Regulations on the Administration of Audio and Video Recordings
(Promulgated by Order No. 341 of the State Council of the People's Republic of China on December 25, 2001, amended according to the Decision of the State Council on Amending the Regulations on the Administration of Audio and Video Recordings by the Order No.595 of the State Council on March 19, 2011)

Chapter I General Provisions
| | 第一章 总 则
|
Article 1 These Regulations are enacted with a view to strengthening the administration of audio and video recordings, promoting the healthy development and flourishing of the career of audio and video recordings, enriching the cultural life of the masses and promoting the construction of socialist material civilization and spiritual civilization.
| | 第一条 为了加强音像制品的管理，促进音像业的健康发展和繁荣，丰富人民群众的文化生活，促进社会主义物质文明和精神文明建设，制定本条例。
|
Article 2 These Regulations shall apply to such activities as publication, manufacture, reproduction, import, wholesale, retail, and lease, etc. of such audio and video recordings as audio tapes, video tapes, gramophone records, compact discs and laser discs, etc. on which contents are recorded.
Audio and video recordings used for radio and television broadcasts shall be subject to the laws and administrative regulations on radio and television.
| | 第二条 本条例适用于录有内容的录音带、录像带、唱片、激光唱盘和激光视盘等音像制品的出版、制作、复制、进口、批发、零售、出租等活动。
音像制品用于广播电视播放的，适用广播电视法律、行政法规。

Article 3 People engaged in the publication, manufacture, reproduction, import, wholesale, retail, and lease of audio and video recordings shall abide by the Constitution and the relevant laws and regulations, adhere to the orientation of serving the people and serving socialism and disseminate ideas, morals and scientific, technical and cultural knowledge beneficial to economic development and social progress.
The following contents are prohibited from being recorded in audio and video recordings:
| | 第三条 出版、制作、复制、进口、批发、零售、出租音像制品，应当遵守宪法和有关法律、法规，坚持为人民服务和为社会主义服务的方向，传播有益于经济发展和社会进步的思想、道德、科学技术和文化知识。
音像制品禁止载有下列内容：
|
(1) that which objects the basic principles determined in the Constitution;
| | （一）反对宪法确定的基本原则的；
|
(2) that which endangers the unity of the nation, sovereignty or territorial integrity;
| | （二）危害国家统一、主权和领土完整的；
|
(3) that which divulges secrets of the State, endangers national security or damages the honor or benefits of the State;
| | （三）泄露国家秘密、危害国家安全或者损害国家荣誉和利益的；
|
(4) that which incites the nationality hatred or discrimination, undermines the solidarity of the nationalities, or infringes upon nationality customs and habits;
| | （四）煽动民族仇恨、民族歧视，破坏民族团结，或者侵害民族风俗、习惯的；
|
(5) that which propagates evil cults or superstition;
| | （五）宣扬邪教、迷信的；
|
(6) that which disturbs the public order or destroys the public stability;
| | （六）扰乱社会秩序，破坏社会稳定的；
|
(7) that which propagates obscenity, gambling, violence or instigates crimes;
| | （七）宣扬淫秽、赌博、暴力或者教唆犯罪的；
|
(8) that which insults or slanders others, or infringes upon the lawful rights and interests of others;
| | （八）侮辱或者诽谤他人，侵害他人合法权益的；
|
(9) that which endangers public ethics or the fine folk cultural traditions;
| | （九）危害社会公德或者民族优秀文化传统的；
|
(10) other contents prohibited by laws, regulations or provisions of the State.
| | （十）有法律、行政法规和国家规定禁止的其他内容的。
|
Article 4 The competent publication department of the State Council shall be responsible for the supervision and administration of the publication, production, reproduction, import, wholesale, retail sale and lease of audio and video recordings across the country; and other relevant administrative departments of the State Council shall, according to the division of functions as prescribed by the State Council, be responsible for the supervision and administration of the relevant activities of operating audio and video recordings.”
The administrative department responsible for the administration of publication of the local people's government at or above the county level (hereinafter referred to as “the competent publication department”) shall be responsible for the supervision and administration of publication, production, reproduction, import, wholesale, retail sale and lease of audio and video recordings within its administrative region; and other relevant administrative departments of the local people's government at or above the county level shall be responsible for the supervision and administration of the relevant activities of operating audio and video recordings within their respective functions.
| | 第四条 国务院出版行政主管部门负责全国音像制品的出版、制作、复制、进口、批发、零售和出租的监督管理工作；国务院其他有关行政部门按照国务院规定的职责分工，负责有关的音像制品经营活动的监督管理工作。
县级以上地方人民政府负责出版管理的行政主管部门（以下简称出版行政主管部门）负责本行政区域内音像制品的出版、制作、复制、进口、批发、零售和出租的监督管理工作；县级以上地方人民政府其他有关行政部门在各自的职责范围内负责有关的音像制品经营活动的监督管理工作。

