The Export Control Law of the People's Republic of China, as adopted at the 22nd Session of the Standing Committee of the Thirteenth National People's Congress of the People's Republic of China on October 17, 2020, is hereby issued, and shall come into force on December 1, 2020. 《中華人民共和國出口管制法》已由中華人民共和國第十三屆全國人民代表大會常務委員會第二十二次會議于2020年10月17日通過,現予公布,自2020年12月1日起施行。

第一章 總  則

Article 1 This Law is enacted for the purposes of maintaining the national security and interest, performing nonproliferation and other international obligations, and strengthening and regulating export control.   第一條 為了維護國家安全和利益,履行防擴散等國際義務,加強和規範出口管制,制定本法。
Article 2 This Law shall apply to the state's control over the export of dual-use items, military products, nuclear, and other items such as goods, technologies, and services related to maintaining the national security and interest and performing nonproliferation and other international obligations (hereinafter collectively referred to as the “controlled items”).   第二條 國家對兩用物項、軍品、核以及其他與維護國家安全和利益、履行防擴散等國際義務相關的貨物、技術、服務等物項(以下統稱管制物項)的出口管制,適用本法。
For the purposes of the preceding paragraph, “controlled items” includes the technical materials and other data relating to the items. 前款所稱管制物項,包括物項相關的技術資料等數據。
For the purposes of this Law, “export control” means the prohibitive or restrictive measures imposed by the state on the outward movement of controlled items from the territory of the People's Republic of China and the provision of controlled items by a citizen, legal person, or unincorporated organization of the People's Republic of China to a foreign organization or individual. 本法所稱出口管制,是指國家對從中華人民共和國境內向境外轉移管制物項,以及中華人民共和國公民、法人和非法人組織向外國組織和個人提供管制物項,采取禁止或者限制性措施。
For the purposes of this Law, “dual-use items” means goods, technologies, and services that are for both civil and military purposes or contribute to an increase in military potential, especially those that may be applied to design, develop, produce, or use weapons of mass destruction and their means of delivery. 本法所稱兩用物項,是指既有民事用途,又有軍事用途或者有助于提升軍事潛力,特別是可以用于設計、開發、生產或者使用大規模殺傷性武器及其運載工具的貨物、技術和服務。
For the purposes of this Law, “military products” means the equipment, specialized production machinery, and other relevant goods, technologies, and services used for military purposes. 本法所稱軍品,是指用于軍事目的的裝備、專用生產設備以及其他相關貨物、技術和服務。
For the purposes of this Law, “nuclear” means nuclear materials, nuclear equipment, non-nuclear materials for reactor use, and relevant technologies and services. 本法所稱核,是指核材料、核設備、反應堆用非核材料以及相關技術和服務。
Article 3 The export control work shall adhere to the holistic approach to national security, maintenance of international peace, overall coordination of security and development, and enhancement of export control administration and services.   第三條 出口管制工作應當堅持總體國家安全觀,維護國際和平,統籌安全和發展,完善出口管制管理和服務。
