The higher people's courts, higher people's procuratorates, departments (bureaus) of public security, departments (bureaus) of national security and judicial departments (bureaus) in all provinces, autonomous regions and municipalities directly under the Central Government; the Military Court and Military Procuratorates of the PLA, and the Security Section of the General Political Department of the PLA; the Production and Construction Corps Branch of the Higher People's Court of Xinjiang Uygur Autonomous Region, and the People's Procuratorate, the Public Security Bureau, the Judicial Bureau and Prison Administration Bureau of Xinjiang Production and Construction Corps,
To accomplish the reform tasks of the Central Government “ to clarify and regulate the procedures for the procuratorial organs' investigation of offences and motion for changing the persons that handles cases, and improve the legal supervisory measures”, and further deepen the reform of the judicial system and work mechanism, the Supreme People's Court, Supreme People's Procuratorate, the Ministry of Public Security, the Ministry of National Security and the Ministry of Justice formulated Several Provisions of the Supreme People's Court, the Supreme People's Procuratorate, the Ministry of Public Security, the Ministry of National Security and the Ministry of Justice on Intensifying the Legal Supervision of Judicial Functionaries' Dereliction of Duty in Litigation Activities (for Trial Implementation), which are hereby issued to you for your earnest implementation. If you have any problem during the implementation thereof, please timely report it to the Supreme People's Court, the Supreme People's Procuratorate, the Ministry of Public Security, the Ministry of National Security or the Ministry of Justice.

各省、自治区、直辖市高级人民法院、人民检察院、公安厅（局）、国家安全厅（局）、司法厅（局），解放军军事法院、军事检察院、总政治部保卫部，新疆维吾尔自治区高级人民法院生产建设兵团分院、新疆生产建设兵团人民检察院、公安局、司法局、监狱管理局：
为落实中央关于“依法明确、规范检察机关调查违法、建议更换办案人等程序，完善法律监督措施”的改革任务，进一步深化司法体制和工作机制改革，最高人民法院、最高人民检察院、公安部、国家安全部、司法部制定了《最高人民法院、最高人民检察院、公安部、国家安全部、司法部关于对司法工作人员在诉讼活动中的渎职行为加强法律监督的若干规定（试行）》。现印发给你们，请认真遵照执行。各地在执行中遇到的问题，请及时报告最高人民法院、最高人民检察院、公安部、国家安全部、司法部。

Article 1 To intensify the legal supervision of the judicial functionaries' dereliction of duty in litigation activities, improve and regulate the supervisory measures and ensure the judicial functionaries' impartiality in judicial work, these Provisions are formulated in accordance with the Criminal Law of the People's Republic of China, the Criminal Procedure Law of the People's Republic of China, the Civil Procedure Law of the People's Republic of China, the Administrative Procedure Law of the People's Republic of China and other relevant laws.
| | 第一条 加强对司法工作人员在诉讼活动中的渎职行为的法律监督，完善和规范监督措施，保证司法工作人员公正司法，根据《中华人民共和国刑法》、《中华人民共和国刑事诉讼法》、《中华人民共和国民事诉讼法》、《中华人民共和国行政诉讼法》等有关法律的规定，制定本规定。

Article 2 The people's procuratorate shall conduct legal supervision over litigation activities according to law. It may conduct legal supervision over judicial functionaries' dereliction of duty by taking such measures as examining case files, investigating and verifying facts of offences, making suggestions about correction of the offences or changing the persons that handle the cases, and filing cases for investigation of job-related crimes.
| | 第二条 人民检察院依法对诉讼活动实行法律监督。对司法工作人员的渎职行为可以通过依法审查案卷材料、调查核实违法事实、提出纠正违法意见或者建议更换办案人、立案侦查职务犯罪等措施进行法律监督。