Article 5 The State shall apply a license system in respect of the publication, manufacture, reproduction, import, wholesale, retail and lease of audio and video recordings. No entity or individual shall, without permission, be engaged in the publication, manufacture, reproduction, import, wholesale, or retail, etc. of audio and video recordings.
The licenses or approval documents issued in accordance with these Regulations shall not be leased, lent, sold, or transferred in any other form.
| | 第五条 国家对出版、制作、复制、进口、批发、零售音像制品，实行许可制度；未经许可，任何单位和个人不得从事音像制品的出版、制作、复制、进口、批发、零售等活动。
依照本条例发放的许可证和批准文件，不得出租、出借、出售或者以其他任何形式转让。

Article 6 The competent publication department of the State Council shall be responsible for making development plans on the audio and video industry, and shall determine the total number, layout and structure of entities engaging in the publication of audio and video recordings and entities engaging in the reproduction of audio and video recordings across the country.
| | 第六条 国务院出版行政主管部门负责制定音像业的发展规划，确定全国音像出版单位、音像复制单位的总量、布局和结构。
|
Article 7 Neither the departments for supervision and administration of business activities in respect of audio and video recordings nor their functionaries shall, directly or in a disguised form, be engaged in the business activities in respect of audio and video recordings or participate in the business activities of the audio and video recording operating entities.
| | 第七条 音像制品经营活动的监督管理部门及其工作人员不得从事或者变相从事音像制品经营活动，并不得参与或者变相参与音像制品经营单位的经营活动。
|
Chapter II Publication
| | 第二章 出 版
|
Article 8 To establish an audio and video recording publishing entity, the applicant shall meet the following conditions:
| | 第八条 设立音像出版单位，应当具备下列条件：
|
(1) having the name and articles of association of the audio and video recording publishing entity;
| | （一）有音像出版单位的名称、章程；
|
(2) having the controlling entity and the competent organ which are cognized by the competent publication department under the State Council;
| | （二）有符合国务院出版行政主管部门认定的主办单位及其主管机关；
|
(3) having a well-defined scope of business;
| | （三）有确定的业务范围；
|
(4) having an organization adapted to the needs of its scope of business and a staff of professionals in the publication of audio and video recordings who meet the qualification requirements prescribed by the State;
| | （四）有适应业务范围需要的组织机构和符合国家规定的资格条件的音像出版专业人员；
|
(5) having the funds, equipment and work premises adapted to the needs of its scope of business;
| | （五）有适应业务范围需要的资金、设备和工作场所；
|
(6) other conditions provided for in laws and administrative regulations.
The approval on the establishment of an audio and video recording publishing entity shall not only be in accordance with the conditions enumerated in the preceding paragraph, but also conform to the programming on the total number, distribution and structure of the audio and video recording publishing entities.
| | （六）法律、行政法规规定的其他条件。
审批设立音像出版单位，除依照前款所列条件外，还应当符合音像出版单位总量、布局和结构的规划。
|
Article 9 The application for the establishment of an audio and video recording publishing entity shall be examined and consented to by the competent publication department under the people's government of the province, autonomous region or municipality directly under the Central Government where the applicant is located before it is submitted to the competent publication department under the State Council for examination and approval. The competent publication department under the State Council shall, within 60 days after accepting the application, make a decision on approving or not approving the application and shall notify the applicant. If the application is approved, a "License for Publishing Audio and Video Recordings" shall be issued to the applicant, who shall have itself registered and obtain the business license in accordance with the law in the administrative department for industry and commerce with the "License for Publishing Audio and Video Recordings”; if the application is not approved, the reason thereof shall be stated.
The application shall clearly state the following:
| | 第九条 申请设立音像出版单位，由所在地省、自治区、直辖市人民政府出版行政主管部门审核同意后，报国务院出版行政主管部门审批。国务院出版行政主管部门应当自受理申请之日起60日内作出批准或者不批准的决定，并通知申请人。批准的，发给《音像制品出版许可证》，由申请人持《音像制品出版许可证》到工商行政管理部门登记，依法领取营业执照；不批准的，应当说明理由。
申请书应当载明下列内容：