Article 4 The state shall implement a unified export control system, and administer it by means such as formulating control lists, directories, or catalogues (hereinafter collectively referred to as the “control lists”) and implementing export licensure.   第四條 國家實行統一的出口管制制度,通過制定管制清單、名錄或者目錄(以下統稱管制清單)、實施出口許可等方式進行管理。
Article 5 The departments undertaking export control functions of the State Council and the Central Military Commission (hereinafter collectively referred to as the “export control administrative departments of the state”) shall be responsible for the export control work according to their division of duties. Other relevant departments of the State Council and the Central Military Commission shall be responsible for work related to export control according to their division of duties.   第五條 國務院、中央軍事委員會承擔出口管制職能的部門(以下統稱國家出口管制管理部門)按照職責分工負責出口管制工作。國務院、中央軍事委員會其他有關部門按照職責分工負責出口管制有關工作。
The state shall establish a coordination mechanism for the export control work to conduct the overall coordination of significant affairs concerning the export control work. The export control administrative departments of the state and the relevant departments of the State Council shall cooperate closely and strengthen information sharing. 國家建立出口管制工作協調機制,統籌協調出口管制工作重大事項。國家出口管制管理部門和國務院有關部門應當密切配合,加強信息共享。
The export control administrative departments of the state shall, in conjunction with the relevant departments, establish an expert advisory mechanism for export control to provide advice on the export control work. 國家出口管制管理部門會同有關部門建立出口管制專家咨詢機制,為出口管制工作提供咨詢意見。
The export control administrative departments of the state shall, in due time, issue the guides to export control in relevant industries, to direct export businesses to establish and improve their internal compliance rules for export control and operate in a well-regulated manner. 國家出口管制管理部門適時發布有關行業出口管制指南,引導出口經營者建立健全出口管制內部合規制度,規範經營。
The relevant departments of the people's governments of provinces, autonomous regions, and municipalities directly under the Central Government shall be responsible for work related to export control in accordance with the provisions of laws and administrative regulations. 省、自治區、直轄市人民政府有關部門依照法律、行政法規的規定負責出口管制有關工作。
Article 6 The state shall strengthen international cooperation in export control, and participate in the development of international rules on export control.   第六條 國家加強出口管制國際合作,參與出口管制有關國際規則的制定。
Article 7 Export businesses may establish and join the relevant chambers of commerce, associations, and other industry self-regulatory organizations in accordance with the law.   第七條 出口經營者可以依法成立和參加有關的商會、協會等行業自律組織。
The relevant chambers of commerce, associations, and other industry self-regulatory organizations shall comply with laws and administrative regulations, provide their members with services relating to export control in accordance with their bylaws, and play a coordinating and self-regulatory role. 有關商會、協會等行業自律組織應當遵守法律、行政法規,按照章程對其成員提供與出口管制有關的服務,發揮協調和自律作用。
Chapter II Control Policies, Control Lists and Control Measures 

