Notice of the State Council on Implementation of the Administrative Compulsion Law of the People's Republic of China
(No. 25 [2011] of the State Council)
The people's governments of all provinces, autonomous regions and municipalities directly under the Central Government; all ministries and commissions of the State Council; and all institutions directly under the State Council:
The Administrative Compulsion Law of the People's Republic of China (hereinafter referred to as the “Administrative Compulsion Law”), as adopted at the 21st meeting of the Standing Committee of the 11th National People's Congress on June 30, 2011, will come into force on January 1, 2012. It is a major event in the building of a socialist country and a government ruled by law. For the effective implementation of the Administrative Compulsion Law, you are hereby notified of the relevant issues as follows:

各省、自治区、直辖市人民政府，国务院各部委、各直属机构：
《中华人民共和国行政强制法》（以下简称行政强制法）已于2011年6月30日经十一届全国人大常委会第二十一次会议通过，将于2012年1月1日起施行。这是建设社会主义法治国家和法治政府的一件大事。为做好行政强制法的实施工作，现就有关问题通知如下：

I. Fully apprehending the great significance of implementation of the Administrative Compulsion Law
The Administrative Compulsion Law is another important law for regulating joint acts of the government following the Administrative Punishment Law, Administrative Reconsideration Law and the Administrative License Law, and has a significant connection to administrative organs. The enactment and implementation of the Administrative Compulsion Law is of great significance in guaranteeing and overseeing administrative organs' strict performance of duties in accordance with law, improving administrative efficiency, maintaining the public interest and social order and protecting the legal rights and interests of citizens, legal persons and other organizations. Local people's governments at all levels and all departments of the State Council shall, from the perspective of profoundly carrying out the Scientific Outlook on Development, accelerating the building of a socialist country and a government ruled by law and building a socialist harmonious society, fully apprehend the great significance of implementation of the Administrative Compulsion Law, take effective measures, make specific arrangements, and solidly and effectively implement the Administrative Compulsion Law.
| | 一、充分认识行政强制法施行的重要意义
行政强制法是继行政处罚法、行政复议法、行政许可法等之后又一部规范政府共同行为的重要法律，与行政机关关系重大。它的公布施行，对保障和监督行政机关严格依法履行职责，提高行政管理效率，维护公共利益和社会秩序，保护公民、法人和其他组织的合法权益具有重要意义。地方各级人民政府、国务院各部门要从深入贯彻落实科学发展观，加快建设社会主义法治国家和法治政府，构建社会主义和谐社会的高度，充分认识行政强制法施行的重要意义，采取有效措施，作出具体部署，狠抓贯彻落实，扎实做好行政强制法的贯彻实施工作。

II. Strengthening study, publicity and training regarding the Administrative Compulsion Law
On the basis of a summary of Chinese practice on administrative compulsion over years, the Administrative Compulsion Law establishes the basic principles for administrative compulsion, and provides for such major systems as the types and methods of administrative compulsion, setting of administrative compulsion, procedures for the implementation of administrative compulsory measures, procedures for enforcement by administrative organs, application to a people's court for enforcement, and legal liability regarding implementation of administrative compulsion. These principles and systems have systematically standardized and comprehensively adjusted administrative compulsion. Staff of administrative organs at all levels, and leaders in particular, shall take the lead to diligently study the Administrative Compulsion Law, thoroughly apprehend the spirit of the Administrative Compulsion Law, fully understand the influence of the upcoming implementation of the Administrative Compulsion Law on government administration, and accurately grasp the new tasks and requirements put forward by the Administrative Compulsion Law on law enforcement by administrative organs. We shall organize training on Administrative Compulsion Law for administrative law enforcement personnel, so that they could fully understand the provisions of the Administrative Compulsion Law and implement them during their administrative law enforcement. We shall make full use of various means of publicity to extensively publicize Administrative Compulsion Law in multiple ways to the people, so that they could learn more about this Law, oversee the implementation of it and protect their own legal rights and interest in accordance with this Law.
| | 二、加强对行政强制法的学习、宣传和培训
在总结多年来我国行政强制实践的基础上，行政强制法确立了行政强制的基本原则，规定了行政强制的种类和方式、行政强制设定、行政强制措施实施程序、行政机关强制执行程序、申请人民法院强制执行、实施行政强制的法律责任等重要制度。这些原则和制度，对行政强制作了系统规范和全面调整。各级行政机关工作人员特别是领导干部，要带头认真学习行政强制法，深刻领会行政强制法的精神，充分认识施行行政强制法对政府管理将产生的影响，准确把握行政强制法对行政执法提出的新任务、新要求。要抓紧组织行政执法人员开展行政强制法培训，使他们全面掌握行政强制法的各项规定，并在行政执法中自觉贯彻执行。要充分利用各种宣传舆论工具，采取多种形式，向人民群众广泛宣传行政强制法，让人民群众了解这部法律，监督这部法律的实施，依照这部法律维护自身的合法权益。