(1) the name and address of the audio and video recording publishing entity;
| | （一）音像出版单位的名称、地址；
|
(2) the name and address of the controlling entity of and the competent organ of the audio and video recording publishing entity;
| | （二）音像出版单位的主办单位及其主管机关的名称、地址；
|
(3) the name(s), address(es) and qualification certifying documents of the legal representative or principal responsible person(s) of the audio and video recording publishing entity;
| | （三）音像出版单位的法定代表人或者主要负责人的姓名、住址、资格证明文件；
|
(4) the sources and amount of funds of the audio and video recording publishing entity.
| | （四）音像出版单位的资金来源和数额。
|
Article 10 Where an audio and video recording publishing entity intends to change its name, controlling entity, competent organ or scope of business, or to merge another audio and video recording publishing entity, or to establish a new audio and video recording publishing entity due to merger or division, it shall go through the formalities of examination and approval in accordance with Article 9 of these Regulations, and shall go through the corresponding registration formalities in the administrative department for industry and commerce that handled the original registration.
Where an audio and video recording publishing entity intends to change its address, legal representative or principal responsible person(s), or to terminate its publishing business activities, it shall go through the modification registration or cancellation registration in the administrative department for industry and commerce that handled the original registration, and shall report to the competent publication department under the State Council for record.
| | 第十条 音像出版单位变更名称、主办单位或者其主管机关、业务范围，或者兼并其他音像出版单位，或者因合并、分立而设立新的音像出版单位的，应当依照本条例第九条的规定办理审批手续，并到原登记的工商行政管理部门办理相应的登记手续。
音像出版单位变更地址、法定代表人或者主要负责人，或者终止出版经营活动的，应当到原登记的工商行政管理部门办理变更登记或者注销登记，并向国务院出版行政主管部门备案。
|
Article 11 The annual publication plans of an audio and video recording publishing entity and the key titles selected by it in respect of national security and social stability, etc. shall be examined and verified by the competent publication department under the people's government of the province, autonomous region or municipality directly under the Central Government at its locality before they are submitted to the competent publication department under the State Council for record; the audio and video recordings on the key selected titles shall not be published until they are submitted for record before publication.
| | 第十一条 音像出版单位的年度出版计划和涉及国家安全、社会安定等方面的重大选题，应当经所在地省、自治区、直辖市人民政府出版行政主管部门审核后报国务院出版行政主管部门备案；重大选题音像制品未在出版前报备案的，不得出版。
|
Article 12 An audio and video recording publishing entity shall indicate in a prominent position on the audio and video recording it has published and its packaging such data as the name and address of the publishing entity, the publisher's code, time of publication and name of the copyright owner, etc. of the audio and video recording; for the publication of imported audio and video recordings, it shall indicate the approval number of import in addition.
An entity engaging in the publication of audio and video recordings shall submit free samples to the National Library of China, the Archives Library of Chinese Publications and the competent publication department of the State Council according to the relevant provisions of the state.
| | 第十二条 音像出版单位应当在其出版的音像制品及其包装的明显位置，标明出版单位的名称、地址和音像制品的版号、出版时间、著作权人等事项；出版进口的音像制品，还应当标明进口批准文号。
音像出版单位应当按照国家有关规定向国家图书馆、中国版本图书馆和国务院出版行政主管部门免费送交样本。

