granted as payment of the purchase price of prospecting right and mining right, upon study, we formulated the Interim Measures for the Administration of Equity Granted to the Central Geological Exploration Fund as Payment of the Purchase Price of Prospecting Right and Mining Right, which are hereby issued to you for your compliance and implementation.

国务院有关部委、有关直属机构，各省、自治区、直辖市、计划单列市财政厅（局）、国土资源厅（局），有关中央管理企业：
为规范以折股方式缴纳探矿权、采矿权价款所形成股权的管理，我们研究制定了《中央地勘基金持有探矿权采矿权价款折股股权管理暂行办法》。现印发给你们，请遵照执行。

Article 1 To regulate the administration of equity granted as payment of the purchase price of prospecting right and mining right, these Measures are formulated pursuant to the Interim Measures for the Administration of the Central Geological Exploration Fund (Working Capital) (No. 342 [2006] of the Ministry of Finance), the Measures for the Administration of the Granting of Equity to Pay the Purchase Price of Prospecting Right and Mining Right (No.695 [2006] of the Ministry of Finance) and other relevant laws and regulations of the state.
| | 第一条 为规范以折股方式缴纳探矿权、采矿权价款所形成股权的管理，根据《中央地质勘查基金（周转金）管理暂行办法》（财建〔2006〕342号）、《以折股方式缴纳探矿权采矿权价款管理办法》（财建〔2006〕695号）和国家相关法律法规，制定本办法。

Article 2 These Measures apply to the administration of equity held by the Central Geological Exploration Fund.
| | 第二条 本办法适用于中央地勘基金持有股权的管理。

Article 3 The Central Geological Exploration Fund Management Center (hereinafter referred to as the “Center”), upon the entrustment of the Ministry of Finance and the Ministry of Land and Resources, is responsible for the daily management of the disposal of and income from the equity held by the Central Geological Exploration Fund.
| | 第三条 中央地质勘查基金管理中心（以下简称基金管理中心）受财政部、国土资源部委托，负责中央地勘基金持有股权的处置和收益等日常管理工作。

Article 4 The Center shall, after receiving a reply given by the Ministry of Finance and the Ministry of Land and Resources to a prospecting or mining right holder on approval of the granting of equity to pay the purchase price of prospecting or mining right, contact the prospecting or mining right holder, handle the relevant equity formalities, and obtain the required certificate.
．．．．．． | | 第四条 基金管理中心接到财政部、国土资源部批复探矿权、采矿权人以折股方式缴纳探矿权、采矿权价款的文件后，应与探矿权、采矿权人联系，办理股权相关手续，取得相关的证明文件。
