The Provisions of the Customs of the People's Republic of China on the Procedure for Handling Simple Administrative Punishment Cases, which were deliberated and adopted at the executive meeting of the General Administration of Customs on February 23, 2010, are hereby promulgated, and shall come into force on April 1, 2010.

Article 1 To regulate the procedure for the customs to handle simple administrative punishment cases, these Provisions are formulated pursuant to the Administrative Punishment Law of the People's Republic of China (hereinafter referred to as the Administrative Punishment Law), the Customs Law of the People's Republic of China and the Regulation of the Customs of the People's Republic of China on the Implementation of Administrative Punishments (hereinafter referred to as the Punishment Regulation).
| | 第一条 为了规范海关办理行政处罚简单案件程序，根据《中华人民共和国行政处罚法》（以下简称《行政处罚法》）、《中华人民共和国海关法》、《中华人民共和国海关行政处罚实施条例》（以下简称《处罚条例》），制定本规定。

Article 2 Simple cases refer to the cases about violations of the customs supervision provisions, which are discovered by the customs at the scene of the business of post delivery, express mails, storage of goods, bonded supervision, or in any other business under customs supervision or the customs statistics business and where facts are clear, circumstances are minor and administrative punishment notices can be made and issued on the spot after field inspection.
| | 第二条 简单案件是指海关在行邮、快件、货管、保税监管等业务现场以及其他海关监管、统计业务中发现的违法事实清楚、违法情节轻微，经现场调查后，可以当场制发行政处罚告知单的违反海关监管规定案件。
