Announcement of the Supreme People's Court of the People's Republic of China
Provisions of the Supreme People's Court on Issues Concerning the Application of the Procedures for Suspending the Execution of Death Penalty, which were adopted at the 1455th meeting of the Judicial Committee of the Supreme People's Court on November 24, 2008, are hereby promulgated and shall come into force on December 26, 2008.

Provisions of the Supreme People's Court on Issues Concerning the Application of the Procedures for Suspending the Execution of Death Penalty
(Interpretation No. 16 [2008] of the Supreme People's Court)
In order to ensure the legal and regulatory implementation of the procedures for suspending the execution of death penalty in death penalty cases, these Provisions are formulated according to the Criminal Procedure Law of the People's Republic of China and other relevant provisions, and in consideration of the practice of criminal trials.

最高人民法院《关于适用停止执行死刑程序有关问题的规定》已于2008年11月24日由最高人民法院审判委员会第1455次会议通过。现予公布，自2008年12月26日起施行。

最高人民法院关于适用停止执行死刑程序有关问题的规定
（法释〔2008〕16号）
为确保死刑案件停止执行死刑程序依法规范进行，根据《中华人民共和国刑事诉讼法》等有关规定，结合刑事审判实践，制定本规定。

Article 1 The judgment “may contain an error” as prescribed in Articles 211 and 212 of the Criminal Procedure Law shall include the following circumstances:
| | 第一条 刑事诉讼法第二百一十一条、第二百一十二条规定的判决“可能有错误”包括下列情形：
|
(1) It is found that the criminal may commit other crimes;
| | （一）发现罪犯可能有其他犯罪的；
|
(2) Other suspects of the joint offence are brought to justice, which may influence the determination of punishment on the criminal;
| | （二）共同犯罪的其他犯罪嫌疑人归案，可能影响罪犯量刑的；
|
(3) The execution of death penalty on other criminals of the joint offence is suspended or stopped, which may influence the determination of punishment on the criminal; and
．．．．．． | | （三）共同犯罪的其他罪犯被暂停或者停止执行死刑，可能影响罪犯量刑的；
