The Measures for the Administration of Donations for Disaster Relief, which were adopted in principle at the second executive meeting of the Ministry of Civil Affairs on October 26th, 2007, are hereby promulgated, and shall come into force as of the date of promulgation.

Chapter I General Provisions
| | 第一章 總則
|
Article 1 For the purpose of regulating the donating for disaster relief, strengthening the administration of the goods and money donated for disaster relief and protecting the legitimate rights and interests of the donators, the recipients of donations for disaster relief and the beneficiaries in disaster-stricken areas, these Measures are formulated in accordance with the Law of the People's Republic of China on Donations for Public Welfare and the National Emergency Plan for the Relief of Disasters.
| | 第一條 為了規範救災捐贈活動，加強救災捐贈款物的管理，保護捐贈人、救災捐贈受贈人和災區受益人的合法權益，根據《中華人民共和國公益事業捐贈法》和《國家自然災害救助應急預案》，制定本辦法。

Article 2 Where the subject of collecting donations for disaster relief conducts donation collecting activities and natural persons, legal persons or other organizations donate property to the recipients of donations for disaster relief in the time of natural disasters for the purpose of supporting disaster-stricken areas and helping victims of disaster, these Measures shall apply.
The “subject of collecting donations for disaster relief” as mentioned in these Measures refers to the public offering foundations with the purpose of disaster relief registered at the civil affairs departments of the people's governments at or above the county level.
| | 第二條 在發生自然災害時，救災募捐主體開展募捐活動，以及自然人、法人或者其他組織向救災捐贈受贈人捐贈財產，用于支援災區、幫助災民的，適用本辦法。
本辦法所稱救災募捐主體是指在縣級以上人民政府民政部門登記的具有救災宗旨的公募基金會。

Article 3 The term “recipients of donations for disaster relief” as mentioned in these Measures includes:
| | 第三條 本辦法所稱救災捐贈受贈人包括：
|
1. the civil affairs departments of the people's governments at or above the county level and the agencies entrusted by them to accept social donations;
| | （一）縣級以上人民政府民政部門及其委托的社會捐助接收機構；
|
2. the public welfare non-governmental organizations with the tenet of disaster relief as determined by the civil affairs departments of the people's governments at or above the county level; and
| | （二）經縣級以上人民政府民政部門認定的具有救災宗旨的公益性民間組織；
|
3. other organizations as specified by laws and administrative regulations.
| | （三）法律、行政法規規定的其他組織。
|
Article 4 Donations for disaster relief shall be made on free will and be gratuitous. It is prohibited to apportion donation tasks coercively or in any disguised form. No entity or individual may seek for profits in the name of donation.
| | 第四條 救災捐贈應當是自願和無償的，禁止強行攤派或者變相攤派，不得以捐贈為名從事營利活動。

Article 5 The scope of use of the goods and money donated for disaster relief is as follows:
| | 第五條 救災捐贈款物的使用範圍：
|
1. the settlement of the difficulties of victims of disaster in clothing, food, dwelling and medical care;
| | （一）解決災民衣、食、住、醫等生活困難；
|
2. the emergency rescue, transfer and resettlement of victims of disaster;
| | （二）緊急搶救、轉移和安置災民；
|
3. the restoration and rebuilding of the collapsed houses of victims of disaster;
| | （三）災民倒塌房屋的恢複重建；
|
4. the uses designated by the donators and directly related to disaster relief; and
| | （四）捐贈人指定的與救災直接相關的用途；
|
5. other necessary expenses directly used for disaster relief upon the approval of the people's government at the same level.
| | （五）經同級人民政府批准的其他直接用于救災方面的必要開支。

Article 6 The civil affairs department of the State Council shall take charge of the disaster relief donation work of the whole nation.
The civil affairs departments of the local people's governments at or above the county level shall take charge of the disaster relief donation work of their respective administrative region.
| | 第六條 國務院民政部門負責管理全國救災捐贈工作。
縣級以上地方人民政府民政部門負責管理本行政區域內的救災捐贈工作。

Article 7 The civil affairs departments of the people's governments at or above the county level may honor the natural persons, legal persons or other organizations that have made outstanding contributions in the disaster relief donation work. Before honoring a donator in public, it is necessary to ask for the donator's opinion.
| | 第七條 對于在救災捐贈中有突出貢獻的自然人、法人或者其他組織，縣級以上人民政府民政部門可以予以表彰。對捐贈人進行公開表彰，應當事先征求捐贈人的意見。

Chapter II Organization of Donation Activities
| | 第二章 組織捐贈與募捐
|
Article 8 In light of the actual situation of a disaster, the civil affairs department of the State Council may organize the donating for disaster relief which covers different provinces (autonomous regions or municipalities directly under the Central Government) or which covers the whole country, while the implementation thereof shall be organized by the civil affairs department of the local people's government at or above the county level.
The civil affairs department of the local people's government at or above the county level shall, upon the approval of the people's government at the same level, organize the donation activity for disaster relief within its administrative region only.
For the donating for disaster relief conducted by the civil affairs department of the local people's government at or above the county level, the implementation thereof shall be organized by each sector, department or entity within itself in the administrative region under the same-level government.
| | 第八條 國務院民政部門可以根據災情組織開展跨省（自治區、直轄市）或者全國性救災捐贈活動，縣級以上地方人民政府民政部門按照部署組織實施。
經同級人民政府批准，縣級以上地方人民政府民政部門組織開展本行政區域內的救災捐贈活動，但不得跨區域開展。
在縣級以上地方人民政府民政部門開展的救災捐贈活動中，同級人民政府轄區內的各系統、各部門、各單位在本系統、本部門、本單位內組織實施。

Article 9 The entity holding a charity performance, charity contest, charity sale or other large-scale donation activity shall file the relevant contents with the civil affairs department of the local people's government for archival purpose within 30 days after the activity is over. The contents filed for archival purpose include the name of the entity, the time, place, contents and form of the activity and the uses of the donated money and goods, etc.
| | 第九條 開展義演、義賽、義賣等大型救災捐贈和募捐活動，舉辦單位應當在活動結束後30日內，報當地人民政府民政部門備案。備案內容包括：舉辦單位、活動時間、地點、內容、方式及款物用途等。

Article 10 The public offering foundations with the tenet of disaster relief may conduct donation collecting activities for disaster relief according to law, but the funds raised in the time of natural disasters may not be used for increasing the original funds.
| | 第十條 具有救災宗旨的公募基金會，可以依法開展救災募捐活動，但在發生自然災害時所募集的資金不得用于增加原始基金。
|
Chapter III Acceptance of Donations
| | 第三章 接受捐贈
|
Article 11 Where the civil affairs department of the people's government at or above the county level is to accept any donated money or goods for disaster relief, it may, when its work so requires, designate an institution accepting social donations or a public welfare non-governmental organization with the tenet of disaster relief to organize the implementation thereof.
．．．．．． | | 第十一條 縣級以上人民政府民政部門接受救災捐贈款物，根據工作需要可以指定社會捐助接收機構、具有救災宗旨的公益性民間組織組織實施。
鄉（鎮）人民政府、城市街道辦事處受縣（縣級市、市轄區）人民政府委托，可以組織代收本行政區域內村民、居民及駐在單位的救災捐贈款物。代收的捐贈款物應當及時轉交救災捐贈受贈人。