Article 3 Where a judicial functionary is under any of the following circumstances in litigation, it may be determined that he is suspected to have committed a dereliction of duty, and the people's procuratorate shall investigate and verify it:
| | 第三条 司法工作人员在诉讼活动中具有下列情形之一的，可以认定为司法工作人员具有涉嫌渎职的行为，人民检察院应当调查核实：
|
1. bending the law for private benefits or for the benefit of his relatives or friends, knowingly making an innocent person prosecuted, or knowingly harboring a guilty person and preventing him from being prosecuted, intentionally making a ruling which is inconsistent with the facts and contravenes the law during the trial of a case;
| | （一）徇私枉法、徇情枉法，对明知是无罪的人而使其受追诉，或者对明知是有罪的人而故意包庇不使其受追诉，或者在审判活动中故意违背事实和法律作枉法裁判的；
|
2. illegally imprisoning anyone or illegally depriving anyone of his personal freedom by any other means;
| | （二）非法拘禁他人或者以其他方法非法剥夺他人人身自由的；
|
3. illegally searching the body or residential house of anyone, or illegally trespassing into anyone's abode;
| | （三）非法搜查他人身体、住宅，或者非法侵入他人住宅的；
|
4. extorting the confession of a criminal or suspect or forcing a witness to give testimonies by violence, or obstructing, by violence, threat or bribery, others from giving testimony, or instigating anyone to give false witness, or helping any party concerned to destroy or forge evidence;
| | （四）对犯罪嫌疑人、被告人实行刑讯逼供或者使用暴力逼取证人证言，或者以暴力、威胁、贿买等方法阻止证人作证或者指使他人作伪证的，或者帮助当事人毁灭、伪造证据的；
|
5. misappropriating or illegally disposing of money or other properties sealed up or detained or frozen;
| | （五）侵吞或者违法处置被查封、扣押、冻结的款物的；
|
6. keeping a criminal suspect or defendant in custody beyond the term of detention, term of detention for investigation or term for handling a case as prescribed in law, and the circumstance is serious;
| | （六）违反法律规定的拘留期限、侦查羁押期限或者办案期限，对犯罪嫌疑人、被告人超期羁押，情节较重的；
|
7. illegally releasing a criminal suspect, defendant or criminal in custody, or being severely derelict in his duty, which lead to the escape of a criminal suspect, defendant or criminal in custody;
| | （七）私放在押的犯罪嫌疑人、被告人、罪犯，或者严重不负责任，致使在押的犯罪嫌疑人、被告人、罪犯脱逃的；
|
8. making favoritism, i.e., illegally making a proposal or ruling or decision or approval of reduction of sentence, release on probation or temporary service outside prison in favor of a criminal who does not meet the relevant requirements for reduction of sentence, release on probation or temporary service outside prison;
| | （八）徇私舞弊，对不符合减刑、假释、暂予监外执行条件的罪犯，违法提请或者裁定、决定、批准减刑、假释、暂予监外执行的；
|
9. being severely derelict in his duty or abusing his power during the execution of a judgment or ruling, i.e. failing to take preservation measures in litigation according to law or failing to fulfill the statutory execution duties, or illegally taking preservation measures in litigation according to law or enforcement measures and resulting in damages to the lawful rights and interest of the party concerned or others;
| | （九）在执行判决、裁定活动中严重不负责任或者滥用职权，不依法采取诉讼保全措施、不履行法定执行职责，或者违法采取诉讼保全措施、强制执行措施，致使当事人或者其他人的合法利益遭受损害的；
|
10. punching or maltreating a person in custody or instigating a person in custody to punch or maltreat anyone in custody;
| | （十）对被监管人进行殴打或者体罚虐待或者指使被监管人殴打、体罚虐待其他被监管人的；
|
11. accepting or extorting bribes from anyone or his close relative or his authorized person; or
| | （十一）收受或者索取当事人及其近亲属或者其委托的人等的贿赂的；
|
12. committing other litigation-related offences and duty-related crimes in serious violation of the Criminal Procedure Law, the Civil Procedure Law, the Administrative Procedure Law or the Criminal Law, namely, failing to perform the duties according to law, damaging the lawful rights of a party concerned or affecting the judicial impartiality.
．．．．．． | | （十二）其他严重违反刑事诉讼法、民事诉讼法、行政诉讼法和刑法规定，不依法履行职务，损害当事人合法权利，影响公正司法的诉讼违法行为和职务犯罪行为。