第二章 管制政策、管制清單和管制措施

Section 1 General Rules 

第一節 一般規定

Article 8 The export control administrative departments of the state shall, in conjunction with the relevant departments, develop export control policies, of which major policies shall be reported to the State Council for approval or to both the State Council and the Central Military Commission for approval.   第八條 國家出口管制管理部門會同有關部門制定出口管制政策,其中重大政策應當報國務院批准,或者報國務院、中央軍事委員會批准。
The export control administrative departments of the state may assess the destination countries and regions to which controlled items are exported, determine their risk levels, and take corresponding control measures. 國家出口管制管理部門可以對管制物項出口目的國家和地區進行評估,確定風險等級,采取相應的管制措施。
Article 9 The export control administrative departments of the state shall, in accordance with the provisions of this Law and relevant laws and administrative regulations, as well as export control policies, formulate and adjust the export control lists for controlled items in conjunction with the relevant departments under the prescribed procedures, and publish the lists in a timely manner.   第九條 國家出口管制管理部門依據本法和有關法律、行政法規的規定,根據出口管制政策,按照規定程序會同有關部門制定、調整管制物項出口管制清單,並及時公布。
As needed for maintaining the national security and interest and performing nonproliferation and other international obligations, with the approval of the State Council or both the State Council and the Central Military Commission, the export control administrative departments of the state may exercise temporary control over the export of goods, technologies, and services outside of the control lists, and make an announcement. The term of temporary control shall not exceed two years. Assessment shall be conducted in a timely manner before the expiration of the term of temporary control, and a decision shall be made according to the assessment results to cancel temporary control, extend the term of temporary control, or include the items subjected to temporary control in the export control lists. 根據維護國家安全和利益、履行防擴散等國際義務的需要,經國務院批准,或者經國務院、中央軍事委員會批准,國家出口管制管理部門可以對出口管制清單以外的貨物、技術和服務實施臨時管制,並予以公告。臨時管制的實施期限不超過二年。臨時管制實施期限屆滿前應當及時進行評估,根據評估結果決定取消臨時管制、延長臨時管制或者將臨時管制物項列入出口管制清單。
Article 10 As needed for safeguarding the national security and interest and performing nonproliferation and other international obligations, with the approval of the State Council or both the State Council and the Central Military Commission, the export control administrative departments of the state may, in conjunction with the relevant departments, prohibit the export of relevant controlled items, or prohibit the export of relevant controlled items to specific destination countries and regions and specific organizations and individuals.   第十條 根據維護國家安全和利益、履行防擴散等國際義務的需要,經國務院批准,或者經國務院、中央軍事委員會批准,國家出口管制管理部門會同有關部門可以禁止相關管制物項的出口,或者禁止相關管制物項向特定目的國家和地區、特定組織和個人出口。
Article 11 An export business engaged in the export of controlled items shall comply with the provisions of this Law and relevant laws and administrative regulations; and if it is legally required to obtain a qualification for the export of relevant controlled items, the corresponding qualification shall be obtained.   第十一條 出口經營者從事管制物項出口,應當遵守本法和有關法律、行政法規的規定;依法需要取得相關管制物項出口經營資格的,應當取得相應的資格。
Article 12 The state shall implement a licensing system for the export of controlled items.   第十二條 國家對管制物項的出口實行許可制度。
To export any controlled items set forth in the control lists or items subjected to temporary control, export businesses shall apply for licensing to the export control administrative departments of the state. 出口管制清單所列管制物項或者臨時管制物項,出口經營者應當向國家出口管制管理部門申請許可。
To export any goods, technologies, or services other than the controlled items set forth in the export control lists and items subjected to temporary control, export businesses shall apply for licensing to the export control administrative departments of the state if they know or should have known, or are notified by the export control administrative departments of the state, that the relevant goods, technologies, or services may have the following risks: 出口管制清單所列管制物項以及臨時管制物項之外的貨物、技術和服務,出口經營者知道或者應當知道,或者得到國家出口管制管理部門通知,相關貨物、技術和服務可能存在以下風險的,應當向國家出口管制管理部門申請許可:
(1) Compromising the national security and interest. (一)危害國家安全和利益;
(2) Being applied to design, develop, produce, or use weapons of mass destruction and their means of delivery. (二)被用于設計、開發、生產或者使用大規模殺傷性武器及其運載工具;
(3) Being used for terrorist purposes. (三)被用于恐怖主義目的。
Where an export business is unable to determine whether the goods, technologies, or services to be exported are within the meaning of controlled items set forth in this Law, and consults the export control administrative departments of the state, the export control administrative departments of the state shall provide a reply in a timely manner. 出口經營者無法確定擬出口的貨物、技術和服務是否屬于本法規定的管制物項,向國家出口管制管理部門提出咨詢的,國家出口管制管理部門應當及時答複。
Article 13 The export control administrative departments of the state shall, by taking into comprehensive consideration the following factors, examine the application of an export business for the export of controlled items, and decide whether to grant or deny a license:   第十三條 國家出口管制管理部門綜合考慮下列因素,對出口經營者出口管制物項的申請進行審查,作出准予或者不予許可的決定:
(1) National security and interest. (一)國家安全和利益;
(2) International obligations and external commitments. (二)國際義務和對外承諾;
(3) The export type. (三)出口類型;
(4) The sensitivity of controlled items. (四)管制物項敏感程度;
(5) Export destination country or region. (五)出口目的國家或者地區;
(6) End user and end use. (六)最終用戶和最終用途;
(7) The relevant credit record of the export business. (七)出口經營者的相關信用記錄;
(8) Other factors set forth by laws and administrative regulations. (八)法律、行政法規規定的其他因素。