Article 13 An audio and video recording publishing entity may not lease, lend, sell or transfer in any other form its name to any entity or individual, nor shall it sell or transfer in any other form its publisher's code to any entity or individual.
| | 第十三条 音像出版单位不得向任何单位或者个人出租、出借、出售或者以其他任何形式转让本单位的名称，不得向任何单位或者个人出售或者以其他形式转让本单位的版号。
|
Article 14 No entity or individual may engage in the audio and video recording publishing activities by such means as purchasing, hiring, borrowing or using the name of an audio and video recording publishing entity without authorization or by purchasing or forging the publisher's code of the audio and video recording publishing entity.
None of the book publishing houses, newspaper offices, periodical offices or electronic publication publishing houses shall publish the audio and video recordings not in support of the publications published under its own imprint; however, each of them may, in accordance with the provisions of the competent publication department under the State Council, publish the audio and video recordings in support of the publications published under its own imprint, and may enjoy rights and shall undertake obligations with reference to the audio and video recording publishing entities.
| | 第十四条 任何单位和个人不得以购买、租用、借用、擅自使用音像出版单位的名称或者购买、伪造版号等形式从事音像制品出版活动。
图书出版社、报社、期刊社、电子出版物出版社，不得出版非配合本版出版物的音像制品；但是，可以按照国务院出版行政主管部门的规定，出版配合本版出版物的音像制品，并参照音像出版单位享有权利、承担义务。
|
Article 15 Audio and video recording publishing entities may cooperate with organizations or individuals from Hong Kong Special Administrative Region, Macao Special Administrative Region, Taiwan region and foreign countries to manufacture audio and video recordings. The specific measures shall be enacted by the competent publication department under the State Council.
| | 第十五条 音像出版单位可以与香港特别行政区、澳门特别行政区、台湾地区或者外国的组织、个人合作制作音像制品。具体办法由国务院出版行政主管部门制定。

Article 16 An audio and video recording publishing entity shall apply a system of editor's responsibility, which guarantees that the contents of the audio and video recordings conform to these Regulations.
| | 第十六条 音像出版单位实行编辑责任制度，保证音像制品的内容符合本条例的规定。
|
Article 17 The application by an entity other than the audio and video recording publishing entities for the establishment of an entity independently engaged in the audio and video recording manufacturing business (hereinafter referred to as audio and video recording manufacturing entity) shall be examined and approved by the competent publication department under the people's government of the province, autonomous region or municipality directly under the Central Government where the applicant is located. The competent publication department under the people's government of the province, autonomous region or municipality directly under the Central Government shall, within 60 days after accepting the application, make a decision on approving or not approving the application and shall notify the applicant. If the application is approved, a “License for Manufacturing Audio and Video Recordings” shall be issued to the applicant, who shall have itself registered and obtain the business license in accordance with the law in the administrative department for industry and commerce with the “License for Manufacturing Audio and Video Recordings”; if the application is not approved, the reason thereof shall be stated. The establishment of radio or television program producing or operating entities shall be in accordance with the relevant laws and administrative regulations.
The application shall clearly state the following:
| | 第十七条 音像出版单位以外的单位申请设立独立从事音像制品的制作业务的单位（以下简称音像制作单位），由所在地省、自治区、直辖市人民政府出版行政主管部门审批。省、自治区、直辖市人民政府出版行政主管部门应当自受理申请之日起60日内作出批准或者不批准的决定，并通知申请人。批准的，发给《音像制品制作许可证》，由申请人持《音像制品制作许可证》到工商行政管理部门登记，依法领取营业执照；不批准的，应当说明理由。广播、电视节目制作经营单位的设立，依照有关法律、行政法规的规定办理。
申请书应当载明下列内容：

(2) the name(s), address(es) and qualification certifying documents of the legal representative or principal responsible person(s) of the audio and video recording manufacturing entity;

(3) the sources and amount of funds of the audio and video recording manufacturing entity.
