Chapter I General Provisions
| | 第一章 总则
|
Article 1 These Provisions are formulated for the purpose of regulating Internet news information services, satisfying the demands of the general public for Internet news information, maintaining the national security and public benefits, protecting the lawful rights and interests of Internet news information service providers, and promoting the healthy and orderly development of Internet news information services.
| | 第一条 为了规范互联网新闻信息服务，满足公众对互联网新闻信息的需求，维护国家安全和公共利益，保护互联网新闻信息服务单位的合法权益，促进互联网新闻信息服务健康、有序发展，制定本规定。
|
Article 2 Those who provide Internet news information services inside the territory of the People's Republic of China shall abide by these Provisions.
News information as mentioned in these Provisions shall mean the news information on current affairs and politics, including the relevant reports and comments on politics, economy, military affairs, diplomacy, and other public affairs, as well as the relevant reports and comments on public emergencies.
Internet news information services as mentioned in these Provisions shall include the publishing of news information via Internet, provision of electronic bulletin services on current affairs and politics, and transmission of communicative information on current affairs and politics to the public.
| | 第二条 在中华人民共和国境内从事互联网新闻信息服务，应当遵守本规定。
本规定所称新闻信息，是指时政类新闻信息，包括有关政治、经济、军事、外交等社会公共事务的报道、评论，以及有关社会突发事件的报道、评论。
本规定所称互联网新闻信息服务，包括通过互联网登载新闻信息、提供时政类电子公告服务和向公众发送时政类通讯信息。

Article 3 Internet news information service providers shall, when engaging in Internet news information services, abide by the Constitution, laws and regulations, adhere to the direction of serving the people and socialism, adhere to the correct media guidance, and maintain the benefits of the state and the public.
The state encourages Internet news information service providers to disseminate healthy and civilized news information which is beneficial to improving the qualities of the Chinese nation, and to promoting economic development and social progress.
| | 第三条 互联网新闻信息服务单位从事互联网新闻信息服务，应当遵守宪法、法律和法规，坚持为人民服务、为社会主义服务的方向，坚持正确的舆论导向，维护国家利益和公共利益。
国家鼓励互联网新闻信息服务单位传播有益于提高民族素质、推动经济发展、促进社会进步的健康、文明的新闻信息。

Article 4 The Information Office of the State Council shall be in charge of the supervision and administration of the Internet news information services throughout China. The information office of the people's government of the provinces, autonomous regions, or municipalities directly under the Central Government shall take charge of the supervision and administration of the Internet news information services within their own jurisdiction.
| | 第四条 国务院新闻办公室主管全国的互联网新闻信息服务监督管理工作。省、自治区、直辖市人民政府新闻办公室负责本行政区域内的互联网新闻信息服务监督管理工作。

Chapter II Establishment of Internet News Information Service Providers
| | 第二章 互联网新闻信息服务单位的设立
|
Article 5 Internet news information service providers may be divided into the following three classes:
| | 第五条 互联网新闻信息服务单位分为以下三类：
|
(1) the Internet news information service providers established by news entities to publish the news that have not been published and broadcasted by the said entities, to provide electronic bulletin services of current affairs and politics, and to transmit communicative information of current affairs and politics to the public;
| | （一）新闻单位设立的登载超出本单位已刊登播发的新闻信息、提供时政类电子公告服务、向公众发送时政类通讯信息的互联网新闻信息服务单位；
|
(2) the Internet news information service providers established by non-news entities to reprint news information, to provide electronic bulletin services of current affairs and politics, and to transmit communicative information of current affairs and politics to the public;
| | （二）非新闻单位设立的转载新闻信息、提供时政类电子公告服务、向公众发送时政类通讯信息的互联网新闻信息服务单位；
|
(3) the Internet news information service providers established by news entities to publish the news information which has been published or broadcasted by the said news entities.
In accordance with the "Decision of the State Council on Establishing Administrative License for the Administrative Examination and Approval Items Really Necessary To Be Retained" and other relevant administrative regulations, the establishment of the Internet news information service providers prescribed in Items (1) and (2) of the preceding paragraph shall be subject to the examination and approval of the Information Office of the State Council.
The establishment of Internet news information service providers prescribed in Item (3) of Paragraph 1 of this Article shall be reported to the Information Office of the State Council or the information office of the people's government of the province, autonomous region, or municipality directly under the Central Government for archival filing.
| | （三）新闻单位设立的登载本单位已刊登播发的新闻信息的互联网新闻信息服务单位。
根据《国务院对确需保留的行政审批项目设定行政许可的决定》和有关行政法规，设立前款第（一）项、第（二）项规定的互联网新闻信息服务单位，应当经国务院新闻办公室审批。设立本条第一款第（三）项规定的互联网新闻信息服务单位，应当向国务院新闻办公室或者省、自治区、直辖市人民政府新闻办公室备案。

Article 6 Where a news entity and a non-news entity cooperate to establish an Internet news information service provider, and the stock rights owned by the news entity is no lower than 51%, it shall be deemed that the Internet news information service provider is established by the news entity; while if the stock rights owned by the news entity is lower than 51%, it shall be deemed that the Internet news information service provider is established by the non-news entity.
| | 第六条 新闻单位与非新闻单位合作设立互联网新闻信息服务单位，新闻单位拥有的股权不低于51%的，视为新闻单位设立互联网新闻信息服务单位；新闻单位拥有的股权低于51%的，视为非新闻单位设立互联网新闻信息服务单位。

