The people's governments of all provinces, autonomous regions and municipalities directly under the Central Government, all ministries and commissions of the State Council and all institutions directly under the State Council:
The Provisions on the Main Functions, Internal Bodies and Staffing of the State Oceanic Administration have been approved by the State Council, and are hereby issued.

Provisions on the Main Functions, Internal Bodies and Staffing of the State Oceanic Administration
According to the Notice of the State Council on the Setup of National Bureaus Administered by Ministries and Commissions (No. 12 [2008] of the State Council), the State Oceanic Administration (at the deputy ministerial level) is established under the Ministry of Land and Resources.

《国家海洋局主要职责内设机构和人员编制规定》已经国务院批准，现予印发。

国家海洋局主要职责内设机构和人员编制规定
根据《国务院关于部委管理的国家局设置的通知》(国发[2008]12号)，设立国家海洋局(副部级)，为国土资源部管理的国家局。

I. Adjustment of Duties
| | 一、职责调整
|
1. Canceling the matters subject to its administrative examination and approval which have already been cancelled by the State Council.
| | (一)取消已由国务院公布取消的行政审批事项。
|
2. Authorizing the qualification administration of marine engineering prospecting and design entities and individuals to public institutions.
| | (二)将海洋工程勘察设计单位资质和个人执业资格管理工作交给事业单位承担。
|
3. Spending more efforts on researching marine strategies and comprehensively coordinating maritime affairs.
| | (三)加强海洋战略研究和对海洋事务的综合协调。
|
II. Major Duties
| | 二、主要职责
|
1. Undertaking the duty of comprehensively coordinating the marine monitoring, scientific research, waste dumping, development and utilization work; drafting the strategies, guidelines and policies for the development of the marine undertaking; making and implementing major marine functional zoning plans, marine administration digitalization plans, marine scientific and technological development plans and strategies for invigorating the marine undertaking with science and technology; and working out and implementing the mid- and long-term plans for the development of marine undertakings and the marine economic development plans together with the relevant departments.
| | (一)承担综合协调海洋监测、科研、倾废、开发利用的责任。组织拟订国家海洋事业发展战略和方针政策，组织拟订并监督实施海洋主体功能区规划、海洋信息化规划、海洋科技规划和科技兴海战略，会同有关部门拟订并监督实施海洋事业发展中长期规划、海洋经济发展规划。

2. Setting up and improving the marine administration systems; drafting laws and regulations governing coastal zones, islands and other sea areas under the jurisdiction of this Administration; working out and implementing domestic support policies and systems in fields like the polar region, high seas and international sea bed, etc., together with the relevant departments; and handling the issues relating to the conclusion of international maritime treaties and sea-related legal issues.
| | (二)负责建立和完善海洋管理有关制度，起草海岸带、海岛和管辖海域的法律法规草案，会同有关部门拟订并监督实施极地、公海和国际海底等相关区域的国内配套政策和制度，处理国际涉海条约、法律方面的事务。

3. Undertaking the duty of monitoring, evaluating and disclosing information about marine economic operations; proposing suggestions on optimizing the marine economic structure and adjusting the industrial structure together with the relevant departments; taking charge of the statistical and accounting work in the marine economic and social development; and organizing the work of saving energy, reducing the discharge of carbon dioxide and responding to climatic changes in the marine field.
| | (三)承担海洋经济运行监测、评估及信息发布的责任。会同有关部门提出优化海洋经济结构、调整产业布局的建议，组织实施海洋经济和社会发展的统计、核算工作，组织开展海洋领域节能减排和应对气候变化工作。

4. Undertaking the duty of regulating the use of sea areas under the jurisdiction of this Administration; supervising and administering the use of sea areas; making national marine functional zonings and supervising their implementation; administering the right to use sea areas; practicing the system of requited use of sea areas; organizing the study and evaluation of sea areas and taking charge of the survey and administration work concerned in delimiting sea areas; and examining and approving and administering the laying of submarine cable pipes.
| | (四)承担规范管辖海域使用秩序的责任。依法进行海域使用的监督管理，依法组织编制并监督实施全国海洋功能区划，组织实施海域使用权属管理，按规定实施海域有偿使用制度，组织实施海域使用论证、评估和海域界线的勘定和管理，审批和管理海底电缆管道铺设。

5. Undertaking the duty of protecting the ecological environment of islands and ensuring the legal use of uninhabited islands; formulating island protection and development plans and policies and supervising the implementation thereof; administering the use of uninhabited islands; and issuing the catalogue of islands which are open to the outside and those under protection.
