Basic Facts 基本案情
Du and seven other persons had a traffic accident on their way to work by taking a vehicle from Zhangjiagang City to the construction site involved in the case in Wuxi City after the vehicle had a flat tire on the expressway and got out of control and rolled, resulting in deaths and injuries of eight persons. It was identified by the traffic police department that all parties were not liable. With Zhangjiagang Free Trade Zone Runfa Labor Services Co., Ltd. (hereinafter referred to as “Runfa Company”) as the employer, Du and seven other persons separately filed applications for work-related injury identification with the Human Resources and Social Security Bureau of Wuxi City, Jiangsu Province (hereinafter referred to as the “Wuxi Human Resources and Social Security Bureau”). After examination, the Wuxi Human Resources and Social Security Bureau separately issued decisions on work-related injury identification and identified that the injuries of the eight persons were all work-related ones. Runfa Company refused to accept the decisions and filed an administrative lawsuit with the Primary People's Court of Liangxi District, Wuxi City, Jiangsu Province (hereinafter referred to as the “Liangxi Primary People's Court”). 杜某某等八人从张家港乘车至无锡涉案工地工作途中,在高速公路上因爆胎导致车辆失控翻滚,发生八人伤亡的交通事故。经交警部门认定,各方当事人均无责任。杜某某等八人以张家港保税区润发劳动服务有限公司(以下简称润发公司)为用人单位分别向江苏省无锡市人力资源和社会保障局(以下简称无锡人社局)申请工伤认定。无锡人社局经审核后分别作出工伤认定决定,认定八人均为工伤。润发公司不服,向江苏省无锡市梁溪区人民法院(以下简称梁溪区法院)提起行政诉讼。
