1. Basic Facts 一、基本案情
The place named [REDCTED] is a pilot area for the reform for entry of rural collective land for commercial construction purposes into the market. A piece of rural collective land for commercial construction purposes owned by the First Residents' Group in the local [REDACTED] Community was included in the scope of a pilot program for entry of rural land into the market in [REDACTED] City. The land eventually entered the market after being traded by transfer. The land was used for industrial purposes, with the transfer term of 40 years and at the price of 120,700 yuan per mu. (In particular, the compensation for land transfer, young crops, and fixtures on the land amounted to 66,000 yuan per mu and the land development costs and collective proceeds amounted to 54,700 yuan per mu.) It was confirmed that the area surveyed by aerial photographing was 136.82 mu and the proceeds for entry of rural land into the market amounted to 16.5142 million yuan. 某地是实施农村集体经营性建设用地入市改革试点地区。当地某社区第一居民组所有的一块农村集体经营性建设用地被纳入入市试点范围。该地块最终采取出让方式入市交易,土地用途为工业用地,出让年限为40年,入市价格为12.07万元/亩(其中,土地流转补偿费、青苗及地上附着物补偿费6.6万元/亩,土地开发成本费、集体收益部分5.47万元/亩),确认航拍测绘面积136.82亩,获得入市收益1651.42万元。
...... 2020年8月,某社区第一居民组对入市收益中的青苗及地上附着物补偿费、土地流转补偿费制定分配方案如下:可纳入分配的费用为青苗及地上附着物补偿费、土地流转补偿费(6.6万元/亩),以户为单位,按照每户现场实际测量的承包地面积进行计算;全体承包农户现场测量的承包地面积共计198.97亩,需分配的资金为1313.2万元。
 原告蒋某某及其父母均系某社区第一居民组集体经济组织成员,但在某社区第一居民组均没有承包地。原告蒋某某认为某社区第一居民组制定的收益分配方案严重侵害其合法权益,遂提起诉讼,请求法院判决撤销某社区第一居民组于2020年8月作出的收益分配方案。