Article 7 Whoever intends to establish an Internet news information service provider as prescribed in Item (1) of Paragraph 1 of Article 5 of these Provisions shall meet the following conditions:
| | 第七条 设立本规定第五条第一款第（一）项规定的互联网新闻信息服务单位，应当具备下列条件：
|
(1) It has sound rules on the management of Internet news information services;
| | （一）有健全的互联网新闻信息服务管理规章制度；
|
(2) It has 5 or more full-time news editors who have engaged in the news work of a news entity for 3 years or longer;
| | （二）有5名以上在新闻单位从事新闻工作3年以上的专职新闻编辑人员；
|
(3) It has the necessary place, necessary equipment and funds, and the sources of the funds shall be legal.
An institution which is allowed to apply for the establishment of an Internet news information service provider as prescribed in the preceding paragraph shall be a central news entity, a news entity directly under the people's government of a province, autonomous region, or municipality directly under the Central Government, or a news entity directly under the people's government of a city where the people's government of the province or autonomous region is located.
For the sake of examination and approval of the establishment of an Internet news information service provider as prescribed in Paragraph 1 of this Article, the applicant shall, in addition to meeting the conditions prescribed in this Article, meet the requirements of the Information Office of the State Council on the total quantity, structure and layout for the development of the Internet news information service industry.
| | （三）有必要的场所、设备和资金，资金来源应当合法。
可以申请设立前款规定的互联网新闻信息服务单位的机构，应当是中央新闻单位，省、自治区、直辖市直属新闻单位，以及省、自治区人民政府所在地的市直属新闻单位。
审批设立本条第一款规定的互联网新闻信息服务单位，除应当依照本条规定条件外，还应当符合国务院新闻办公室关于互联网新闻信息服务行业发展的总量、结构、布局的要求。

Article 8 Whoever intends to establish an Internet news information service provider as prescribed in Item (2) of Paragraph 1 of Article 5 of these Provisions shall, in addition to meeting the conditions prescribed in Items (1) and (3) of Paragraph 1 of Article 7 of these Provisions, have 10 or more full-time news editors; among whom there shall be no less than 5 news editors who have engaged in the news work of any news entity for 3 years or longer.
An organization that is allowed to apply for the establishment of an Internet news information service provider prescribed in the preceding paragraph shall be a legal person that has lawfully existed for 2 years or more to provide Internet information services, and having not been given any administrative penalty within the latest 2 years due to violation of any law, regulation or rule for the administration of Internet information services. If the applicant organization is an enterprise legal person, its registered capital shall not be lower than RMB 10 million Yuan.
For the sake of examination and approval of the establishment of an Internet news information service provider prescribed in Paragraph 1 of this Article, the applicant shall, in addition to meeting the conditions prescribed in this Article, meet the requirements of the Information Office of the State Council on the total quantity, structure and layout for the development of the Internet news information service industry.
| | 第八条 设立本规定第五条第一款第（二）项规定的互联网新闻信息服务单位，除应当具备本规定第七条第一款第（一）项、第（三）项规定条件外，还应当有10名以上专职新闻编辑人员；其中，在新闻单位从事新闻工作3年以上的新闻编辑人员不少于5名。
可以申请设立前款规定的互联网新闻信息服务单位的组织，应当是依法设立2年以上的从事互联网信息服务的法人，并在最近2年内没有因违反有关互联网信息服务管理的法律、法规、规章的规定受到行政处罚；申请组织为企业法人的，注册资本应当不低于1000万元人民币。
审批设立本条第一款规定的互联网新闻信息服务单位，除应当依照本条规定条件外，还应当符合国务院新闻办公室关于互联网新闻信息服务行业发展的总量、结构、布局的要求。

Article 9 No organization may establish a Chinese-foreign joint venture, Chinese-foreign cooperative or wholly foreign owned Internet news information service provider.
Where an Internet news information service provider cooperates with a Chinese-foreign joint venture, Chinese-foreign cooperative or wholly foreign owned enterprise either inside or outside the territory of China in the business involving Internet news information services, it shall report to the Information Office of the State Council for safety evaluation.
| | 第九条 任何组织不得设立中外合资经营、中外合作经营和外资经营的互联网新闻信息服务单位。
互联网新闻信息服务单位与境内外中外合资经营、中外合作经营和外资经营的企业进行涉及互联网新闻信息服务业务的合作，应当报经国务院新闻办公室进行安全评估。

Article 10 To apply for the establishment of an Internet news information service provider prescribed in Item (1) or Item (2) of Paragraph 1 of Article 5 of these Provisions, the applicant shall fill out a registration form of application, and submit the following materials:
| | 第十条 申请设立本规定第五条第一款第（一）项、第（二）项规定的互联网新闻信息服务单位，应当填写申请登记表，并提交下列材料：
|
(1) the rules on the management of Internet news information services;
| | （一）互联网新闻信息服务管理规章制度；
|
(2) the testimonial on the property right or use right of the place, and the testimonial on the sources and amount of funds;
