Decision of the First Session of the Ninth National People's Congress on the Plan for Restructuring the State Council

The First Session of the Ninth National People's Congress deliberated and approved the Plan for Restructuring the State Council.

Appendix 1: Plan for Restructuring the State Council
As required by the Fifteenth National Congress of the Communist Party of China and the Second Plenary Session of the Fifteenth Central Committee of the CPC, the aim in the current restructuring of the State Council is: to institute a system of government administration characterized by high efficiency, coordinated operation and standardized behavior, to perfect the public servant system of the State, to build up a specialized contingent of administrators of high quality and to gradually establish a system of government administration with Chinese characteristics that is suited to the system of a socialist market economy. The principles for the restructuring are: transforming the functions of the government and realizing the separation of government administration from enterprise management in line with the requirements of the socialist market economy; readjusting the organizational structure of the government and streamlining the administrative structure in accordance with the principles of simplified administration, unified action and high efficiency; readjusting the duties and limits of power of government departments and clearly dividing the duties and work among the departments in accordance with the principle that powers are commensurate with duties, so as to improve the operating mechanism of administration; and strengthening legislation for the administrative system in compliance with the requirements of ruling the country and conducting administrative affairs in accordance with law.
The specific plan for the current restructuring of the State Council is as follows:

按照中国共产党第十五次全国代表大会和十五届二中全会的要求，这次国务院机构改革的目标是：建立办事高效、运转协调、行为规范的政府行政管理体系，完善国家公务员制度，建设高素质的专业化行政管理队伍，逐步建立适应社会主义市场经济体制的有中国特色的政府行政管理体制。改革的原则是：按照社会主义市场经济的要求，转变政府职能，实现政企分开；按照精简、统一、效能的原则，调整政府组织结构，实行精兵简政；按照权责一致的原则，调整政府部门的职责权限，明确划分部门之间职责分工，完善行政运行机制；按照依法治国、依法行政的要求，加强行政体系的法制建设。

(for the purpose of strengthening leadership of the State Council over economic restructuring, the State Commission for Economic Restructuring is to be turned into a high-level think-tank of the State Council, with the Premier serving as the director and relevant ministers as members, which will not be included in the series of component departments of the State Council).
